HomeMy WebLinkAbout213'b N ORDINANCE NO. z 3 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS AMENDING THE LOS ALTOS HILLS MUNICIPAL CODE BY ADDING THERETO PROVISIONS RELATING TO THE PRESERVATION OF HISTORICAL SITES. The City Council of the Town of Los Altos Hills does hereby ordain as follows: SECTION 1. There is hereby added to Title 9 of the Los Altos Hills Municipal Code a new Chapter 6, to read as follows: "CHAPTER 6. PROTECTION OF HISTORICAL SITES. Sec. 9-6.01. Designation of Historical Sites. The Council may, from time to time, based upon evidence presented to it, find and determine that a particular site within the Town has significant historical or archaeological value, and designate such site as a Historical Site. For purposes of this chapter the term "Historical Site" shall mean any site so designated pursuant to this section or by appropriate state or federal authority. Sec. 9-6.02. Protection of Historical Sites. No person shall damage, deface or destroy or cause to be damaged, defaced or destroyed any Historical Site without prior written approval of the Council. Sec. 9-6.03. New Developments Involving Historical Sites. No project, including without limitation mining, road building, real estate development, deep plowing, land leveling or recreational use, which might endanger any Historical Site, shall be undertaken without prior submission of a written report assessing the impact of such project upon such Historical Site. If any such project will damage such Historical Site, permission to proceed will be conditioned upon making provision for adequate protection of the Historical Site. Sec. 9-6.04. Means of Protecting Historical Sites. Acceptable means of reducing the impact of a project on a Historical Site shall, depending upon specific circumstances, include the following in descending order of preference. (a) Protection of the Site as part of a park, monument, shrine or other controlled area. (b) Leaving the Site in its natural condition. (c) Burial or other non-destructive covering of the Site. (d) Excavation of the Site by archaeologists acceptable to the Town, with all materials and information recovered remaining the property of the Town. Sec. 9-6.05. Historical Site Policies. It shall be the policy of the Town to encourage property owners and developers to adhere to the spirit of the foregoing provisions as well as the compatible policies established by the National Environmental Policy Act and all other applicable federal and state laws. It shall further be the policy of the Town to move vigorously to acquire and to protect Historical Sites important to its history, in accordance with a master plan to be designed by the Town Historian in consultation with the Town Council and with appropriate specialists." -2- IWO V SECTION 2. This ordinance shall be posted within the Town of Los Altos Hills in three (3) public places and shall become effective thirty (30) days following its adoption. I HEREBY CERTIFY that the foregoing ordinance was introduced at a regular meeting of the City Council of the Town of Los Altos Hills on August 15, 1973, and was thereafter, at a regular meeting of said Council held on September 5, 1973, passed and adopted.
