HomeMy WebLinkAbout267ORDINANCE NO. 267 AN ORDINANCE OF THE CITY OF THE TOWN OF LOS ALTOS HILLS AMENDING CHAPTER 5 ENTITLED "ZONING" OF THE LOS ALTOS HILLS MUNICIPAL CODE BY ADDING SECTIONS 9-5.215 (1) AND 9-5.231, AND BY AMENDING SUBSECTION (b) OF SECTION 9-5.503, RESPECTIVELY, CONCERNING WALLS AND FENCES The City Council of the City of the Town of Los Altos Hills DOES ORDAIN as follows: SECTION 1. AMENDMENT OF CODE. Chapter 5 entitled "Zoning" of Title 9 of the Los Altos Hills Municipal Code is hereby amended by adding to Article 2 thereof Section 9-5.215 (1) to read as follows: SECTION 9-5.215 (1). FENCE. "Fence" shall mean a constructed barrier or screen composed of wood, metal, masonry, glass, plastic or any other construction material (not including graded berms or living hedges). SECTION 2. AMENDMENT OF CODE Chapter 5 entitled "Zoning" of Title 9 of the Los Altos Hills Municipal Code is hereby amended by adding to Article 2 thereof Section 9-5.231 to read as follows: SECTION 9-5.231. WALL. "Wall" shall mean a constructed barrier or screen composed of wood, metal, masonry, glass, plastic or any other construction material (not including graded berms or living hedges). ry v SECTION 3. AMENDMENT OF CODE. Chapter 5 entitled "Zoning" of Title 9 of the Los Altos Hills Municipal Code is hereby amended by amending Subsection (b) of Section 9-5.503 of Article 5 to read as follows: SECTION 9-5.503. HEIGHT. (b) Walls and Fences. Walls or fences (herein referred to collectively as "fences") shall not exceed a maximum height of six feet (6') when located between setback lines and property lines; PROVIDED, HOWEVER, the height of any fence along a road shall be determined by the openness of the fence and its distance from a "reference line," and PROVIDED, further, that no fence shall be erected on the roadway side of the "reference line." 1. The "reference line" for a fence along any road shall be: (a) The existing right of way boundary line, or (b) A line located thirty feet (30') from the centerline of the right-of-way of the road, whichever is farthest from the center- line of the road. 2. The maximum height of a fence erected on the "reference line" for that fence shall be" (a) Three feet (3') for a fence with less than fifty percent (508) open area (when viewed perpendicular to the plane of the fence). -2- (b) Four and one-half feet (4-1/2') for a fence with no less than fifty per- cent (508) open area. 3. The maximum height of a fence erected on the property side of the "reference line" may be in- creased by one foot (1') for each ten feet (10') the location of the fence is moved from the "reference line" for that fence; PROVIDED, HOWEVER, no fence shall exceed a maximum height of six feet (61) when located between the "reference line" for that fence and the struc- tural setback line for the property on which the fence is located. SECTION 4. EFFECTIVE DATE. POSTING. This Ordinance shall be in full force and effect thirty (30) days from and after its passage, and shall be posted within the City of the Town of Los Altos Hills in three (3) public places.
