HomeMy WebLinkAbout329ORDINANCE NO. 329 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS FURTHER AMENDING CHAPTER 1 ENTITLED "ZONING' OF TITLE 10 OF THE LOS ALTOS HILLS MUNICIPAL CODE BY AMENDING SECTIONS 10-1.249 DEFINING A STRUCTURE, 10-1.601 CONCERNING OFF-STREET PARKING FACILITIES, AND 10-1.702 DEFINING A SECONDARY DWELLING; REPEALING SUBSECTION (k) CONCERNING SECONDARY DWELLINGS, AND RELETTERING SUBSECTIONS (1) AND (m), RESPECTIVELY, OF SECTION 10-1.703 THEREOF The City Council of the Town of Los Altos Hills DOES ORDAIN as follows: SECTION 1. AMENDMENT OF CODE. Section 10-1.249 entitled "Structure" of Chapter 1 entitled "Zoning of Title 10 of the Los Altos Hills Municipal Code is hereby amended to read as follows: Section 10-1.249. Structure. "Structure" shall mean anything such as buildings, decks, swimming pools, tennis courts, and patios, requiring construction or erection on the ground. SECTION 2. AMENDMENT OF CODE. Section 10.1.601 entitled 'Residential Uses" of Chapter 1 entitled "Zoning" of Title 10 of the Los Altos Hills Municipal Code is hereby amended to read as follows: Section 10-1.601. Residential Uses. Each dwelling shall provide surfaced off-street parking facilities for a minimum of four (4) cars including garage or carport space. Each second dwelling shall provide surfaced off-street parking facilities for a minimum of one (1) car in addition to the four required for the primary dwelling. Each parking space shall be at least ten (101 feet wide and at least twenty (20') feet long. Unobstructed vehicular access shall be available at all times. SECTION 3. AMENDMENT OF CODE. Section 10-1.702 entitled "Accessory Uses and Structures Permitted (R -A)" of Chapter 1 entitled "Zoning" of Title 10 of the Los Altos Hills Municipal Code is hereby amended by adding thereto Subsection (k) amended to read as follows: Section 10-1.702. Accessory Uses and Structures Permitted (R -A). (k) One secondary dwelling on each parcel or lot of land in one ownership which is of at least one (1) acre in net area, subject to the applicable provisions of this Chapter and other laws. Secondary dwellings shall meet the following standards: (1) A secondary dwelling shall be subordinate to and architecturally consistent with the primary dwelling. (2) The secondary dwelling shall not exceed 1,000 square feet of floor area. (3) If the secondary dwelling is within or attached to the primary -2- dwelling, it shall be constructed so that the entire structure appears to be one dwelling. (4) If the secondary dwelling is separate from the primary dwelling, it shall not be sited in a visually prominent location, and shall respect the visual and acoustic privacy of primary dwellings on contiguous lots. (S) The lot on which a secondary dwelling is located must be connected to the public sanitary sewer system or have a private sewage disposal system that is deemed to be adequate for the addition of the second dwelling by the Santa Clara County Division of Health Services; and must have an adequate water supply. (6) The secondary dwelling shall not have a significant adverse impact on traffic flow and safety. (7) Any vehicular access to a secondary dwelling shall be by a common driveway with the primary dwelling. (8) The views of prominent scenic features by primary dwellings on contiguous lots shall be preserved. SECTION 4. AMENDMENT OF CODE. Section 10-1.703 entitled "Conditional Uses and Structures (R -A)" of -3- .0 b V Chapter 1 entitled "Zoning" of Title 10 of the Los Altos Hills Municipal Code is hereby amended by repealing Subsection (k) thereof entitled "Secondary Dwellings", and by relettering Subsections (1) entitled "Town Facilities' and (m) entitled "Commercial Stables" thereof as (k) and (l), respectively. SECTION 5. EFFECTIVE DATE. POSTING. This Ordinance shall be in full force and effect thirty (30) days from and after its passage, and shall be posted within the Town of Los Altos Hills in three (3) public places.
