HomeMy WebLinkAbout1116 • RESOLUTION NO. 1116 RESOLUTION OF THE COUNCIL OF THE CITY OF THE TOWN OF LOS ALTOS HILLS AS THE CODE REVIEWING BODY APPROVING AND ADOPTING A CONFLICT OF INTEREST CODE FOR THE DEPARTMENT OF ADMINISTRATION FOR THE TOWN OF LOS ALTOS HILLS WHEREAS , the Political Reform Act of 1974, as amended, requires the adoption and promulgation of conflict of interest codes by every local government agency with certain exceptions; and WHEREAS, the Department of Administration has formulated a conflict of interest code which has been submitted to the City Coun- cil for its consideration as the code reviewing body; and WHEREAS, the City Council has held a public hearing on April 19 , 1978, as required by the Act, NOW, THEREFORE, the City Council of the City of the Town of Los Altos Hills does hereby resolve as follows : 1. The "Conflict of Interest Code of the Department of Adminis- tration City of the Town of Los Altos Hills" a copy of which marked Exhibit "A" is attached hereto, is hereby approved, and adopted as the conflict of interest code for the persons filling the designated positions set forth therein. 2. The Conflict of Interest Code hereby adopted is to be effective as of April 19 , 1978 , and each person required to file a disclosure statement shall do so on or before May 19 , 1978. 3. The Mayor is hereby authorized to execute on behalf of the City Council, the transmittal sheet on the approved Conflict of Interest Code indicating its adoption. 4. The City Clerk shall maintain a file of the above mentioned Conflict of Interest Code, along with all disclosure statements filed pursuant thereto. 411 411 - CONFLICT OF INTEREST CODE OF THE DEPARTMENT OF ADMINISTRATION, CITY OF THE TOWN OF LOS ALTOS HILLS SECTION 1. Purpose. Pursuant to the provisions of Government Code Sections 87300, et seq. , the following provisions constitute the Conflict of Interest Code for the Department of Administration. Nothing contained herein is intended to modify or abridge the pro- visions of the Political Reform Act of 1974 (Government Code Section 81000) . The provisions of this Code are additional to Government Code Section 87100 and other laws pertaining to conflicts of in- terest. Except as otherwise indicated, the definitions of said Act and regulations adopted pursuant thereto are incorporated herein k, and this Code shall be interpreted in a manner consistent therewith. ' SECTION 2. Designated Positions . The position of City Manager, City Clerk, City Engineer, City Attorney, Planning Officer, Build- ing Inspector, and any consultant as defined in the regulations of the Fair Political Practices Commission are designated positions . Officers holding those positions are designated employees and are deemed to make, orartici ate in the making of, decisions which P P may forseeably. have a material effect on a financial interest. SECTION 3. Disclosure Statements . The designated positions. in the Department of Administration are so broad andindefinable that the requirements of Section 87309 of the Government Code cannot be complied with. Therefore, each designated employee shall file an annual statement disclosing that employee 's financial interests reportable under' Sections 87200-87207 of the Government Code as the same exist or may be hereafter amended. EXHIBIT "A" . K 4' SECTION 4 . Place and Time of Filing. (a) All designated employees required to submit a statement of financial interests shall file the original with the. City Clerk. (b) The City Clerk shall make and retain. a copy of the statement of financial interest and shall forward the original to the City Council of the City of the Town of Los Altos Hills. (c) . A designated employee required to submit a statement of financial interest shall submit an initial statement within 30 days . after the effective date of this Code. (d) All persons appointed to designated positions or employed in such positions shall file initial statements not less than 10 days before assuming office, unless an earlier assumption of office is required by emergency circumstances, in which case the statement shall be filed within 30 days thereafter. (e) Annual statements shall be filed during the month of February by all designated employees. Such statements shall cover - the period of the preceding calendar year. (f) A designated employee required to file a statement of financial interest with any other agency, which is within the same territorial jurisdiction, may comply with the provisions of this Code by filing a duplicate copy of the statement filed with the other agency, in lieu of an entirely separate document. (g) Statements of financial interests filed under this Code shall be signed under penalty of perjury and verified by -the-.filer. The verification shall state that the filer has used all reasonable diligence in its preparation and that to the best of his or her knowledge it is true and complete. -2- • • SECTION 5. Contents of Disclosure Statements. Disclosure statements shall be made on forms supplied by the City Clerk and shall contain the information required by Section, 87206 and 87207 of the Government Code. SECTION 6 . Disqualification. Designated employees must dis- qualify themselves from makingparticipating or p cipating in the making of J anydecisions ns inwhich they have a reportable financial interest, when it is reasonably foreseeable that such interest may be materially affected by the decision. No designated employee shall be required to disqualify himself or herself with respect to any matter which could not be legally. acted upon or decided without his or her participation. . t.
