Because the Chens' proposed house is so much larger than others nearby and because it is the first house visible on entering Gerth Lane, the visual impact is huge and counter to the semi -rural feel of our street. Therefore, we ask that the house conform to the town's rules, and that no variance on the 50 -foot right-of-way requirement be granted. Since a large house can be fit into the allowable area, a waiver is unnecessary. We also question the decision to allow this property to be defined as a corner lot. The plans show that all access is directly from Gerth Lane, and in fact, access from "the front" is impossible because of Matadero Creek. Calling this a corner lot has allowed the house to be 10 feet closer to Gerth, with a 30' setback instead of 401 . The net effect of allowing these two conditions is to set the house 20 feet closer to the road than would otherwise be allowed. In conclusion, 1) We oppose the right-of-way variance. 2) We oppose the corner lot designation. 3) We support having the plans conform to the existing rules. In addition, if the plans are approved, we ask that storm water drainage be addressed, since this property is near the bottom of our hill and also request that parking during construction be limited to the Chen's side of the road. Mott MacDonald reviewed right-of-way. requirements for .Gerth Lane located in Los Altos Hills, California. In conjunction with the redevelopment of an, existing single-family residence located at 2210 Old Page Mill Road, the Town of Los Altos Hills has requested that a roadway dedication of 20 feet be provided along the Gerth Lane project frontage to increase the right-of-way from 30 feet to 50 feet. A right-of-way dedication of 10 feet is proposed by the Project applicant; which would provide a right-of-way of 40 feet. The project location with respect to the local road network is shown on Exhibit L. -The project site plan is shown on Exhibit 2. Based on guidelines published . by The American Association of State Highway . and Transportation Officials (AASHTO), a total roadway width of. 20 feet would be adequate were the road ever to be- widened. Currently, there are no plans to widen the -roadway. The recommended roadway width for Gerth Lane is based on the volume of traffic carried by Gerth Lane, the land use served by the road and the function of the road as explained below. Gerth Lane is an existing private one -lane cul-de-sac road, approximately 1,500 feet in length. Gerth Lane provides access to 14 parcels, 12 of which are currently developed with single-family residential homes. A one -lane bridge is located on-Gerth Lane approximately 60 feet from the intersection at Old Page Mill Road. Gerth Lane carries less than 400 vehicles per day and is, therefore, classified as a low-volume, local. road. Based on Institute of Transportation Engineers trip generation rates, the homes accessed from Gerth Lane generate a total of 120 trips .per day (10 trips per day x 12 homes). Development of the two existing vacant parcels with single-family homes would increase the vehicle trips generated by Gerth Lane development to 140 trips per day (10 trips per day x'14 homes). - AASHTO publishes- guidelines for the geometric design of :very low-volume local roads., Low- volume roads are roads that carry 400 vehicles per day or less. Gerth Lane functionally operates as a Rural Minor Access Road. These are the characteristics of Gerth Lane. Exhibit 3 shows the AASHTO guidelines for total roadway width for new construction of very low-volume local roads in rural areas. The AASHTO recommended total roadway width, including shoulders, for a rural minor access road is 18 feet for a design speed under 40 miles per hour. An 18 foot roadway within a 40 foot right-of-way would provide 11 additional feet of shoulder/clear space on each side of the roadway, assuming the road was centered within the right-of-way. AASHTO publishes guidelines for low-volume local streets in urban areas and those guidelines are shown on Exhibit 4. For a low development density, which. is applicable to Gerth Lane, the AASHTO guideline for a low-volume local road in an urban area is 20 to 28 feet. The guidelines are referenced from the ITE Recommended Guidelines for Subdivision Streets. The lower end of the range is applicable to residential streets with sufficient off-street parking such that on -street parking is only occasionally required, which is the case with the Gerth Lane neighborhood. Therefore, a total roadway width of 20 feet would be appropriate based on the new construction urban residential street guidelines. A 20 foot roadway within a 40 foot right-of-way would provide 10 additional feet of shoulder/clear space on each side of the roadway, assuming the road was centered within the right-of-way. The AASHTO recommended rural and urban roadway widths for local minor access roads and residential streets are applicable to new construction. The cross section widths of existing roads do not necessarily need to be modified except where there is evidence of a site specific safety problem. According to the project applicant, there have been no reported vehicle crashes on Gerth Lane for the last several years. Where site-specific safety problems do not exist, it is not likely that any road improvement would provide substantial safety benefits. The one -lane design of Gerth Lane is not uncommon in rural areas nor uncommon in Los Altos Hills. Therefore, widening Gerth Lane to provide a wider roadway is not recommended at this time. In summary, on the basis of the AASHTO urban residential street guidelines, a roadway width of 20 feet would be adequate for Gerth Lane, although AASHTO guidelines support an 18 foot roadway based on guidelines for rural areas. The ultimate widening of Gerth Lane to 20 feet can be accomplished within a right-of-way of 40 feet. This would allow 10 feet of additional shoulder/clear space on each side of the roadway with the roadway centered in the right-of-way, or 20 feet of shoulder/clear space on Project side of the roadway if the existing south edge of pavement was maintained at its existing location. We.Sm W. llawthms Row YrR M-2000 • Mr. Gerth, the original land owner, formed larger parcels on one side and set the easements for the road largely on the larger properties, in a continuous row. • In 1957, Gerth Lane owners established a Road Maintenance Agreement which recorded the easement shall be maintained by owners with lot size one acre or more. This agreement is recorded in the deed. • In 1985, Mr. Cochrane subdivided his property into three parcels and continued to dedicate the 30' easement from those newly created parcels. • Participating properties shall consist of Class A improved, and Class B unimproved, acre or more...... contained in their deeds...... We appreciate the opportunity to express our concerns regarding the proposed development. My husband Richard and I together with our 3 young children moved to the area in August 2003. We were attracted to the neighbourhood due to its semi rural/rustic feel and the benefits that this feel afforded our children. Most of the homes are obscured from the road and we note that recent remodels such as 2344 Old Page Mill Road and 2102 Old Page Mill Road have re -landscaped their properties so as to maintain their' visibility from the road and the semi rural feel. The Chens' proposed house is so much larger than others nearby and it is the first house visible upon entering Gerth Lane, thus, the visual impact is enormous and counter to the semi -rural feel of our street and neighbourhood. Therefore, we ask that the house conform to the town's rules, and that no variance on the 50 -foot right-of-way requirement be granted. Since a large house can adequately fit into the allowable area, a waiver is unnecessary. We also question the decision to allow this property to be defined as a corner lot. The plans show that all access is directly from Gerth Lane, and in fact, access from "the front" is impossible because of Matadero Creek. Labeling this as a corner lot has granted the proposed house to be 10 feet closer to Gerth, with a 30' setback instead of 40'. The net effect of allowing these two conditions would set the house 20 feet closer to the road than would otherwise be permitted In conclusion, 1) We oppose the right-of-way variance. 2) We oppose the corner lot designation. 3) We support having the plans conform to the existing rules.
