HomeMy WebLinkAbout1584 , RESOLUTION NO. 1584 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE TOWN OF LOS ALTOS HILLS DECLARING THE INTENTION OF SAID CITY TO VACATE AND ABANDON A PORTION OF A CER- TAIN TRAIL EASEMENT LOCATED IN THE CITY OF THE TOWN OF LOS ALTOS HILLS UNDER THE PROVISIONS OF THE "PUBLIC STREETS, HIGHWAYS AND SERVICE EASEMENTS VACATION LAW" , SECTION 8300 ET SEQ. , OF THE STREETS AND HIGHWAYS CODE It appearing to the City Council of the City of the Town of Los Altos Hills that a portion of a certain trail easement located within Lot 26 , Tract No . 6297 within the City of the Town of Los Altos Hills should be vacated and abandoned for the reason that the said easement is unnecessary for present or prospective public pur- poses , and that the best interests of the citizens of Los Altos Hills will be served by such vacation and abandonment ; And, pursuant to the provisions of the "Public Streets , High- ways and Service Easements Vacation Law," Section 8300 , et seq. , of the Streets and Highways Code , such action is authorized if said easement is unnecessary for present or prospective public use ; NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the City Council of the City of the Town of Los Altos Hills as follows : 1 . The City Council does hereby declare its intention to vacate and abandon that certain portion of a trail easement des- cribed in Exhibit "A" attached hereto and incorporated herein by ` reference, and to conduct the vacation proceeding under the "Public Streets , Highways and Service Easements Vacation Law" . 2 . That there is no official name by which the portion of the trail easement described in Exhibit "A" , and proposed to be aban- doned is commonly known. 3 . A hearing on said proposed vacation and abandonment of the said easement hereinabove described, be and the same is hereby fixed for Wednesday, OCTOBER 5, 1983 , at the hour of 7 : 30 o ' clock P.M. of said day at the Council Chambers , Town Hall, 26379 Fremont Road, Los Altos Hills , California, notice of which hearing is hereby given, at which time and place all persons interested in -1- . . , • 0 t ' or objecting to said proposed vacation and abandonment may appear and present objections to said proposed vacation and abandonment , and submit to said City Council evidence in support thereof, under and in conformity with the provisions of said "Public Streets , Highways and Service Easements Vacation Law" . 4 . Reference is hereby made to the map and/or plat of the portion of said easement above-described, on file in the office of the City Clerk, Town Hall , Los Altos Hills , California; for further particulars and said map and/or plat is incorporated herein and made a part thereof. 5 . The proposed vacation and abandonment be submitted to the Los Altos Hills Planning Commission, to be considered by said body and a recommendation returned to the City Council at said hearing. 6 . That this Resolution be published for two successive weeks in the PENINSULA TIMES TRIBUNE, a daily newspaper published and circulated in the County of Santa Clara, there being no newspaper published and circulated in the City of the Town of Los Altos Hills , and that at least three notices of said vacation and abandonment , which notices shall state the passage of this Resolution of Inten- tion and of the day, hour and place of hearing thereunder, be posted not more than 300 feet apart along the line of public trail easement proposed to be abandoned at least two weeks before the day of the hearing , under the provisions of the "Public Streets , Highways and Service Easements Vacation Law" . " as shown within lot 26 of said Tract No . 6297 .
