HomeMy WebLinkAbout248J ORDINANCE No. 248 AN ORDINANCE OF THE CITY OF THE TOWN OF LOS ALTOS HILLS AMENDING CHAPTER 1 OF TITLE 6 OF THE LOS ALTOS HILLS MUNICIPAL CODE TO ADOPT BY REFERENCE SANTA CLARA COUNTY ORDINANCE No. NS -600.12 RELATING TO ANIMALS The City Council of the City of the Town of Los Altos Hills, County of Santa Clara, State of California, DOES ORDAIN as follows: SECTION 1. AMENDMENT OF CODE. Section 6-1.01 of Chapter 1 of Title 6 of the Los Altos Hills Municipal Code is hereby amended to read as follows: Section 6-1.01. ADOPTION OF SANTA CLARA COUNTY ORDINANCE No. NS -600.12 Santa Clara County Ordinance No. NS -600.12 adopted on September 11, 1978, by the Santa Clara County Board of Super- visors and entitled, "AN ORDINANCE AMENDING, REPEALING AND ADDING VARIOUS SECTIONS OF CHAPTER I, II, III, IV, IV 1/2 AND IV 3/4, RELATING TO ANIMALS AND ADDING CHAPTER VI ESTABLISHING AN ANIMAL ADVISORY COMMITTEE, AND CHAPTER VII RELATING TO THE SALE OF ANIMALS, OF DIVISION B4, TITLE B OF THE SANTA CLARA COUNTY ORDINANCE CODE" and filed in the office of the City Clerk of the City of the Town of Los Altos Hills on February 7 , 1979, IS HEREBY ADOPTED, and by reference incorporated herein as if fully set forth, except as hereinafter otherwise provided, as the Animal and Rabies Control Ordinance of the City of the Town of Los Altos Hills and as and for the rules, regulations and standards within this City, as to all matters therein contained, except as herein otherwise provided. Three copies of the Animal and Rabies Control Ordinance shall, at all times, be kept on file in the office of the City Clerk. Whenever the term "Santa Clara County", "County", or "Board of Supervisors", is used or appears in the Animal and Rabies Control Ordinance, there shall be substituted for each such term "City of the Town of Los Altos Hills", "City" or "City Council", as the case may be. SECTION 2. AMENDMENT OF CODE. Section 6-1.02 of Chapter 1 of Title 6 of the Los Altos Hills Municipal Code is hereby amended to read as follows: Sec. 6-1.02 Deletions. There is hereby deleted from the Animal and Rabies Control Ordinance each of the following: Subsections (c), (e), (h), (m), and the last sentence of Subsection (n), respectively, of Section B4-1; Section B4-87; Section B4-887 and Chapter VI entitled "Animal Advisory Committee" consist- ing of Sections B4-120 to B4-124, inclusive. SECTION 3. AMEND14ENT OF CODE. Section 6-1.03 of Chapter 1 of Title 6 of the Los Altos Hills Municipal Code is hereby amended to read as follows; Sec. 6-1.03. Amendment of Section B4-3. Section B4-3 of the Animal and Rabies Control Ordinance hereby is amended to read as follows: Sec. B4-3. Animals running at large. No person owning or having control of any animal shall permit such animal to stray or run at large upon any public street or other public place, or upon any private place or property without the consent of the owner or person in control thereof. -2- v SECTION 4. AMENDMENT OF CODE. Section 6-1.04 of Chapter 1 of Title 6 of the Los Altos Hills Municipal Code is hereby amended to read as follows: Sec. 6-1.04. Addition of Section B4-8. Section B4-8 is hereby added to the Animal and Rabies Control Ordinance to read as follows: Sec. B4-8. Abandoned Animals. It is unlawful to abandon any animal in the City of the Town of Los Altos Hills. SECTION 5. AMENDMENT OF CODE. Section 6-1.05 is hereby added to Chapter 1 of Title 6 of the Los Altos Hills Municipal Code to read as follows: Sec. 6-1.05. Addition of Section B4-25. Section B4-25 is hereby added to the Animal and Rabies Control Ordinance to read as follows: Sec. B4-25. Notification of Impoundment. The animal control officer shall give notice of impoundment to the owner of every animal impounded, if he is known. SECTION 6. AMENDMENT OF CODE. Section 6-1.06 is hereby added to Chapter 1 of Title 6 of the Los Altos Hills Municipal Code to read as follows: Section 6-1.06. Amendment of Section B4-38. Section B4-38 of the Animal and Rabies Control Ordinance is hereby amended by deleting therefrom the terms "commer- cial kennel", "animal menagerie", or "pet shop". SECTION 7. AMENDMENT OF CODE. Section 6-1.07 is hereby added to Chapter 1 of Title 6 of the Los Altos Hills Municipal Code to read as follows: me Section 6-1.07. Addition of Section B4-39. Section B4-39 is hereby added to the Animal and Rabies Control Ordinance to read as follows: Sec. B4-39. Vaccination of dogs. Every owner of a dog over four (4) months of age shall cause such dog to be vaccinated with an anti- rabies vaccine approved by the state department of public health. Revaccination shall be made at such intervals of time as may be prescribed by the state department of public health. Compliance with the provisions of this section shall be a condition to the issuance or renewal of dog licenses. SECTION S. AMENDMENT OF CODE. Section 6-1.08 is hereby added to Chapter 1 0£ Title 6 of the Los Altos Hills Municipal Code to read as follows: Section 6-1.08. Amendment of Section B4-43. Section B4-43 of the Animal and Rabies Control Ordinance is hereby amended by amending the third sentence to read as follows: Sec. B-43. Metal Tags. The fee for a duplicate tag shall be fixed by resolution of the City Council. SECTION 9. AMENDMENT OF CODE. Section 6-1.09 is hereby added to Chapter 1 of Title 6 of the Los Altos Hills Municipal Code to read as follows: Section 6-1.09. Amendment of Section B4.-58. Section B4-58 of the Animal and Rabies Control Ordinance is hereby amended by amending the third sentence thereof to read as follows: -4- Sec. B4-58. Metal Tags The fee for a duplicate tag shall be fixed by resolution of the City Council. SECTION 10. AMENDMENT OF CODE. Section 6-1.10 is hereby added to Chapter 1 of Title 6 of the Los Altos Hills Municipal Code to read as follows: Section 6-1.10. Addition of Section B4-59. Section B4-59 is hereby added to the Animal and Rabies Control Ordinance to read as follows: Sec. B4-59. Registration period. A registration certificate issued pursuant to Section B4-57 shall be valid for a period of five (5) years from the date of issue. SECTION 11. AMENDMENT OF CODE. Section 6-1.11 is hereby added to Chapter 1 of Title 6 of the Los Altos Hills Municipal Code to read as follows: Section 6-1.11. Amendment of Sections B4-70, B4-71 and B4-72. Sections B4-70, B4-71 and B4-72, and each of them, of the Animal and Rabies Control Ordinance are hereby amended by deleting therefrom the terms "commercial kennel". animal menagerie", "pet shop" or "pet grooming parlor". SECTION 12. AMENDMENT OF CODE. Section 6-1.12 is hereby added to Chapter 1 of Title 6 of the Los Altos Hills Municipal Code to read as follows: Section 6-1.12. Amendment of B4-73. Section B4-73 of the Animal and Rabies Control Ordinance is hereby amended by amending the second paragraph thereof to read as follows: -5- Sec. B4-73. Expiration and renewal of permit. Upon failure to make application for the renewal of a permit within thirty (30) days of the expiration of a permit, or prior thereto, the applicant shall pay in addition to the permit fee a penalty for late re- newal, the amount of which shall be fixed by resolution of the City Council. SECTION 13. AMENDMENT OF CODE. Section 6-1.13 is hereby added to Chapter 1 of Title 6 of the Los Altos Hills Municipal Code to read as follows: Section 6-1.13. Amendment of Section B4-86. Section B4-86 of the Animal and Rabies Control Ordinance is hereby amended to read as follows: Sec. B4-86. Keeping Dangerous Animal Prohibited. No person shall keep, have, maintain, sell, trade or let for hire a dangerous animal. SECTION 14. AMENDMENT OF CODE. Section 6-1.14 is hereby added to Chapter 1 0£ Title 6 of the Los Altos Hills Municipal Code to read as follows: Section 6-1.14. Amendment of Section B4-133. Section B4- 133 of the Animal and Rabies Control Ordinance is hereby amended by deleting therefrom the terms "commercial kennel", "animal menagerie", "pet shop" or "pet grooming parlor". SECTION 15. AMENDMENT OF CODE. Section 6-1.15 is hereby added to Chapter 1 of Title 6 of the Los Altos Hills Municipal Code to read as follows: C. %10 '40 Section 6-1.15. Violations; Penalties. violations of the Animal and Rabies Control ordinance shall be punishable as follows: (a) Any violation of the rules and regulations formu- lated by the Administrator pursuant to Section B4-11 of the Animal and Rabies Control Ordinance shall be deemed an infraction. (b) Any person found guilty of violating any pro- visions of Section B4-4 and B4-40 of the Animal and Rabies Control Ordinance shall be deemed guilty of an infraction, and each day of such violation shall constitute a separate infraction. A fine not exceeding $100.00 per separate violation shall be imposed upon conviction. However, any offense which would otherwise be an infraction is a misdemeanor if a defendant has been con- victed of three (3) or more violations of this Chapter within the twelve (12) month period immediately preceding the commission of the offense and such prior convictions are admitted by the defendant or alleged in the accusa- tory pleading. For this purpose, a bail forfeiture shall be deemed to be a conviction of the offense charged. (c) Any person who fails, refuses, or neglects to quarantine any animal as ordered by the health office, or who refuses to allow the health officer to inspect any private premises where the animal is kept, is guilty of a misdemeanor. (d) Any person who fails, or refuses to permit an -7- i inspection by the Administrator and/or an animal control officer pursuant to Section B4-11 of the Animal and Rabies Control Ordinance is guilty of a misdemeanor. (e) Any person who fails, or refuses to appear at the hearing provided for in Section B4-29 of the Animal and Rabies Control Ordinance is guilty of a misdemeanor. Any person convicted of a misdemeanor shall be punishable by imprisonment in the County jail for a period not to exceed six (6) months, or by a fine not to exceed $500, or by both fine and imprisonment. SECTION 15. This ordinance shall be posted within the City of the Town of Los Altos Hills in three (3) public places and shall become effective thirty (30) days following its adoption. • fr • x f I hereby certify that the foregoing Ordinance was introduced at a regular meeting of the City Council of the Town of Los Altos Hills on the 7th day of February , 1979, and was thereafter passed and adopted at a regular meeting of the City Council held on the 7th day of March , 1979. -8- City Clerk
