RESOLUTION NO. 1099
A. RESOLUTION APPROVING THE ANNEXATION OF UNINHABITED -
TERRITORY DESIGNATED THE LAH 77-2 ANNEXATION TO THF
CITY OF THE TOWN OF' LOS. ALTOS HILLS •
WHEREAS, heretofore a petition was filed with the City Clerk
of the City of the Town of Los Altos Hills .to annex to the City •
of the Town of Los Altos Hills pursuant to the provisions of -
. annexation of the Uninhabited Territory Act of .,1939 , as amended,
certain uninhabited territory hereinafter described and designated
as the LAH77-2Annexation, situate in the County of Santa Clara, •
State of California, and contiguous to the City of the Town of
Los Altos Hills; and .
WHEREAS, it appears to the City Council, and said Council
so .finds that said petition was signed by the owners of all of the
land in the territory proposed to be annexed, pursuant to and is
deemed to be consent in writing by all the owners of the land in
such territory as contemplated by Section 35015 and 54797.1, res-
pectively of the Government Code of the State of. California; and
WHEREAS, an Application For. Annexation to annex said terri-
tory was filed with the Santa :Clara County Local Agency Formation.
Couuuission as required by law, and the boundary description of
the territory proposed to be annexed has been determined to be
definite and certain by the executive officer -thereof; and •
WHEREAS , the proposal for said annexation heretoforeiwas
submitted to the Santa Clara County Local Agency Formation Com--;
mission and on December 7 , 1977, said Coi►uuissiori approved and
authorized the City Council of the City of the Town of. Los Altos

Hills to annex said territory without notice and hearing by the
City Council and without an election pursuant to Section 54797-1 of
the Government Code; and
WHEREAS, the Application for Annexation having been' accepted
for filing pursuant to Section 54791 of the Government Code prior
to theeffective date of the Municipal Organization Act of 1977,
the annexation proceedings may be completed under and it accordance.
with the provisions of law existing prior to the Municipal Organi-
• zation Act of 1977; and
WHEREAS, the Santa Clara County Local Agency Formation Com-
mission has confirmed a Negative Declaration on said annexation
pursuant to the California Environmental Quality Act of 1970 (Public
Resources Code. 21000 , et seq) ; and
WHEREAS, the consent of the owners of the property to be
annexed required by Section 35009 of the Government Code of Cali-
fornia has been attained and is on file in the office of the City
Clerk; and.
WHEREAS, it appears to said City Council and said *Council hereby
finds that said petition is in. proper form and the real property
described therein and hereinafter is contiguous to the City of the
Town of Los Altos Hills; and that less than twelve (12) persons .
who have been registered to vote within the territory for at least
fifty-four (54) days resided within said territory at the time of
the filing of the petition, and that said territory is uninhabited
meaning territory in the County of Santa Clara and within the meang of -
the Annexation of Uninhabited Territory Act of 1939 , as amended,
and it is for the best interest, convenience, necessity and general

welfare of the people of the City of- the Town of Los Altos Hills
that said territory be annexed to the City of the Town of Los
Altos Hills;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF THE TOWN OF -
LOS ALTOS HILLS DOES RESOLVE as follows :
1. The territory designated as LAH 77-2 Annexation is located
in the County of...Santa Clara, State of California, is contiguous
to the City of the Town of Los Altos Hills , _is uninhabited terri-
tory within the meaning of the Annexation of Uninhabited Terri-
tory Act of 1939, as amended, and is described in Exhibit "A"
entitled "LAH 77-2 Annexation" , attached- hereto and made a part
hereof.
2 . The territory designated as the LAH 77-2 Annexation is
hereby annexed to and made a. part of the City of the Town of Los
Altos Hills .
3. The City Clerk is hereby authorized and directed to pre-
. pare certified copies of this Resolution, under seal, showing the -
date . of passage and transmit the same to the Secretary of State of
the State of California as required by the provisions of Section
35316 of the Government Code, and to the Executive Officer of the
Santa Clara Local Agency Formation Commission as required by the
provisions of Section 54797.2 (a) of the Government Code: •
4 . The City Clerk is hereby authorized and directed to pre-
pare and .record with the County Recorder of the County of Santa
Clara an affidavit stating that all requirements of the law per- j
taining to proceedings for the annexation of. territory have been

complied with, which affidavit shall have attached to it a certifi-
cate of the Secretary of State describing this Resolution filed in
his office to complete the proceedings, and the date of such filing,
and be accompanied by a certified copy of the boundary description
of the said annexation and a map delineating said boundaries as
required by Sections 34080 and 34081 of the Government Code; and
prepare and file a statement of change of boundaries as required
by Sections 54900 to 54904, inclusive, of the Government Code; and
6. This Resolution shall take effect upon adoption.

1978.
