Home My WebLink About1246 • • RESOLUTION NO. 1246 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE TOWN OF LOS ALTOS HILLS ORDERING THE VACATION AND ABANDONMENT OF A CERTAIN EASEMENT IN THE CITY OF THE TOWN OF LOS ALTOS HILLS, UNDER THE PROVISIONS OF THE "PUBLIC SERVICE EASEMENTS VACATION LAW" ORDER OF VACATION AND ABANDONMENT WHEREAS, the City Council of the City of the Town of Los Altos Hills, under and pursuant to the provisions of the "Public Service Easements Vacation Law" , Section 50430, et seq. , Government Code, did on the 3rd day of October, 1979, pass and adopt Resolution No. 1238 , declaring the intention of said City Council to vacate a certain Waterline easement located within Lots 1, 2 and 3, Tract No. 6314, San Antonio Rancho Unit No. 1; and WHEREAS, a public hearing was had on the 7th day of November, 1979, in the Council Chambers, Town Hall, 26379 Fremont Road, Los Altos Hills, California, whereat said proposed vacation and abandonment were duly considered, and said matter submitted to said City Council for action; and WHEREAS, notice of said hearing was duly given and made in the time, form, manner and by posting said notice in the manner required by the aforementioned Statute, and proof thereof ison file with said City Council; and WHEREAS, no protests, either written or oral, were filed with or received by said City Council respecting said proposed vacation and abandonment, and the Planning Commission submitted its report and recommendation; And said City Council being fully advised in said matter finds that, from all the evidence submitted, that the above-described Waterline easement hereinafter particularly described in Exhibit "A" , • 410 is unnecessary for present or prospective public purposes, by reason of the following findings of fact: No water utilities presently are installed within the easement described in Exhibit "A" . The City of the Town of Los Altos Hills itself does not have any need, present or future, for the easement to be abandoned. The waterline easement to be abandoned was erroneously granted to the City of the Town of Los Altos Hills which does not operate a water utility but should have been granted to California Water Service. The Subdivider of San Antonio Rancho Unit No. 1 has advised that a similar waterline easement is being conveyed to California Water Service which operates a water utility serving the above-described subdivision. NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by said City Council that the foregoing Recitals are true and correct; BE IT FURTHER RESOLVED by said City Council that the Waterline easement located within Lots 1, 2 and 3, Tract No. 6314, San Antonio Rancho, Unit No. 1 be, and the same is hereby vacated and abandoned as being unnecessary for present or prospective public purposes, and that the easement herein vacated and abandoned is described in Exhibit "A" attached hereto and incorporated herein by reference.
