RESOLUTION NO . 1307
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE TOWN OF
LOS ALTOS HILLS ORDERING THE VACATION AND ABANDONMENT OF
AN EMERGENCY ACCESS EASEMENT AND PORTIONS OF CERTAIN SANITARY
SEWER AND PATHWAY EASEMENTS LOCATED IN THE CITY OF THE TOWN
OF LOS ALTOS HILLS , UNDER THE PROVISIONS OF THE "PUBLIC
SERVICE EASEMENTS VACATION LAW"
ORDER OF VACATION AND ABANDONMENT
WHEREAS , the City Council of the City of the Town of Los Altos
Hills , under and pursuant to the provisions of the "Public Service
Easements Vacation Law" , Section 50430 , et seq . , Government Code ,
did on the 16th day of July, 1980 , pass and adopt Resolution No . 1290 ,
declaring the intention of said City Council to vacate and abandon
that certain emergency access easement described in Exhibit "A" , and
a portion of that certain sanitary sewer easement described in Exhibit
"B", and a portion of that certain pathway easement described, in
Exhibit "C" , respectively, each of which is attached hereto and incor-
porated herein by reference ; and
WHEREAS, a public hearing was had on the 21st day of August , 1980 ,
in the Council Chambers , Town ;Hall , Los Altos Hills , California, whereat
said proposed vacation and abandonment were duly considered, and said
matter submitted to said City Council for action; and
WHEREAS, notice of said hearing was duly given and made in the
time , form, manner and by posting, in the manner required by the afore-
mentioned Statute , and proof thereof is on file with said City Council ;
and
WHEREAS , no protests , either written or oral , were filed with or
received, by said City Council respecting said proposed vacation and
abandonment , and the Planning Commission submitted its report and
recommendation;
And said City Council being fully advised in said matter finds
that , from all the evidence submitted, that the above-described emergency
access easement and the portions . of the above-described sanitary sewer
and pathway easement , and each of them, are unnecessary for present or
prospective public purposes , by reason of the .following findings of fact ;
The easement for emergency access is no longer required because
emergency access is provided by an existing emergency . access . route for
Edgerton Road on which the property across which the easements to be
. abandoned run, fronts and which alternate emergency access is to be

retained . •
The width of the sanitary sewer and pathway easements as dedicated
has proven •to be in excess of that which is required for either instal-
lation of sewers or the accommodation of pedestrian traffic .
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by said City
.Council thatthe foregoing Recitals are true and correct .
BE IT FURTHER RESOLVED by said City Council that the certain
emergency access easement. described in Exhibit "A" , and the portion of
that certain sanitary sewer easement described in Exhibit "B" , and the
portion of that certain pathway easement described in Exhibit "C" ,

respectively, and each- of them, is hereby vacated and abandoned as being
unnecessary for present or prospective public purposes , and that the
easements - and rights herein vacated and abandoned are 'described , respec-
tively, in Exhibits "A" , . "B" and "C" , attached hereto and .incorporated
herein by reference .
REGULARLY passed and adopted this 21st day of August , 1980 .

All of that certain thirty foot (30 ' ) wide strip of land
lying easterly of and abutting the westerly line of Lot 2 ,
Tract No . 5762 , and designated E . A. E . (Emergency Access
Easement) as said Lot and Tract are shown on the map thereof
filed for record in Book 379 of Maps , Pages 36 and 37 , Santa
Clara County Records .
