AN ORDINANCE OF THE CITY OF THE TOWN OF LOS ALTOS HILLS
AMENDING SUBSECTIONS (A) AND (C) OF SECTION 9-4.603 OF
CHAPTER 4 ENTITLED "SUBDIVISIONS" OF TITLE 9 ENTITLED
"PLANNING AND ZONING" OF THE LOS ALTOS HILLS MUNICIPAL
CODE
The City Council of the City of the Town of Los Altos Hills
does ORDAIN as follows:
SECTION 1. AMENDMENT OF CODE. The first sentence of sub-
section (a) of Section 9-4.603 and subsection (c) of Section
9-4.603, respectively, of Article VI entitled "Tentative Lot
Design and Development Plans" of Chapter 4, entitled "Subdivisions"
of Title 9 of the Los Altos Hills Municipal Code, hereby are amended
to read as follows:
Section 9-4.603. Preparation of Tentative Lot
Design and Development Plans.
(a) Each lot shall contain a circle having a
diameter of 160 feet enscribed totally within its net area.
(c) Each lot shall contain an area of at least one
(1.00) net acre within a circle no greater than 350 feet in
diameter.
SECTION 2. SEVERABILITY.
If any section, subsection, subdivision, paragraph, sentence,
clause or phrase of this ordinance or any part thereof, or the
application thereof to any person or circumstance is for any reason
held to be unconstitutional or invalid, or ineffective by any court
of competent jurisdiction, such decision shall not affect the
validity or effectiveness or application of the remaining portions
of this ordinance, or any part thereof, which can be given effect
without the invalid portion or application. The City Council
hereby declares it would have passed each section, subsection,
subdivision, paragraph, sentence, clause or phrase thereof,
irrespective of the fact that any one or more sections, sub-
sections, subdivision, paragraph, sentence, clause or phrase be
declared unconstitutional or invalid or ineffective.
SECTION 3. URGENCY MEASURE.
The immediate preservation of the public safety, health and
welfare require the adoption of this ordinance as an urgency mea-
sure. The facts constituting the need for such action are:
The City of the Town of Los Altos Hills has not yet com-
pleted the study of the subdivision regulations of the Town, among
others, which it undertook this year to determine inadequacies
therein and the consistency or lack thereof of the General Plan
of the Town.
In order to provide more current regulation in the areas
of lot design and development plans, and size and requirements of
lots, the City Council of the City of the Town of Los Altos Hills
has caused to be prepared modifications of local subdivision
regulations which the City Council has determined to be appro-
priate and necessary, and which have been adopted as part of
the within ordinance.
In order that the foregoing regulations be available with-
out delay to be used by the property owners within the Town now
desiring to commence development of their respective properties,
it is necessary that the foregoing regulations be effective im-
mediately.
Therefore, this ordinance is declared to be an ordinance
adopted as an urgency measure and is to be effective November 15,
1978.
This Ordinance shall be posted within the City of the Town
of Los Altos Hills in three (3) public places.
This ordinance was introduced and adopted at a regular meet-
ing of the City Council held on November 15, 1978, by the
following roll call vote:
AYES: Mayor Hillestad, Councilmembers McReynolds, Nystrom, Perkins
and Proft.
NOES: None.
ABSENT: None.
