Council Chambers, 26379 Fremont Road NOTICE IS HEREBY GIVEN THAT A SPECIAL MEETING OF THE LOS ALTOS HILLS PLANNING COMMISSION WILL BE HELD ON: THURSDAY, JULY 25, 2013 at 7:00 P.M. The agenda for the special meeting is as follows: 1. ROLL CALL AND PLEDGE OF ALLEGIANCE Present: Commissioner Abraham, Commissioner Couperus, Commissioner Mandle, Chair Partridge, Commissioner Tankha Staff. None 2. REORGANIZATION OF PLANNING COMMISSION 2.1 Appointment of New Chair MOTION MADE AND SECONDED: Chair Partridge moved to nominate Commissioner Abraham for the position of Chair. The motion was seconded by Commissioner Couperus. AYES: Commissioner Partridge, Commissioner Couperus, Commissioner Mandle, Commissioner Tankha NOES: None ABSENT: None ABSTAIN: Commissioner Abraham MOTION CARRIED. Chair Abraham recognized Commissioner Partridge and presented him with a gift for his service as Chair. Special Planning Commission Meeting Minutes July 25, 2013 1 MOTION MADE AND SECONDED: Commissioner Couperus moved to nominate Commissioner Mandle for the position of Vice -Chair. The motion was seconded by Commissioner Partridge. PRESENTATIONS FROM THE FLOOR Paul Jensen, Los Altos Hills, wants to create a focus group to look at the setback ordinance and how it is actually being enforced. Samuel Broydo, Los Altos Hills, stated his concerns regarding the draft Circulation Element. Requests the Commission study the draft proposal. 4. PUBLIC HEARINGS 4.1 LANDS OF JALIL. Middle Fork Lane (APN 182-10-050 & 182-10-05 #311-11-ZP-SD-GD; A request for a Site Development Permit for a 8,437 square foot two story new residence (Maximum height 32') with a 3,097 square foot basement and a 606 square foot swimming pool. The applicant is also requesting the removal of six (6) heritage oak trees and a Grading Policy Exception for up to 11' of fill and 15' of cut for the new residence, driveway, fire truck turnaround, swimming pool, and yard areas. CEQA Review: Categorical Exemption per Section 15303 (a)(e) (Staff -Nicole Horvitz). Ex Parte Communications: Commissioner Tankha reported that she had met with the Jalils. Commissioner Partridge reported that he spoke with the Jalils. Commissioner Mandle reported that she spoke with both the Jalils, and the Designer Scott Stotler. Commissioner Couperus reported he met with the Jalils and Mr. Stotler, as well as a neighbor. Chair Abraham reported that spoke with the Jalils, as well as Mr. Stotler. Assistant Planner Nicole Horvitz presented the staff report. Ms. Horvitz noted a correction to the staff report; the report states six (6) heritage oaks are to be removed, when in fact there are only five (5). Commission asked questions of staff. Special Planning Commission Meeting Minutes July 25, 2013 Chair Abraham opened the PUBLIC HEARING. Designer Scott Stotler spoke in support of the project. Applicant Rehan Jalil spoke in support of his project and presented a powerpoint presentation to the Commission. Commission asked questions of the applicant and designer. Steve Hartzell, designed the septic system for this property and spoke to the efficacy of the system. Mark Helton, Giuliani and Kull, addressed grading on the property, as well as answered grading questions in regards to the fire truck turnaround, posed by the Commission. John Conover, Los Altos Hills, is not opposed to development on the lot, but is opposed to the request for a grading exception. Linda Conover, Los Altos Hills, lives at the top of the hill and will be directly impacted by the development. She is concerned with the request for a grading exception. Mike Kuranoff, Los Altos Hills, expressed concern over the amount of grading being requested. Chris Green, Los Altos Hills, is concerned about the septic field as it ends at her house and the grading/cut when it comes to landslides and earthquakes. Donna Prudence, Los Altos Hills, is concerned with the grading, the septic, and states they should come up with a better design with less of an impact on the neighborhood. Mr. Stotler gave a closing statement. Mr. Jalil gave a closing statement. Mr. Hartzell spoke to the concerns of septic springs; there is no significant underground water in the area that could be contaminated. Ted Sayre, Cotton and Shires and Assoc., spoke to the slope stability of the property. Chair Abraham closed the Public Hearing. Commissioner Couperus affirmed that this is a difficult lot to develop on, but he believes there is a better design for this lot, in regards to cut and fill, than the one presented. Commissioner Mandle acknowledged the positive aspects of the project, but the grading is excessive, and the removal of the oak trees could have a negative effect on the remaining trees. Commissioner Partridge a cknowledged t hat t he 1 of i s d ifficult, b ut b uildable. Stated that the home needs to embrace the contours of the land. He had concerns about the removal of so many oak trees. Commissioner Tankha acknowledged the positive aspects of the project, andA stated that exceptions will be required on this lot, but she is not comfortable supporting the project with the grading levels as it is. Chair Abraham summarized that the commission has concerns about the proposed design. He offered the applicant two (2) options: ask for the commission to vote to approve or deny, or continue the project so he can come back with new plans. Planning Director Debbie Pedro recommended the design review consultation option. Mr. Jalil requested that the project be continued to revise his plans. MOTION SECONDED AND CARRIED: Moved by Commissioner Partridge, seconded by Commissioner Couperus and passed unanimously to continue the application for a new residence to a date uncertain. AYES: Chair Abraham, Commissioner Couperus , Commissioner Mandle, Commissioner Partridge, Commissioner Tankha NOES: None ABSENT: None ABSTAIN: None MOTION CARRIED. Chair Abraham called for recess at 9:25. Chair Abraham resumed the meeting at 9:36. Special Planning Commission Meeting Minutes July 25, 2013 4 4.2 AMENDMENT TO THE ZONING ORDINANCE WITH REGARD TO OFF STREET PARKING REQUIREMENTS FOR SECONDARY DWELLING UNITS. (Section 10-1.601) The draft ordinance would not require unobstructed access for secondary dwelling unit parking (Staff- Brian Froelich). Planning Director Debbie Pedro presented the staff report. Commission asked questions of staff. MOTION SECONDED AND CARRIED: Moved by Commissioner Tankha, seconded by Commissioner Couperus and passed unanimously to forward a recommendation to the City Council to adopt the proposed amendment to the Los Altos Hills Municipal Code regarding parking. AYES: Chair Abraham, Commissioner Couperus , Commissioner Mandle, Commissioner Partridge, Commissioner Tankha NOES: None ABSENT: None ABSTAIN: None MOTION CARRIED. 4.3 AMENDMENT TO THE ZONING ORDINANCE TO EXTEND THE SUNSET PROVISION OF LOS ALTOS HILLS MUNICIPAL CODE SECTION 10-1.502 (B) (,66) (viii) UNTIL JULY 30, 2018. The draft ordinance extension would continue the development area bonus for the installation of roof mounted solar panels for five (5) ears (Staff- Brian Froelich). Planning Director Debbie Pedro presented the staff report. Commission asked questions of staff. Commissioners discussed making an amendment to replace the word "regulation" with the word "ordinance" in paragraph V. MOTION SECONDED AND CARRIED: Moved by Commissioner Partridge, seconded by Commissioner Mandle and passed unanimously to forward a recommendation to the City Council to approve an amendment to the Zoning Ordinance to extend the Sunset Provision of the Los Altos Hills Municipal Code Section 10-1.502 (B) (6) (viii) UNTIL JULY 30, 2018, with an amendment to paragraph V to replace the word "regulation" with the word "ordinance". APPROVAL OF MINUTES 8.1 Approval of July 7, 2013 minutes. Planning Director Debbie Pedro noted a correction on the Agenda as the meeting was July 1, not July 7. MOTION MADE AND SECONDED: Commissioner Partridge moved to approve the July 1, 2013 minutes. The motion was seconded by Commissioner Tankha. The applicant is also requesting to remove one (1) heritage oak tree. The applicant is also requesting approval of the removal of one (1) heritage oak tree. The proposal adjusts the side property line between the subject properties with no resulting change to lot size, MDA, or MFA. CEQA review: exempt per 15305 (a). (Staff -Brian Froelich).
