RESOLUTION NO. 1520
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE TOWN
OF LOS ALTOS HILLS ORDERING THE VACATION AND ABANDONMENT
OF A PORTION OF A CERTAIN PUBLIC SERVICE EASEMENT IN THE
CITY OF THE TOWN OF LOS ALTOS HILLS UNDER THE PROVISIONS
OF THE "PUBLIC SERVICE EASEMENTS VACATION LAW"
ORDER OF VACATION AND ABANDONMENT
WHEREAS, the City Council of the City of the Town of Los Altos
Hills, under and pursuant to the provisions of the "Public Service
Easements Vacation Law" , Section 50430, et seq. , Government Code, did
on the 1st day of December , 1982 , pass and adopt Resolution
No. 1504 , declaring the intention of said City Council to vacate and
abandon a portion of a certain public service easement, and described
in Exhibit "A" , attached hereto and incorporated herein by reference; and
WHEREAS , a Public Hearing was had on the 5th day of January
1983 , in the Council Chambers , Town Hall, 26379 Fremont Road, Los Altos
Hills, California, whereat said proposed vacation and abandonment were
duly considered, and said matter submitted to said City Council for
action; and
WHEREAS, notice of said Hearing was duly given and made in the
time, form and in the manner requited in the aforementioned Statute,
and proof thereof is on file with said City Council; and
WHEREAS , no protests, either written or oral, were filed with or
received by said City Council respecting said proposed vacation and
abandonment, and the Planning Commission having submitted its report
and recommendation;

AND, said City Council being advised in said matter finds that,
from all the evidence submitted, the above-described portion of the
public service easement is unnecessary for present or prospective
public purposes by reason of the following findings of fact:
The portion of the easement proposed to be abandoned
is contiguous with the westerly boundary line of the
property through which it runs.
Both Pacific Telephone and the Purissima Hills
County Water District have advised that they do not main-
tain any facilities within the portion of the easement
proposed to be abandoned, nor do they anticipate any
future installations. Pacific Gas and Electric Company
advised that it had no objection to the proposed aban-
donment.
By reason of the present and projected non-use of
the portion of the easement in question, its continued
existence would be an unreasonable burden on the owner
through whose property it runs.
NOW, THEREFORE, BE IT AND ITIS HEREBY RESOLVED by said City
Council that the foregoing Recitals are true and correct.
BE IT FURTHER RESOLVED by said City Council that the portion of
the public service easement described in Exhibit "A" is hereby vacated
and abandoned as being unnecessary for present or prospective public
purposes, and that the easement and the right herein vacated and abandoned
is described in Exhibit "A" , attached hereto and incorporated herein by
reference.
REGULARLY passed and adopted this 5th day of January , 1983.

DESCRIPTION OF FIVE FOOT WIDE PUBLIC UTILITY EASEMENT.
ALL THAT CERTAIN STRIP OF LAND FIVE FEET IN WIDTH SITUATE IN
THE TOWN OF LOS ALTOS HILLS, COUNTY OF SANTA CLARA, STATE OF
CALIFORNIA, THE WESTERLY LINE OF WHICH. IS DESCRIBED AS FOLLOWS:
Beginning at the northwest property corner of Lot #2, Tract
#19.08 , titled Esperanza Hills, recorded in Book 85 of Maps on
Page 55 in the Office of the County Recorder. of Santa Clara
County, said property corner also being the northeast property
corner of Lot #3 of said Tract; thence,
Along the common property lines of Lots #2 & #3 of said sub-
division, S21° 10 ' 00" E, 126 . 38 ft. ; S3° 51' 51" W, 176 .53 ft.
to the end of the easement.
