RESOLUTION NO. 1370
• RESOLUTION GRANTING APPROVAL FOR THE DIVISION
OF THE ESHNER PROPERTY INTO ADDITIONAL BUILDING SITES
RESOLVED, by the City Council of the City of the Town of Los
Altos Hills, County of Santa Clara, State of California, that
WHEREAS, heretofore Jules Eshner and Margaret Eshner and Julie
Eshner entered into an agreement with the City of the Town of Los
Altos Hills whereby the number of building sites into which the •
real property described therein could be divided was limited to
sixteen building sites , unless thereafter the express written
approval to the division of the real property into additional
building sites was given by Resolution of the City Council; and
WHEREAS, the above-described agreement entitled "Agreement
and Covenants Running with the Land" thereafter on May 29, 1968,
was recorded in Book 8129 at Page 236 of the Official
Records of the Santa Clara County Recorder; and
WHEREAS, approval of the division of the real property des-
cribed in the agreement into additional building sites having been
requested, .
• NOW, THEREFORE, the City Council of the City of the Town of
Los Altos Hills hereby grants its approval to the division of the
property described in the agreement referred to above into not
more than a total of nine (9) single family dwelling building sites,
provided, however, (1) that prior to the approval of any Tentative
Subdivision or Parcel Map the owners of the real property described
in the agreement referred to above and the proposed subdivider
shall covenant in writing to pay to Sewer Assessment District No.

Two one sewer assessment share for each additional building site
shown on the proposed Tentative Subdivision or Parcel Map; and
(2) that within one (1) year from July 13, 1981, or upon the
recording of any Final Subdivision or Parcel Map, whichever shall
first occur, the owners of the real property described in the
agreement referred to above and the proposed subdivider shall pay
to the City of the Town of Los Altos Hills the sum of Two Hundred
Thousand Dollars ($200, 000) to be utilized in the purchase of
appropriate open space land within the City of the Town of Los
Altos Hills .
