HomeMy WebLinkAbout127ORDINANCE NO. 127 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS CALIFORNIA ADOPTING THE UNIFORM BUILDING CODE (1967 EDITIONJOF THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, THE UNIFORM PLUMBING CODE (1967 EDITION) OF THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS, AND THE NATIONAL ELEC- TRICAL CODE (1965 EDITION) OF THE NATIONAL FIRE PROTECTION ASSOCIATION, REGULATING THE CONSTRUCTION, ALTERATION, REN- OVATING AND REMODELING OF BUILDINGS, THE INSTALLATION OF PLUMBING, GAS AND ELECTRICAL FACILITIES AND APPLIANCES, THE INSTALLATION OF CERTAIN UTILITIES UNDERGROUND, THE ISSUANCE OF PERMITS THEREFOR, PROVIDING FOR THE FEES, ADMINISTRATION AND ENFORCEMENT THEREOF, AND PENALTIES FOR ITS VIOLATION,AND REPEALING ALL ORDINANCES OR PORTIONS THEREOF IN CONFLICT THEREWITH. THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: All of the provisions of the Uniform Building Code (1967 Edition) of the International Conference of Building Officials, hereinafter referred to as The Building Code, and each and all of the regulations, provisions, penalties, con- ditions, and terms of such Building Code (three copies of which code have been filed for use and examination by the public in the office of the City Clerk), excepting the second paragraph of Section 205 of said Building Code, are hereby referred to and are hereby adopted as the Building Code of the Town of Los Altos Hills, the same as if fully set forth in this Ordinance. SECTION 2: All of the provisions of the Uniform Plumbing Code (1967 Edition) of the International Association of Plumb- ingand Mechanical Officials, hereinafter referred to as the Plumbing Code, and each and all of the regulations, provisions, penalties, conditions and terms of such Plumbing Code (three copies of which code have been filed for use and examination by the public in the office of the City Clerk) are hereby referred to and are hereby adopted as the Plumbing Code of the Town of Los Altos Hills, the same as if fully set forth in this "POR10 & FAIBANT Ordinance. -1- V 40 SECTION 3: All of the provisions of the National Electrical Code (1965 Edition) of the National Fire Pro- tection Association, hereinafter termed the Electrical Code, and each and all of the regulations, provisions, penalties, conditions and terms of such Electrical Code (three copies of which code have been filed for use and examination by the public in the office of the City Clerk) are hereby referred to and are hereby adopted as the Electrical Code of the Town of Los Altos Hills and made a part hereof, the same as if fully set forth in this ordinance. SECTION 4: The fees and charges for permits and per- formance of duties of the Building Inspector, under the Build- ing Code, shall be those specified in said Building Code. Fees and charges for permits and the performance of duties of the Building Inspector under the Plumbing Code and Electrical Code shall be those fixed by Resolution No. 340 passed and adopted by the City Council of the Town of Los Altos Hills on March 7, 1966, or such resolution as may be adopted by said Council in the future. SECTION 5: Whenever work, for which under this Ordinance a permit is required, is started without obtaining such permit, the fee for such permit thereafter granted shall be double the normal fee for such permit, provided that the double fee may be waived by specific action of the City Council of the Town of Los Altos Hills in any case in which it is deemed that such double fee would be a special hardship, and that the work was commenced without intent to evade this ordinance. SECTION 6: The Building Inspector of the Town of Los Altos Hills is hereby charged with the enforcement and administration of the provisions of this Ordinance. SECTION 7: This Ordinance shall not be construed as l GON10 & FAIBANT -2- %0 V imposing upon the Town of Los Altos Hills any liability or responsibility for damages resulting from defective building, plumbing or electrical work; nor shall the Town of Los Altos Hills or any official or employee thereof be held as assuming any such liability or responsibility by reason of the inspections authorized hereunder. SECTION 8: Any person, firm or corporation violating any of the provisions of this Ordinance or the Codes hereby adopted shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed $500.00 or by imprisonment in the facilities then in use by the Town of Los Altos Hills as a jail for not to exceed six (6) months, or by both such fine and imprisonment. Each separate day or any portion thereof during which any violation of this Code occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be pun- ishable as herein provided. SECTION 9: The erection, construction, enlargement, alteration, repair, movement, improvement, removal, conversion, demolition, equipping, use, occupancy, or maintenance, of any contrary to any of the provisions hereof building or structure within the Town of Los Altos Hills, is hereby declared to be and constitute a public nuisance, and to be subject to abatement as such. The owner of the premises in- volved in any such public nuisance shall be responsible for payment to the Town of Los Altos Hills of any and all costs incurred, including reasonable attorneys' fees, in the abatement of any such nuisance, and all such costs shall be charged as a special assessment against the land upon which the building or structure is located and shall be collected in the manner pro- vided for special assessments. SECTION 10: If any section, sentence, clause or phrase of "GOF10 3 FAIBANT -3- V this ordinance is for any reason held to be unconstitutional or invalid, said decision shall not effect the validity of the remaining portions of this Ordinance. This Council hereby declares that it would have passed this Ordinance and each Section, sentence, clause and phrase thereof irrespective of the fact that any one or some other section, sentence, clause, or phrases be declared unconstitutional or invalid. SECTION 11. Every electrical and telephone service lead-in, constructed or placed subsequent to the effective date hereof, shall be constructed and placed under ground so that no portion thereof remains above ground at any place between the street or easement line supply and the structure which it serves. SECTION 12. The requirements of the foregoing Section 11 shall not apply to installations of the following types: a. Where the installation consists of the addition of a wire or wires to an already existing utility lead-in. b. Where as to the particular installation all of the following criteria are met: 1. The service lead-in shall approach the structure served from the rear or side lot lines, as opposed to the area of customary ingress and egress to and from the structure. installation. 2. N been misconstrued or misapplied with regard to any particular installation shall have the right to appeal such questions to the City Council. The procedure for such appeal and considera- tion thereof shall be that specified in Section XIII of Ordinance No. 78 of the Town of Los Altos Hills adopted by the City Council on December 4, 1961. SECTION 12. Ordinance No. 29 adopted by the City Council of the Town of Los Altos Hills on February 25, 1957, Ordinance No. 33 adopted by the City Council of the Town of Los Altos Hills on March 11, 1957, Ordinance No. 56 adopted by the City Council of the Town of Los Altos Hills on July 20, 1959, Ordinance No. 76 adopted by the City Council of the Town of Los Altos Hills on September 18, 1961, Ordinance No. 88 adopted by the City Council of the Town of Los Altos Hills on May 20, 1963, Ordinance No. 96 adopted by the City Council of the Town of Los Altos Hills on December 2, 1963, Ordinance No. 104 adopted by the City Council of the Town of Los Altos Hills on March 1, 1965, and Ordinance No. 113 adopted by the City Council of the Town of Los Altos Hills on February 7, 1966, be and the same are hereby repealed, and Resolution No. 340 adopted by the City Council of the Town of Los Altos Hills on March 7, 1966, to the extent it is inconsistent herewith, is rescinded, all effective on the effective date of this Ordinance. SECTION 13. This Ordinance shall be posted in three (3) public places within the Town of Los Altos Hills, and shall become effective thirty (30) days following its adoption.
