AN ORDINANCE OF THE CITY OF THE TOWN OF LOS ALTOS HILLS
AMENDING CHAPTER 1 OF TITLE 8 TO ADOPT BY REFERENCE THE
1982 EDITION OF THE UNIFORM BUILDING CODE, INCLUDING THE
APPENDIX THERETO, AND THE UNIFORM BUILDING CODE STANDARDS,
1982 EDITION; ADDING CHAPTER. 1.6 TO ADOPT BY REFERENCE
THE CABO ONE $ TWO FAMILY DWELLING CODE, 1983 EDITION;
AMENDING CHAPTER 2 of TITLE 8 TO ADOPT BY REFERENCE THE
1984 EDITION OF THE NATIONAL ELECTRICAL CODE; AMENDING
CHAPTER 3 OF TITLE 8 TO ADOPT BY REFERENCE THE UNIFORM
PLUMBING CODE, 1982 EDITION; AND AMENDING CHAPTER 4 OF
TITLE 8 TO ADOPT BY REFERENCE THE UNIFORM MECHANICAL
CODE, 1982 EDITION, RESPECTIVELY, OF THE LOS ALTOS HILLS
MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF THE TOWN OF LOS ALTOS HILLS
DOES ORDAIN as follows:
SECTION 1. Section 8-1.01 of Chapter 1 of Title 8 of the Los Altos
Hills Municipal Code is hereby amended to read as follows:
Section 8-1.01. ADOPTION OF UNIFORM BUILDING CODE, 1982 EDITION.
The Code of rules, regulations and standards printed in
two volumes and published by the International Conference of
Building Officials under the title "Uniform Building Code,
1982 Edition", including the appendix thereto designated as
"Primary Code" and the "Uniform Building Code Standards, 1982
Edition", designated as "Secondary Code", hereinafter collect-
ively called the 'Building Code", regulating the erection,
construction, enlargement, alteration, repair, moving, removal,
demolition, conversion, occupancy, equipment, use, height,
area and maintenance of all buildings and structures in the
City of the Town of Los Altos Hills, and providing for the
issuance of permits and the collection of fees therefor,

defining terms, providing penalties for its violation, and
repealing conflicting ordinances, printed in book form and
filed in the Office of the City Clerk of the City of the
Town of Los Altos Hills on February 1 , 1984, IS
HEREBY ADOPTED, and by reference incorporated in this Section
as if fully set forth, except as hereinafter otherwise pro-
vided, as the Building Code of the City of the Town of Los
Altos Hills and as and for the rules, regulations and stand-
ards within this City, as to all matters therein contained,
except as herein otherwise provided in this Chapter. The
mandatory requirements of the Appendix to the Building Code
shall be enforceable to the same extent as if contained in
the body of the Building Code. Three copies of the Building
Code shall, at all times, be kept on file in the Office of
the City Clerk.
SECTION 2. Section 8-1.02 of Chapter 1 of Title 8 of the Los Altos
Hills Municipal Code is hereby amended to read as follows:
Section 8-1.02. DELETIONS.
There is hereby deleted from the Building Code Section 204.
SECTION 3. Section 8-1.02(1) of Chapter 1 of Title 8 of the Los
Altos Hills Municipal Code is hereby amended to read as follows:
Section 8-1.02(1). AMENDMENT OF SECTION 205.
Section 205 of the Building Code is hereby amended to read
as follows:
SECTION 205. VIOLATIONS AND PENALTIES.

It shall be unlawful for any person, firm or corporation
to erect, construct, enlarge, alter, repair, move, improve,
remove, convert, or demolish, equip, use, occupy or maintain
any building or structure in the City of the Town of Los
Altos Hills, or cause the same to be done, contrary to or in
violation of any of the provisions of this Code.
SECTION 4. Section 8-1.03 of Chapter 1 of Title 8 of the Los Altos
Hills Municipal Code is hereby amended to read as follows:
Section 8-1.03. AMENDMENT OF SECTION 304.
Subsection (a) of Section 304 is hereby amended to read
as follows:
Section 304. FEES.
(a) Building Permit Fees. A fee for each building permit
shall be paid to the Building Official, and the amount of said
fee shall be comprised of the following:
1. The amount set forth in Table No. 3-A, but not less
than Twenty -Five Dollars ($25.00); plus
2. An amount equal to Sixty -Five Dollars ($65.00) for
each new bedroom to be constructed under the permit.
3. A final deposit fee shall be required of all appli-
cants for a building permit for construction of,
additions to or remodeling of a single family
dwelling as follows:
a. If the estimated value of the work is Ten
Thousand Dollars ($10,000.00) or more, the
fee shall be an amount equal to one (1) percent
of the estimated value of the work for which
the permit is issued, but not to exceed One

Thousand Dollars ($1,000.00.
b. If the estimated value of the work is less
than Ten Thousand Dollars ($10,000.00), the
fee shall be One Hundred Dollars ($100.00).
The final deposit fee shall be refunded within
thirty (30) days following the making of a final
inspection and approval thereof by the Building
Official. If a final inspection is not requested
and obtained prior to expiration of the Permit,
the final deposit fee shall be forfeited to the
City of the Town of Los Altos Hills.
4. A special inspection fee in the amount of Seventy -
Five Dollars ($75.00) shall be paid by any person
who is not required to have a building permit but
who requests an inspection by or an opinion of
the Building Official concerning any question aris-
ing under the Code and which involves a structure
or building.
The determination of value or valuation under
any of the provisions of this Code shall be made
by the Building Official. In determining valua-
tion the Building Official shall utilize, among
others, the building valuation data appearing in
"Building Standards" a bimonthly publication of
the International

Conference of Building Officials, 5360 South
Workman Mill Road, Whittier, California, and
under the San Francisco sub -area for "Regional
Modifiers, Western United States".
Where work for which a permit is required
by this Code is started without obtaining such
permit, the fee for such permit thereafter
granted shall be ten (10) times the normal fee
for such permit; provided, however, such increased
fee may be waived by specific action of the Council
in any case in which it is deemed that such
increased fee would be a special hardship and
that the work was commenced without intent to
evade the provisions of this Code. The payment
of any such increased fee shall not relieve any
person from fully complying with the require-
ments of this Code in the execution of the work
nor from any other penalties prescribed for vio-
lations of the provisions of this Code.
SECTION 5. Section 8-1.03(1) hereby is added to Chapter 1 of Title
8 of the Los Altos Hills Municipal Code to read as follows:
Section 8-1.03(1). AMENDMENT OF TABLE NO. SA.
Table No. SA entitled "Wall and Opening Protection of
Occupancies Based On Location On Property" hereby is
amended by adding to Group R3 the following:

"Attached Secondary Dwellings will have a one-hour
occupancy separation from the main house. The occupancy
separation will be constructed and insulated as on ex-
terior walls per the Uniform Building Code."
SECTION 6. Sections 8-1.03(2) and 8-1.03(3) of Chapter 1 of Title
8 of the Los Altos Hills Municipal Code be and each of them hereby
is repealed.
SECTION 7. Chapter 1.6 entitled "CABO One $ Two Family Dwelling
Code" hereby is added to the Los Altos Hills Municipal Code to read
as follows:
Chapter 1.6 CABO ONE & TWO FAMILY DWELLING CODE.
Section 8-1.60 ADOPTION OF CABO ONE F, TWO FAMILY DWELLING CODE.
The Code of rules and regulations known and designated
as the CABO One & Two Family Dwelling Code, 1983 Edition,
in this Chapter called the "Family Dwelling Code", requir-
ing the obtaining of a permit, controlling the design,
construction, prefabrication, equipment or appliance
installation, quality of materials, use and occupancy,
location and repair of family dwellings not more than
three (3) stories in height, printed in book form and filed
in the Office of the City Clerk of the City of the Town of
Los Altos Hills on the 1st day of February , 1984,
IS HEREBY ADOPTED, and by reference incorporated in this
Chapter as if fully set forth, except as otherwise provided

in this Chapter, as the Family Dwelling Code of the
City of the Town of Los Altos Hills.
Three copies of the Family Dwelling Code shall, at
all times, be kept on file in the Office of the City Clerk.
Section 8-1.61. DELETIONS.
There is hereby deleted from the Family Dwelling Code
the following Sections:

Section 8-1.62. Section R-106.2 of the Family Dwelling
Code hereby is amended to read as follows:
Section R-106.2. VIOLATIONS.
It shall be unlawful for any person, firm or
corporation whether as owner, lessee, sublessee, or
occupant to erect, construct, enlarge, alter, repair,
move, improve, remove, convert or demolish, equip, use,
occupy or maintain any single family building or structure
in the City of the Town of Los Altos Hills, or cause the
same to be done, contrary to or in violation of any of
the provisions of this Code or any order issued by the
Building Official hereunder.

SECTION 8. Section 8-2.01 0£ Chapter 2 of Title 8 of the Los Altos
Hills Municipal Code hereby is amended to read as follows:
Section 8-2.01. ADOPTION OF NATIONAL ELECTRICAL CODE.
The Code of rules, regulations and standards known
and designated as the National Electrical Code, 1984
Edition, published by the National Fire Protection
Association, in this Chapter called the "Electrical
Code", regulating electric conductors and equipment
installed within or on public and private buildings and
other premises, the conductors connecting the installa-
tions to a supply of electricity, and other outside con-
ductors adjacent to the premises within the City of the
Town of Los Altos Hills, printed in book form and filed
in the Office of the City Clerk of the City of the Town
of Los Altos Hills on the 1st day of February , 1984,
IS HEREBY ADOPTED, and by reference incorporated in this
Section as if fully set forth, except as hereinafter
otherwise provided in this Chapter, as the Electrical
Code of the City of the Town of Los Altos Hills, and as
and for the rules, regulations and standards within this
City, as to all matter therein contained, except as
otherwise provided in this Chapter. Three copies of the
Electrical Code shall, at all times, be kept on file in
the Office of the City Clerk.
SECTION 9. Section 8-2.02 of Chapter 2 of Title 8 of the Los Altos
Hills Municipal Code hereby is amended to read as follows:

and payment of additional fees shall not be required until
the total fees to be paid exceed Twenty -Five Dolalrs ($25.00).
SECTION 10. Section 8-2.03(1) of Chapter 2 of Title 8 of the Los
Altos Hills Municipal Code hereby is amended to read as follows:
Section 8-2.03(1). DEFINITIONS.
Wherever "dwelling unit", "multifamily dwelling",
"one -family dwelling" and "two-family dwelling" are de-
fined or used in the National Electrical Code, they shall
be construed to apply only for purposes of electrical
installations and not as to occupancy classifications as
set forth in the Uniform Building Code, 1982 Edition.
SECTION 11. Sections 8-2.03(2) and 8-2.05 of Chapter 2 of Title 8
of the Los Altos Hills Municipal Code be and each of them hereby
is repealed.

The Code of rules, regulations and standards printed
and published by the International Association of Plumbing
and Mechanical Officials under the title "Uniform Plumbing
Code, 1982 Edition", including the appendices thereto,
hereinafter called the "Plumbing Code", prescribing
regulations for the protection of the public health and
safety, requiring a permit and inspection for the instal-
lation or alteration of plumbing and drainage systems,
defining certain terms, establishing minimum regulations
for the installation, alteration, or repair of plumbing
and drainage systems and the inspection thereof, defining
terms, providing penalties for its violation, and repealing
conflicting ordinances, printed in book form and filed in
the Office of the City Clerk of the City of the Town of
Los Altos Hills on the 1st day of February , 1984,
IS HEREBY ADOPTED, and by reference incorporated herein as
if fully set forth, except as hereinafter otherwise provided,
as the Plumbing Code of the City of the Town of Los Altos
Hills and as and for the rules, regulations and standards
within this City, as to all matters therein contained,
except as otherwise provided in this Chapter. The man-
datory requirements of the appendices to the Plumbing
Code shall be enforceable to the same extent as if contained
in the body of the Plumbing Code. Three (3) copies of

the Plumbing Code shall, at all times, be kept on file
in the Office of the City Clerk.
SECTION 13. Section 8-3.02 of Chapter 3 of Title 8 of the Los
Altos Hills Municipal Code hereby is amended by amending the fee

SECTION 14. Section 8-3.02(1) of Chapter 3 of Title 8 of the Los
Altos Hills Municipal Code hereby is amended to read as follows:

There are hereby deleted from the 1982 Plumbing Code
Sections 20.3, 20.4, 20.7, 20.13 and 20.14.
SECTION 15. Section 8-3.02(3) of Chapter 1 of Title 8 of the Los
Altos Hills Municipal Code hereby is amended to read as follows:

Section 8-3.02(3). AMENDMENT OF SECTION 201.
Subsection 201(k) is added to Section 201 of the 1982
Plumbing Code to read as follows: No provisions contained
in this Code shall apply to one and two-family dwelling
private sewage disposal systems and minimum plumbing
facilities when alternate facilities or installations have
been approved by the local health officer, provided that
such alternate facilities or installations provide sub-
stantially equivalent protection to health and safety.
SECTION 16. Section 8-3.02(4) of Chapter 1 of Title 8 of the Los
Altos Hills Municipal Code hereby is repealed.
SECTION 17. Section 8-4.01 of Chapter 4 of Title 8 of the Los
Altos Hills Municipal Code hereby is amended to read as follows:
Section 8-4.01. ADOPTION OF UNIFORM MECHANICAL CODE.
1982 EDITION.
The Code of rules, regulations and standards printed
in one volume and published by the International Associa-
tion of Plumbing and Mechanical Officials under the title
"Uniform Mechanical Code, 1982 Edition", including Appendix
A through C, inclusive, thereto, hereinafter collectively
called the "Mechanical Code", prescribing regulations for
the protection of the public health and safety, regulating
and controlling the design, construction, installation,
quality of materials, location, operation and maintenance
of heating, ventilating, cooling, refrigeration systems,

incinerators and other miscellaneous heat -producing
appliances in the City of the Town of Los Altos Hills
and providing for the issuance of permits and the
collection of fees therefor, defining terms, providing
penalties for its violation, and repealing conflicting
ordinances, printed in book form and filed in the Office
of the City Clerk of the City of the Town of Los Altos
Hills on the 1st day of February , 1984,
IS HEREBY ADOPTED, and by reference incorporated herein
as if fully set forth, except as hereinafter otherwise
provided, as the Mechanical Code of the City of the Town
of Los Altos Hills and as and for the rules, regulations
and standards within this City, as to all matters therein
contained, except as herein otherwise provided and subject,
however, to the amendments, additions and deletions set
forth in this Chapter. The mandatory requirements of the
adopted appendices to the Mechanical Code shall be enforce-
able to the same extent as if contained in the body of the
Mechanical Code. Three (3) copies of the Mechanical Code
shall, at all times, be kept on file in the Office of the
City Clerk.
SECTION 18. Section 8-4.02 of Chapter 4 of Title 8 of the Los
Altos Hills Municipal Code hereby is amended to read as follows:

There is hereby deleted from the Mechanical Code
Sections 203 and 204.

SECTION 20. Section 8-4.06 of Chapter 4 of Title 8 of the Los
Altos Hills Municipal Code hereby is amended to read as follows:
Section 8-4.06. VIOLATIONS.
It shall be unlawful for any person, firm, or cor-
poration to erect, install, alter, repair, relocate, add
to, replace, use, or maintain heating, ventilating, cooling,
or refrigeration equipment in the City of the Town of Los
Altos Hills, or cause the same to be done, contrary to or

in violation of any of the provisions of the Mechanical
Code.. Maintenance of equipment which was unlawful at the
time it was installed and which would be unlawful under
the Mechanical Code if installed after the effective date
of the Mechanical Code, shall constitute a continuing vio-
lation of the Mechanical Code.
SECTION 21. PENALTIES.
Any person, firm or corporation violating any provision of
the Building, Family Dwelling, Electrical, Plumbing, or Mechanical
Codes shall be deemed guilty of a misdemeanor and, upon conviction
thereof, shall be punishable by a fine not to exceed $500.00 or by
imprisonment in the County Jail for not to exceed six (6) months,
or both fine and imprisonment. Each separate day or any portion
thereof during which any violation of any of the above-described
Codes occurs or continues may by Council approval be deemed to con-
stitute a separate offense, and, upon conviction thereof, shall be
punishable as herein provided.
SECTION 22. SEVERABILITY.
If any section, subsection, subdivision, paragraph, sen-
tence, clause or phrase of this Ordinance, or any part thereof,
or the application thereof to any person or circumstance, is for
any reason held to be unconstitutional or invalid, or ineffective
by any Court of competent jurisdiction, such decision shall not
affect the validity or effectiveness or applications of the remaining
portions of this Ordinance, or any part thereof, which can be given

effect without the invalid portion or application. The Council
hereby declares that it would have passed each section, subsection,
subdivision, paragraph, sentence, clause or phrase thereof,
irrespective of the fact that any one or more sections, subsections,
subdivisions, paragraphs, sentences, clauses or phrases be declared
unconstitutional or invalid or ineffective.
SECTION 23, INTERPRETATIONS.
In interpreting and applying the provisions of this Ordi-
nance, the requirements contained herein are declared to be mini-
mum requirements for the purposes set forth.
The provisions of this Ordinance, insofar as they are sub-
stantially the same as existing statutory provisions relating to
the same subject matter, shall be construed as restatements and
continuations and not as new enactments.
This Ordinance shall not nullify the more restrictive pro-
visions of covenants, agreements, or other ordinances or laws, but
shall prevail as to such provisions which are less restrictive.
SECTION 24. This Ordinance shall be posted within the City of the
Town of Los Altos Hills in three (3) public places and shall become
effective thirty (30) days following its adoption.
