AN ORDINANCE AMENDING CERTAIN PROVISIONS OF THE LOS ALTOS
HILLS MUNICIPAL CODE RELATING TO SLOPE DENSITY, BEING AN
URGENCY ORDINANCE EFFECTIVE IMMEDIATELY UPON ADOPTION.
The City Council of the Town of Los Altos Hills, California,
does hereby ordain as follows:
SECTION 1. Amendment of Municipal Code
Sec. 9-5.401 of the Los Altos Hills Municipal Code
is hereby amended to read as follows:

"Sec. 9-5.401 Lot area.
The provisions of this section are minimum
requirements for lots used or intended to be used
for primary uses or conditional uses. other laws of
the Town may impose standards requiring substantially
larger lots, thereby reducing the number of lots
possible in a subdivision.
(a) Minimum lot area. No lot shall have a net
area less than 43,560 square feet.
(b) Slope density requirements. In addition to
the requirements set forth in section (a) of this section,
the average area of lots created in any subdivision shall
not be less than the following:
(1) Where the average slope of the parcel
to be subdivided is greater than ten (10%) percent, but
not greater than forty-five (45%) percent, the average
net lot area shall not be less than "a" as determined by
the formula: a - 1 where "S" is
the average slope of: the parcel in percent.
(2) Where the average slope of the parcel to
be subdivided is greater than forty-five (45%) percent,

the following provisions shall apply:
(f) The number of lots and
average net lot area permitted shall be based on a
demonstration by the applicant and a finding by the
Planning Commission that each lot and related
subdivision improvements can be developed in
compliance with the "Purposes" (Sec. 9-5.103) of
this chapter and "Purposes" of Title 9, Chapter 4,
of this Code.
(ii) The Planning Commission
shall extend the formula provisions in Sec. 9-5.401(b)(1)
to the average slope of the parcel to be subdivided
as a guideline up to fifty (50%) percent in determining
the adequacy of the average net lot area of the
subdivision.
(iii) In no case shall the average
net lot area be less than the area required by
Sec. 9-5.401(b)(1) for a slope of forty-five (45%)
percent.
(3) For the purposes of subsections (1)
and (2) of this subsection, the average slope of a
parcel to be subdivided shall be determined according
to the formula S - .00229 IL where:

(ii) I is the contour interval
in feet;
(iii) L is the combined length of
contour lines in scale feet; and
(iv) A is the gross area in acres
of the parcel to be subdivided.

A topographic base map shall be used in meeting
the requirements for tentative subdivision maps as set
forth in Article 3 of Chapter 4 of this title.
Measurements along contours shall be made at contour
intervals not to exceed ten (10') feet. Any portion
or portions of a parcel to be subdivided which have an
average slope greater than 55 (55%) percent may be
assigned an average slope of 55 (55%) percent for
purposes of computing the average slope of the entire
parcel.
(4) Any proposed lot which is large enough
to be further subdivided under the provisions of
subsections (1) and (2) of this subsection, shall be
excluded in computing the average slope and average net
lot area in the balance of the subdivision.
(5) It is intended that the flexibility in
individual lot sizes permitted by this ordinance shall
be used for the purpose of maximizing the inherent
usefulness of each lot as a superior building site and
in adjusting the overall subdivision to natural
conditions and the surrounding neighborhood. The
Planning Commission shall review the size of individual
lots to determine compliance with this intent.
(6) Once a final subdivision map has been
recorded for a subdivision, lot lines shall thereafter
not be altered so as to allow a greater number of lots
in that subdivision than the maximum permitted by the
provisions of subsections (1) and (2) of this subsection.
Lots not included in the total net acreage used in
determining average lot area, as provided for in
subsection (4) of this subsection, may be further

divided subject to the provisions of this chapter and
other laws of the Town."
SECTION 2. Urgency Measure
This ordinance is adopted pursuant to Sec. 65858
of the Government Code of the State of California, as an
urgency measure necessary to protect the public safety,
health, and welfare, and is for the purpose of prohibiting
any uses which may be in conflict with contemplated zoning
proposals which the City Council and the Planning Commission
of the Town of Los Altos Hills intend to study within a
reasonable time. The City Council of the Town of Los Altos
Hills hereby finds and determines that the natural environment
of the steeper properties of the Town affected by this
ordinance have a high degree of frailty and are vulnerable
to irreversible damage which could be brought about by
unregulated human intervention, and that the purpose of this
ordinance is to prevent the possible loss of important resources
by intensive development occurring while appropriate regulations
are being studied.
SECTION 3. Effective Date, Duration
This ordinance, being an urgency measure, shall become
effective immediately upon its adoption, and shall be and remain
in full force and effect for one hundred twenty (120) days
following the date of adoption, unless further extended by
subsequent ordinance.

introduced at a regular/meeting of the City Council of
the Town of Los Altos Hills on the 16th day of May, 1972,
and was thereafter, on the same date, passed and adopted
by the following roll call vote:
