HomeMy WebLinkAbout147430 40 ORDINANCE NO. 147 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS, CALIFORNIA, PROHIBITING THE OPERATION UPON PRIVATE PROPERTY AND PRIVATE ROADS OF UNLICENSED VEHICLES AND OF MOTOR VEHICLES BY UNLICENSED PERSONS AND PRESCRIBING PENALTIES FOR VIOLATION THEREOF, BEING AN URGENCY MEASURE EFFECTIVE IMMEDIATELY THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Definitions. Unless the provision or con- text otherwise requires, these definitions shall govern the construction of this ordinance. (a) Driver's License. "Driver's license" means a license to operate motor vehicles duly issued by the Depart- ment of Motor Vehicles of the State of California, and shall include both an operator's and a chauffeur's license. (b) Implement of Husbandry. An "implement of husbandry" is a vehicle which is used exclusively in the conduct of agri- cultural operations. An implement of husbandry does not include a vehicle which is designed primarily for the trans- portation of persons or property on a highway. (c) Farm Tractor. A "farm tractor" is a tractor which may be used on a highway to draw a farm trailer carrying produce or carryingother implements of husbandry, between farms or to a processing or handling point and returning with or without the trailer, but which otherwise is itself an implement of husbandry. (d) Motor Cycle. A "motor cycle" is any motor vehicle other than a tractor having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground and weighing less than 1,500 pounds, except that four wheels may be in contact with the ground when two of the wheels are a functional part of a sidecar. A "motor assisted bicycle" is a standard bicycle designed primarily to be driven by human motive power, to which an auxiliary motor of not exceeding one-half gross brake horsepower has been attached. (f) Motor Driven Cycle. A "motor driven cycle" is any motorcycle including every motor scooter, with a motor which produces less than 15 gross brake horsepower, but not including any motor assisted bicycle. (g) Motor Vehicle. a "motor vehicle" is a vehicle which is self-propelled. (h) Private Road or Driveway. A"private road or driveway" is a way or place in private ownership and used for vehicular travel by the owner and those having express or implied per- mission from the owner but not by other members of the public. SECTION 2. Operations Prohibited. (a) No person shall drive a motorcycle, motor driven cycle or motor vehicle (other than an implement of husbandry, a farm tractor or a motor assisted bicycle) upon any private property within the Town of Los Altos Hills or upon any private road or driveway in said Town (unless such private road is then subject to the regulatory provisions of the Vehicle Code of the State of California) unless he holds in his possession a valid driver's license which has been issued to him by the Department of Motor Vehicles of the State of California. (b) No person, whether he is licensed or not, shall drive any motorcycle, motor driven cycle or motor vehicle (other than an implement of husbandry, a farm tractor or a motor assisted bicycle) upon any private property within the Town of Los Altos Hills or upon any private road or driveway in said Town (unless such private road is then subject to the -2- L OORIO 9 FAIBANT `O V' regulatory provisions of the Vehicle Code of the State of California), unless such motorcycle, motor driven cycle, or motor vehicle is duly registered with the Department of Motor Vehicles of the State of California pursuant to the provisions of the California Vehicle Code, and evidence of such regis- tration is displayed pursuant to the provisions of said Vehicle Code applicable to public highways. SECTION 3. Nuisances. Each violation of this Ordinance shall constitute a public nuisance and be subject to abate- ment as such. SECTION 4. Penalties for Violation. Every person who violates this Ordinance or suffers it to be violated shall be guilty of a misdemeanor and shall be punishable by a fine of not to exceed $500.00 or by imprisonment in the County Jail for not to exceed six (6) months or by both such fine and imprisonment. SECTION 5. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this ordinance. The Council of the Town of Los Altos Hills hereby declares that it would have passed this ordinance and each section, subsection, paragraph, sentence, clause and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses or phrases be declared unconstitutional or invalid. SECTION 6. Urgency Measure. The City Council of the Town of Los Altos Hills hereby finds and determines that an emergency exists within said. Town due to the hazards to life, limb and property created by the operation on private property of un- licensed vehicles, and of vehicles by unlicensed drivers, and LADO RIO R FAMA.T -3- N ri that the public health, safety and welfare require the enact- ment of the within Ordinance and the same is hereby adopted as an urgency measure effective immediately upon adoption.
