AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS PROHIBITING
CERTAIN ACTS WITHIN THE LIMITS OF PARKS, PRESERVES OR OTHER
PUBLIC AREAS AND PROVIDING FOR PENALTIES FOR VIOLATION.
The City Council of the Town of Los Altos Hills does
hereby ordain as follows:
SECTION I. ACTS WITHIN LIMITS OF PARK, PRESERVE OR
OTHER PUBLIC AREA.
It shall be unlawful for any person to do any of the
acts hereinafter specified within the limits of any public
park, preserve or other public area in the Town of Los Altos Hills:
1. To cut, break, injure, deface or disturb any tree, shrub,
plant, rock, building, monument, bench or other structure,
apparatus or property; to pluck, pull up, out, take or remove
any shrub, bush, plant or flower; to mark, or write upon, any
building, monument, fence, bench or other structure; to cut or
remove any wood, turf, grass, soil, rock, sand or gravel;
provided however that Town employees and agents in the course
of their duties of maintenance of said areas shall be permitted
to do any or all of the above specified acts, and provided further
that acts by private individuals prohibited by this subsection
may be permitted where the public interest so requires, by
express prior authorization of the City Manager. This section
shall not be construed so as to apply to unavoidable accidental
damage to trees, shrubs and turf.
2. To distribute any handbills, or circulars, or to post,
place, or erect any bills, notice, paper or advertising device
or matter of any kind.
3. To make or kindle a fire for any purpose, or to in any
manner transport fire or any burning substance, except in
designated picnic areas where fireplaces are provided therefor,

or in such designated fireplaces to leave any fire or live
coals unextinguished and unattended, except that this shall
not be construed as a restriction on the smoking of any cigar,
cigarette, pipe, or other device for smoking lawful nicotine
compounds; provided, further, it shall be unlawful to discard,
throw or drop any lighted match, cigar, cigarette, or any other
burning substance within such areas.
4. To camp, lodge, occupy sleeping bags, or sleep,
between the hours of twelve midnight and six a.m.
5. To kill or have in possession any wild birds or
animals.
6. To throw, deposit, place or leave in or upon any place
within said parks or upon said preserve or public area any waste
papers, cans, bottles, trash, refuse or rubbish of any kind,
except in a receptacle provided for such purpose by the Town.
7. To place in trash receptacles provided in such parks,
household trash or garbage generated or accumulated outside of
said park, preserve or public area.
SECTION II. DRIVING IN PARKS, PRESERVES OR OTHER PUBLIC AREAS.
A. PROHIBITION. It shall be unlawful for any person to
drive, propel, or operate any motor vehicle, except as provided
in subsection B herein, on any public park, preserve, or other
public area (except on roads or streets designated for vehicular
traffic) within the Town of Los Altos Hills.
B. EXCEPTIONS. The following are excepted from the
provisions of this section:
1. Police officers or auxiliary police officers
operating vehicles in the performance of their duties;
2. Persons operating vehicles owned by public agencies
in the performance of their duties;

3. Any person operating a motor vehicle in the

performance of a contract for construction, repair or maintenance
of any public park, preserve or other public area, or structure
thereon, or agent or employee of such person.
C. MOTOR VEHICLE DEFINED. For purposes of this section,
a "motor vehicle" is defined as any vehicle which is self-
propelled. It includes, but is not limited to, automobiles,
trucks, jeeps, motorcycles, motor scooters, motor driven
bicycles, beach buggies and amphibious craft or vehicles.
SECTION III. VIOLATION.
Any person or entity violating any provision of this
Ordinance shall be guilty of a misdemeanor and upon conviction
thereof may be punished by a fine of not more than Five Hundred
Dollars ($500.00) or by imprisonment for not more than six (6)
months in any jail or commitment facility used by the Town of
Los Altos Hills, or by both such fine and imprisonment. Each
day any such violation exists shall be deemed to be a separate
offense.
SECTION IV. SEVERABILITY.
If any section, subsection, clause, phrase or sentence of
this Ordinance be declared, for any reason, invalid or
unconstitutional, by any court of competent jurisdiction,
such decision shall not affect the remaining portions of this
Ordinance. The City Council of the Town of Los Altos Hills
hereby declares that it would have passed this Ordinance and
each section, subsection, clause, phrase, and sentence thereof,
regardless of the fact that any one or more other sections,
subsections, clauses, phrases, and sentences thereof were declared
invalid or unconstitutional.
SECTION V. PUBLICATION, EFFECTIVE DATE.
This Ordinance shall be posted in three (3) public places
within the Town of Los Altos Hills and shall become effective

thirty (30) days following its adoption.
I HEREBY CERTIFY that the foregoing ordinance was introduced
at a regular meeting of the City Council of the Town of Los Altos
Hills on the 20th day of April, 1970, and was thereafter, at a
regular meeting of said Council, held on the 4th day of May,
1970, passed and adopted by the following roll call vote:
