LOS ALTOS HILLS, CA. 94022 RESOLUTION NO. 921 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILL-S ORDERING THE VACATION AND ABANDONMENT OF A PORTION OF A CERTAIN STREET LOCATED IN THE TOWN OF LOS ALTOS HILLS, UNDER THE PROVISIONS OF THE "STREET VACATION ACT OF 1941, " SECTION 8300, et seq. , OF THE STREETS AND HIGHWAYS CODE ORDER OF VACATION AND ABANDONMENT WHEREAS, the City Council of the Town of Los Altos Hills , under and pursuant to the provisions of the "Street Vacation Act of 1941, " Section 8300 et seq. , Streets and Highways Code, did on the 5th day of November, 1975, pass and adopt Resolution No. 913 declaring. the intention of said City Council to vacate a portion of a certain public street easement hereinafter described in the Exhibit "A" attached hereto and incorporated herein by reference; and WHEREAS, the official name of the street, a portion of which is proposed to be abandoned and the name by which it is commonly known, is Estacada Drive (formerly Estacada Avenue) ; and WHEREAS, a public hearing was had on the 3rd day of December, 1975, in the meeting place of the City Council, Council Chambers , Town Hall, 26379 Fremont Road, Los Altos Hills, California, whereat said proposed vacation and abandonment were duly considered, and said matter submitted to said City Council for action; and WHEREAS, notice of said hearing was duly given and made in the time, form, manner and by posting, in the manner required by the aforementioned Statute, and proof thereof is on file with said City Council; and 41) B 811 PAU697 WHEREAS, no protests, either written or oral, were filed with or received by said City Council respecting the proposed vacation and abandonment of the portion of the street described in Exhibit "A" and the Planning. Commission submitted its report and recommendation; And said City Council being fully advised in said matter and finds that, from all the evidence submitted, that a portion of a certain public street easement in the Town of Los Altos Hills, herein- after particularly described in Exhibit "A" is unnecessary for present or prospective public street purposes, and further finds that the public convenience and necessity require the reservation of the hereinafter described easements and rights-of-way for strucutres, NOW, THEREFORE, BE IT AND ITIS HEREBY RESOLVED by said City Council that the foregoing Recitals are true and correct; BE IT FURTHER RESOLVED by said City Council that the portion of the public street easement described in Exhibit "A" be, and it is hereby vacated and abandoned as being unnecessary for present or prospective public purposes; provided, however, there hereby is reserved and excepted from the vacation of a portion of Estacada Drive (formerly Estacada Avenue) more particularly described in Exhibit "A" , the permanent easement and right at any time, or from time to time, respectively, to construct, maintain, operate, replace, remove and renew water pipe lines, sanitary sewers and storm drains and other public utilities and appurtenant structures in, upon, over and across the portion of the public street easement herein ordered vacated and the property described in Exhibit "A" , and pursuant to any existing franchises or renewals thereof, or otherwise, to install, construct, maintain, repair, operate, replace, remove, renew and -2- • 0 ti B 811 PAcE69s enlarge lines of pipe, conduits, cables, wires, poles, and other con- venient structures, equipment and fixtures in, upon, over and across the portion of the public street easement herein ordered vacated and the property described in Exhibit "A" for the operation of gas pipe lines , telegraphic and telephone lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water and incidental purposes, including access and the right to keep the property described in Exhibit "A" free from inflammable materials, and wood growth, and otherwise protect the same from all hazards, in, upon and over the portion of the public street herein ordered vacated and the property described in Exhibit "A" . BE IT FURTHER RESOLVED, that the portion of the public street easement herein vacated and abandoned is described in Exhibit "A" . Along the northerly line of the said last mentioned Lot 8, West to the northwesterly corner of the aforesaid Lot 8 , a distance of 67. 91 feet; thence 2. Leaving the northerly line of the aforesaid Lot 8 , along a circular arc to the left, having a radial bearing of North 76°24 ' 04" West, a radius of 40. 00 feet, a central angle of 103°35 ' 56" and a length of 72. 32 feet to a point, having . a radial bearing of North; thence 3 . Leaving the- aforesaid circular curve, North, to the southerly line of Lot 9 , as the said Lot 9 is shown and delineated on the afore- said subdivision map of Tract No. 1118 , a distance of 0. 60 feet more or less; thence 4.
