ROLL CALL AND PLEDGE OF ALLEGIANCE Present: Commissioners: Abraham, Couperus, Mandle, Tankha, Chair Partridge Absent: None Staff: Debbie Pedro, Planning Director; Nicole Horvitz, Assistant Planner; Cynthia Richardson; Consultant Plaririer; Deborah Padovan; City -Clark 2. PRESENTATIONS FROM THE FLOOR There were no presentations from the floor. 3. PUBLIC HEARINGS 3_1 LANDS OF WALLACE, Stonebrook Drive, APN# 336-23-020 & 021, File # 137-11 MISC. Approval of a Final Map Amendment to show a corrected Geologic Fault trace. CEOA Review: Exempt per section 15305. (Staff -C Richardson). Consultant Planner Cynthia Richardson presented the staff report. Commission discussion ensued. Chair Partridge opened the PUBLIC HEARING. Applicant Robert Wallace provided a history on the property. , Geologist John O'Rourke responded to questions from the Commission. Glenn Wilkerson, Los Altos Hills, expressed his concern that due to an error made years ago, he is uncertain whether or not he has a seismic fault on his property. He Planning Commission Regular Meeting Minutes December 6, 2012 requested that the inaccurate information regarding the fault line on his property be removed from the map. Planning Director Debbie Pedro responded to questions from the Commission. Ernie Solomon, Los Altos Hills, stated that he is a retired geologist and expressed his opinion. Ted Sayer, Cotton Shires & Associates, has been in contact with the California Geologic Survey and they are overseeing the fault investigation at Foothill College that's being done by Cleary Consultants. This work will change the location of the Monte Vista fault line through the campus. Mr. Wallace requ ested that the work they have conducted will be considered independently from Foothill so they may develop their property. Chair Partridge closed the PUBLIC HEARING. Discussion ensued. MOTION MADE AND SECONDED: to forward a recommendation to the City Council for approval of a Final Map Amendment to show a corrected Geologic Fault trace. Moved by Commissioner Couperu s. The motion was seconded by Commissioner Abraham. AYES: Commissioners: Partridge NOES: None ABSENT: None MOTION CARRIED. Abraham, Couperus, Mandle, Tankha, Chair 3.2 LANDS OF CALIFORNIA DEPARTMENT OF TRANSPORTATION (APPLICANT: SPRINT WIRELESS); 2350 Page Mill Road, File #187 -12 -SD - CUP; a request for a Conditional Use Permit renewal for an existing/previously approved wireless communications facility and modifications to the antennas and ground equipment. CEQA review: Exempt per 15 3 01 (a). (Staff -Nicole Horvitz). Assistant Planner Nicole Horvitz presented the staff report. Commission asked questions of staff. 2 Planning Commission Regular Meeting Minutes December 6, 2012 Commissioner Abraham discussed changing language to include "The applicant shall not cause radiation in the frequencies allocated to the amateur radio service." Chair Partridge opened the PUBLIC HEARING. Rosemary Burn, Representative for Sprint, there is no objection to the extra condition of approval. The language is acceptable to Sprint. Chair Partridge closed the PUBLIC HEARING. MOTION MADE AND SECONDED: to forward a recommendation to the City Council to approve a request for a Conditional Use Permit renewal for an existing/previously approved wireless communications facility and modifications to the antennas and ground equipment, with conditions as amended to include, that operation of equipment is not to produce levels of radiation higher than -127dbm in the frequencies allocated. And noise shall be measured, per the Town ordinance (LAHMC Section 5-2.02), from the property boundary when the noise source is on private property. Moved by Commissioner Abraham. The motion was seconded by Commissioner Couperus. AYES: Commissioners Partridge NOES: None ABSENT: None ABSTAIN: None MOTION CARRIED. Commission recess 7:57 Abraham, Couperus, Mandle, Tankha, Chair Commission reconvened at 8:02 p.m. 3_3 LANDS OF PURISSIMA HILLS WATER DISTRICT (APPLICANT: SPRINT WIRELESS); 12863 La Cresta Drive, File #46 -12 -SD -CUP; a request for a Conditional Use Permit renewal for an existing/previously pproved wireless communications facility and modifications to the antennas and ground equipment. CEOA review: Exempt per 15301(a). (Staff -Nicole Horvitzl Assistant Planner Nicole Horvitz presented the staff report. Commission discussion ensued.
