HomeMy WebLinkAbout31ORDINANCE NO. 31 An Ordinance of the Town of Los Altos Hills providing for the licensing for Revenue of all business, as defined therein, within the City and establishing procedures for the collection thereof and authorizing legal action for collection when necessary. The City Council of the Toxin of Los Altos Hills does ordain as follows: Term SECTION 13-1: This Ordinance may be cited as the Business License Ordinance of the Town of Los Altos Hills. Definitions SECTION 13-2: The following terms, phrases and words shall be deemed to have the meaning given herein. (a) "City" is the Toxin of Los Altos Hills. b "Council" is the City Council of the Town of Los Altos Hills. (c) "License Officer" is the Inspector of the Town of Los Altos Bills or deputy authorized by him as such. (d) "Insignia" is any emblem, sticker or other kind of identifying device required by this Ordinance. (e) "License" means the right to use or carry on a business as defined herein for a period of time as specified. (f) "Business" is meant to include all kinds of vocations, occupations, professions, enterprises, establish- ments and all other kinds of activities and matters, together with all devices, materials, vehicles and appurtenances used therein, any of which are conducted for commercial or monetary gain or benefit, directly or indirectly, upon any premises or elsehwere within the Town of Los Altos Hills. (g) "Person" include any individual or partnership or association together of individuals or any corporate entity or any officer, agent, or ernloyee thereof. SECTION 13-3: Compliance Required. Every person shall, except as otherwise provided in this Ordinance before engaging in, conducting, transacting or carrying on any business-trithidthe Torm of Los Altos Mills, pay -a fee for revenue only toaid City and receive areceipt and .license for such business, No pers se any vehicle, premise, device or machinery in connection with business without such fee and license. Any such license must be kept ineffect.in conformity with this ordinance and such license shall not be connected with regulation but the fee thereof imposed for revenue only and collection processed by court action in event of non-payment. SECTION 13-4: Agents Responsibility. Agents or representatives of non-resident persons who are doing business within City shall be personally responsible for the compliance by their principals with this Ordinance as well as the direct responsibility of the principals. SECTION 13-5: Exceptions as to delivery. No license shall be required of any person from any persons for the mere delivery in the City of property purchased or acquired elsewhere in good faith from such person at a regular place of business outside the City or for the regular delivery within the City upon the order of a resident thereof of food products, newspapers or other regularly established incidents of residential living. SECTION 13-6: City License Officer City License Officer shall: (a) Collect all license fees and shall issue all licenses to qualified persons. ORDINAANCE '# 311 �M; - 2 - (b) Promulgate and enforce necessary rules and regulations. (c) Adopt all forms and prescribe information deemed desirable to be stated therein. (d) Require applicant to state such facts in writing and upon penalty of perjury as deemed necessary. SECTION 13-7: Procedure Application shall be filed in person or by mail and shall be accompanied by the payment of the fee as provided herein. A written receipt shall be given for any payment made and a license, if as a license, or insignia thereof delivered. SECTION 13-8: Term - The period for which a' license is issued shall be for the fiscal year of City dating from July let in any year to June 30th of the succeeding year, or any fraction of such year. SECTION 13-9: Renewal - Renewal of License may be had by payment of the fee therefor. SECTION 13-10: Fees: The Annual License fee shall be set forth in the following Schedule: (a) General Contractor - including building, paving and repair and remodelling operations. 3 50.00 (b) Amusement Parks, Camp grounds, restaurant or dancing facilities. 50.00 (c) Auctioneers - for the 1st day with an additional 25.00ect charge for additional days (d) Delivery of commodities to locations within the Town of Los Altos Hills from '-lithout the City on regular schedules for established routes for each from one to five route operation 25.00 (e) Delivery of commodities to locations within the Town of Los Altos Hills not an regular schedule or established routes a l.fee for vehicle 1 ton or less capacity 5..00 2.fee for one to 8 ton vehicle 8.00 3.fee for over 8 ton vehicle 12.00 (f) All other businesses 25.00 g No fee shall be required for any non-profit activity for which the City Council of the Town of Los Altos Hills gives Permit. Except that for any license issued after January let of any year the fee shall be one-half that stipulated in the above table. SECTION 13-11: Contents of License Each License shall contain: lal Name of Licensee or business under which conducted. b Rind and address of business c License fee d Date of issuance and of expiration (e) Such other information as License officer deems pertinent. SECTION 13-12: Display - Any License issued hereunder, or any insignia in connection therewith, shall be kept for public display in connection with the conduct of this business and as to any motor vehicles by affixing to a proper location to seen on such vehicle. SECTION 13-13: Home occupation exclusion - No License shall be required for a strictly home occupation which is defined as part time activity wholly minor in character and as related to a main occupation as homemaker and completely incidental to household duties and without advertising referring to location or visible evidence thereof from the outside. -2- �W - 4 vd -3- SECTION 13-14: Exclusion of Utilities - No License fee shall be required of any person operating under any franchise or contract of the City from which a fee payment is made to the City. SECTION 13-15: Non -validating effect. The acceptance of a fee or issuance of a License under this Ordinance shall not be regarded as approval of any business or the conduct thereof contrary to the laws of the State or Ordinance of the City nor in violation of any health or safety measures or provisions or an operation which is deemed a nuisance or contrary to the interests of the health, welfare and safety of any individual or entity. SECTION 13-16: Enforcement. -The License Officer shall be responsible for the enforcement of this Ordinance and shall make all investigations deemed necessary therefor. Any peace officer of the City shall render every assistance required by the License Officer and the City Attorney shall upon request process any measures for enforcement of the Ordinance. SECTION 13-17: Liability. The amount of an unpaid license fee shall constitute a debt due the City. SECTION 13-18: Severability. The City Council of the Town of Los Altos Hills hereby declares that it would have adopted any word, sentence, phrase or section of this Ordinance irrespective of any other word, sentence, phrase or section. If any Court of competent jurisdiction shall declare any portion of this Ordinance void or unconstitutional, it shall not effect any other portion and except as so declared void or unconstitutional, this Ordinance shall remain in full force and effect. SECTION 13-19: Effective Date. This Ordinance shall become effective 31 days after its adoption and shall be posted in 3 public places as designated within the Town of Los Altos Hills. SECTION 13-20: There has been heretofore established in the Town of Los Altos Hills the position of Building Inspector. The Building Inspector of the Town of Los Altos Hills shall be responsible for the enforcement of this ordinance and shall issue all permits as provided. The above and foregoing Ordinance was duly introduced at a regular meeting of the Council of the Town of Los Altos Hills on Monday the Wth day of March, 1957, duly and regularly passed by the following vote: AYES: Councilmen Bledsoe, Fow'e, Hoefler, Mayor Treat.
