ORDINANCE NO. 36
An Ordinance of the Town of Los Altos Hills
regdrding the construction, laying or maintaining of pipes
drains or conduits across or along puolic ways or cutting
into or removing the surface thereof in the Town of Los
Altos Hills.
The City Council of the Town of Los Altos Hills
does ordain as follows:
Section 1 - Permit Reequir�ed: No person or agency
whether pu c or private, shall make any cut into or inter-
fere with or remove the surface of any public way or shall
construct or maintain any pipe, drain or conduit along or
across any street, road or highway in the Town or make any
excavation or out therein for such purpose without first
obtaining a permit so to do in the manner herein provided.
Section 2 - Uplication IpA Depgait: Any person
or agency, wwE ie mer pub c or private, ddesiirinng to construct
lay or maintain any pipe, drain or conduit along or across any
street, road or highway under jurisdiction of the Town shall
make application in writing to the Town Clerk and shall deposit
with such application the sum of One Hundred Dollars (100.00)
or a sum of money sufficient in amount in the opinion of the
Town Clerk to cover the total coat of the contemplated work,
whichever amount shall be greater or in the discretion of the
Town Clerk a good and sufficient bond in lieu thereof;
provided that no permit or bond shall be required from a public
agency or public utility entity operating in the Town of Loa
Altos Hills under a franchise granted by the Town of Los Altos
Hills or from any district or entity for which express authority
to lay mains without permit is specifically given by law.
However, such agency, public utility or district shall be
required to give at least 24 hours notice before undertaking
any operations thereon. The provisions as to operations and the
obligations for restoration as hereinafter provided shall
apply to such agency, public utility or district as is setforth
for other users; Provided that the Town Clerk may in his dis-
cretion waive the requirement for the deposit of said sum or
bond for public agencies or public utility corporations which
are entitled to operate or maintain facilities in public rights -
of way either by operation of law or pursuant to a franchise
granted by the Town. Said deposit or bond is required for the
purpose of ensuring the proper laying or construction of such
pipe, drain or conduit and the proper restoration of said
highway and shall be forfeited or called, as the case may be
in the event that the work is not properly done as herein
provided.

specified herein, which work shall be done in all cases under
the supervision and to the satisfaction of said Town Engineer.

No more trenches shall be opened than can be
properly and completely bacYfi.11ed in one (1) day. No gars

on any project unless authorized by the Town Engineer.
One (1) traffic lane shall be kept open in safe
condition at all times. Adequate warning and .regulatory signs
and other safety measures sh;.11 be taken at all times to protect
the public who may or must be present in the area where work
is being performed. Complete closure of all traffic lanes
may be made at the discretion of and in accordance with the
plans for detours approved by the Town Engineer. Twenty-four (24)
hours advance notice must be filed with t`.e Town Engineer and
Town Clerk, stating the road to be closed, the limits and
approximate duration of closure. Such agencies must also be
notified immediately upon reopening of the road to emergency
vehicles.
Road Commissioner shall be supplied at all times
with the names and telephone numbers of at least two (2)
persons in charge of or responsible for the work subject to
$ermit who can be reached for emergency work twenty-four
(24) hours a day, seven (7) days a week.
(2) Backfill. Backfill in all trenches shall be
attained by any type of tamping capable of producing the
compaction requirements, except that no water tamping will be
permitted within two feet of finish grade. Backfill shall be
compacted to a relative compaction of 95% for the entire deptb.

the entire trench section with a minimum thickness of 12 incb.er
and compacted to 950/6 relative compaction.
The City reserves the right to make as many compac-
tion tests as it deems necessary to a certain conformance to
the compaction requirements. The cost of such tests shall be
borne by the persons performing the excavation in, along,
and across roads. Upon completion of the backfill and road
base, but prior to placing surfacing, the pavement adjacent
to the work shall be thoroughly cleaned to the satisfaction
of the Town Road Commissioner. A power broom shall be used if
so required by the Road Commissioner.
(3) Restoration of Pavement: After compaction tests
have been made on the trench section to the satisfaction of the
Road Commissioner, pavement shall be restored as follows:
a. The untreated road base shall be given one (1)
coat of SC -1 road oil applied at the rate of
0.25 gallons per squre yard.
b. The entire trench shall be paved with hot plant
mix surfacing 2%z inches in thickness after
rolling. The plant mix shall conform to the
requirements of Section 20 of the Standard
State Specifications Type B mix.
c. After the pavement has been rolled, the surface
shall be treated with a fog seal coat applied
at the rate of .05 gallons per square yard.
(4) Miscellaneous. The City may, as a condition
to granting an encroaclent permit, require a field inspectior.
with representatives of both the applicant and the Road
Commissioner's office. A description of the condition of
the existing pavement and shoulders will be filed with the

Road Commissioner and the applicant. Pavement shoulder,
disturbed by the applicant's operations will be restored at
the applicant's expense to the satisfaction of the Road (ur�-
missioner. Small utility extensions and lateral connections
to existing sanitary sewers may be exempted from the regaireT,n'.s
of such prior field inspection. In such event, encroach-
ment permits may be issued upon receipt of request therefor
together with a sketch showing location or a written
description of the proposed work.
Property owners shall be protected from any
damage to property and dust nuisance. A water wagon shall
be available on demand of the Road Commissioner.
Written permission of the Road Commissioner
shall be required for excavations made between November
1 and March 1.
Any non-compliance with these specifications
shall be remedied within five (5) days after written
notice to do so by Road Commissioner. Upon failure to
conform with the request of the Road Commissioner within
said five (5) day period, the Town shall be entitled to
proceed to correct the deficiency, and the costs thereof
shall be the obligation of the applicant.
The Town may perform any emergency work requiring
immediate attention which applicant fails or is unable
to remedy; the costs of such work shall be the obligation
of the applicant.
Inspection costs incurred by the Town in the
progress of the applicant's operations shall be reimbursed
to the Town by the applicant. The Town shall be the sole
judge as to the need of such inspection.
The City Clerk's office shall be notified forty-
eight (48) hours prior to the actual beginning of any
excavation in, along or across any road or highway in
the Town.
No work shall be deemed completed until final
approval thereof is made in writing by the Road Commissioner.
Applicant may be required to indemnify and save
harmless the Town, its officers and employees from any
suits, claims or actions brought by any person or persons
for or on account of any injuries or damages sustained
or arising out of the excavations covered by this section.
Applicant shall maintain the condition of his
excavation and pavement restoration to the satisfaction
of the Road Commissioner.
Section 4. This Ordinance shall be posted in
three (3) puu-b places in the Town of Los Altos Hills
and shall take effect 31 days after its passage.

of the Town Council of the Town of Los Altos Hills held
