HomeMy WebLinkAbout225Y_ s (40 C%VtNANCE NO. 225 J J AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS AMENDING CHAPTER 1 OF TITLE 4 OF THE LOS ALTOS HILLS MUNICIPAL CODE ENTITLED "EMERGENCY SERVICES" The City Council of the Town of Los Altos Hills does ordain as follows: SECTION 1. AMENDMENT OF CODE. Chapter 1 of Title 4 of the Los Altos Hills Municipal Code hereby is amended to read as follows: TITLE 4. PUBLIC SAFETY Chapter 1. Emergency Services Sec. 4-1.01. Purposes. The declared purposes of this chapter are to provides for the preparation and carrying out of plans for the protection of persons and property within the Town in the event of an emergency and to provide for the coordination of the emergency functions of the Town with all other public agencies and affected private persons, corporations, and organizations. Any expenditures made in connection with such emergency activities, including mutual aid activities, shall be deemed conclusively to be for the direct protection and benefit of the persons and property within the Town. Sec. 4-1.02. Definitions. For the purposes of this chapter, "emergency" shall mean the actual or threatened existence of conditions of disaster or of extreme peril to the safety of persons and property within this Town caused by such conditions as air pollution, fire, flood, storm, epidemic, riot, earthquake, or other conditions including conditions resulting from war or imminent threat of war, but other than conditions resulting from a labor controversy, which conditions are or are likely to be beyond the control of the services, personnel, equipment, and facilities of this Town, requiring the combined forces of other political subdivisions to combat. it rr J J Sec. 4-1.03. Disaster Council: Membership The Town of Los Altos Hills Disaster Council is hereby created and shall consist of the following: (a) The Mayor, who shall be Chairman; (b) The Mayor Pro Tem, who shall be Vice -Chairman; (c) The City Manager, who shall develop emergency preparedness plans and organize the civil preparedness program of the Town and have such other duties as may be assigned by the Chairman. (d) The Sheriff of Santa Clara County and the Fire Chief of the Los Altos Fire District, or designees. (e) The Chief of Police of Los Altos Hills or his designee. (f) Such representatives of civic, business, labor, veterans, military, professional, or other organizations having an official group or organization civil preparedness responsibility as may be appointed by the Disaster Council. Sec. 4-1.04. Disaster Council: Powers and Duties: Meetings. It shall be the duty of the Disaster Council, and it is hereby empowered to review and recommend for adoption by the City Council civil preparedness and mutual aid plans and agreements and such ordinances, resolutions, rules and regulations as are necessary to implement such plans and agreements. The Disaster Council shall meet upon call of the Chairman at least semi-annually, or, in his absence from the Town or inability to call such meeting, upon the call of the Vice -Chairman. Sec. 4-1.05. Director of Emergency Services: Powers and Duties. There is hereby created the office of the Director of Emergency Services. The Mayor shall be the Director of Emergency Services. There is hereby created the office of Assistant Director of Emergency services, who shall be the City Manager. The Director is hereby empowered: -2- it V J d (a) To proclaim the existence or threatened existence of a local emergency and the termination thereof, subject to confirmation by the City Council at the earliest practicable time; (b) To request the Governor through appropriate channels to proclaim a state of emergency when, if in the opinion of the Director, the resources of the Town are inadequate to cope with the emergency. (c) To control and direct or provide for the control and direction of the efforts of the Emergency Services Organization of the Town for the accomplishment of the purposes of this chapter; (d) To direct or provide for the coordination and cooperation between groups, services, divisions, and Staff of the Emergency Service Organization of the Town and to resolve questions of authority and responsibility which may arise between them; and (e) To represent or provide representation of the Emergency Services Organization fo the Town in all dealings with public or private agencies pertaining to civil preparedness. Sec. 4-1.06. Director of Emergency Services: Powers and duties during emergencies. In the event of the proclamation of a local emergency or the proclamation of a state of emergency by the Governor or the State Director of the Office of Emergency Services or the existence of a state of war emergency, the Director is hereby empowered: (a) To make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency. (b) To obtain vital supplies, equipment, and such other properties found lacking and needed for the protection of the life and property -3- I V v J of the people, and to bind the Town for the fair value thereof, and, if required immediately, to commandeer the same for public use. (c) To require the emergency services of any Town officer or employee and, in the event of the proclamation of a state of emergency by the Governor in the region in which the Town is located, to command the aid of as many citizens of the community as the Director thinks necessary in the execution of his duties. Such persons shall be entitled to all privileges, benefits, and immunities as are provided by State law for registered disaster service worker volunteers; (d) To requisition the necessary personnel or materials of any Town department or agency; and (e) To execute all of his ordinary powers as Mayor, all of the special powers conferred upon him by any ordinance, statute, agreement approved by the City Council, or by any other lawful authority. Sec. 4-1.08. Emergency Organization. All officers and employees of this city, together with those volunteer forces enrolled to aid them during any emergency, and all groups, organizations, and persons who may by agreement or operation of law, including persons impressed into service under the provisions of Sec. 4-1.06 (c) of this Ordinance, be charged with duties incident to the protection of life and property in this city during such emergency, shall constitute the emergency organization of the Town of Los Altos Hills. Sec. 4-1.09. Emergency Plan. The Town of Los Altos Hills Disaster Council shall be responsible for the development of the Town of Los Altos Hills Emergency Plan, which plan shall provide for the effective mobilization of all of the resources of this Town, -4- W v J both public and private, to meet any condition constituting a local emergency, state of emergency, or state of war emergency; and shall provide for the organization, powers and duties, services, and staff of the emergency organization. Such plan shall take effect upon adoption by resolution of the City Council. Sec. 4-1.10. Violations: Penalties. It shall be a misdemeanor, punishable as set forth in Chapter 2 of Title I of this Code, for any person during an emergency: (a) Willfully to obstruct, hinder, or delay any member of the Emergency Services Organization in the enforcement of any lawful rule or regulation issued pursuant to the provisions of this chapter or in the performance of any duty imposed upon him by virtue of the provisions of this chapter. (b) To do any act forbidden by any lawful rules or regulations issued pursuant to the provisions of this chapter if such act if of such nature as to give, or be likely to give, assistance to the enemy, or to imperil the lives, or property of the inhabitants of the Town, or to prevent, hinder, or delay the defense or protection thereof; and (c) To wear, carry, or display, without authority, any means of identification specified by the State Office of Emergency Services. SECTION 2. EFFECTIVE DATE. This ordinance shall be posted in three (3) public places within the Town of Los Altos Hills and shall become effective thirty (30) days following its adoption. SECTION 3. SEVERABILITY. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this ordinance are declared to be severable. -5- 410 V V4 d I HEREBY CERTIFY that the foregoing ordinance was introduced at a regular meeting of the City Council of the Town of Los Altos Hills on the 6th day of August , 1975, and was thereafter, at a regular meeting of said Council, held on the 20th day of August 1975, passed and adopted by the following roll call vote: AYES: Councilmen Cheney, Helgesson, McReynolds, Mayor Grabowski NOES: Councilwoman Miller ABSENT: NONE ABSTAIN: NONE , Appro Ma r ATTEST: - �� City Clerk 0
