ORDINANCE NO. 306
AN ORDINANCE OF THE CITY OF THE TOWN OF LOS ALTOS HILLS
ADOPTING AS AN URGENCY MEASURE THE AUTHORITY TO ISSUE
BUILDING PERMITS UNDER THE EXISTING TOWN
ZONING LAW FOR CERTAIN DESCRIBED APPLICATIONS
The City Council of the City of the Town of Los Altos Hills,
County of Santa Clara, State of California, DOES ORDAIN as follows:
SECTION 1. FINDINGS.
The City Council finds:
(a) On September 3, 1986 the City Council adopted
Ordinance No. 305 which, among others, amended the Zoning
Law of the Town and which will become effective on Octo-
ber 3, 1986.
(b) The City Council has been advised that a number
of property owners are in a unique position in that they
filed applications in compliance with the present Town Zon-
ing Law, but which applications would not comply with the
amended provisions of the Towns Zoning Law appearing in
Ordinance No. 305, and obtained all required permits, ex-
cept for building permit, but none of whom will be able
to qualify for issuance of a building permit prior to
October 3, 1986.
(c) The City Council believes it would be unreason-
able to require the applicants falling into the catagory
described above commence their applications anew.
SECTION 2.. BUILDING PERMIT ISSUANCE.
Each person who has submitted an application under the provi-
sions of the Zoning Law of the Town as it exists on the date this
Ordinance is adopted, and who has obtained all necessary approvals
thereunder and including Special Land Use Permit (if required)
under Ordinance No. 292, as amended by Ordinance Nos. 295 and
300, but who has not applied for a building permit shall be en-
titled to apply for and receive a building permit provided that
the building permit is issued not later than January 2, 1987.
SECTION 3. URGENCY AND EFFECTIVE DATE.
This Ordinance is an Urgency Ordinance and is for the immedi-
ate preservation of the public peace, health and general welfare.
The facts constituting the urgency consist of the following:
The City of the Town of Los Altos Hills has adopted a revised
and amended Zoning Law. The effective date of the new Ordinance,
namely October 3, 1986, will not allow property owners who have
applied for and received all necessary permits, except for a build-
ing permit, to apply for and receive a building permit prior to
October 3, 1986, under the provisions of the existing Zoning Law.
Because none of these property owners will be able to apply for
and actually obtain a building permit prior to October 3, 1986,
they face the only alternative of filing new applications and be-
ginning the obtaining of necessary permits under the revised pro-
visions of the Zoning Law. Because it appears equitable to the
Council that each of these property owners be given an opportunity
to apply for and receive a building permit prior to January 2, 1987,
it is necessary to memorialize this authority to issue building
permits in an Ordinance adopted and effective prior to October 3,
1986.
This Ordinance takes effect immediately.
SECTION 4. POSTING.
This Ordinance shall be posted within the City of the Town of
Los Altos Hills in three (3) public places.

Hills this 17th day of September 1986, by the following roll call:
