An Ordinance of the Town of Los Altos Hills providing for the licensing for Revenue of all business, as defined therein, within the City and establishing procedures for the collection thereof and authorizing legal action for collection when necessary. The City Council of the Town of Los Alto: Hi.17.a foes ordain as follows: Term SECTION 13-1: This Ordinance may be cited as the Business License Ordinance of the Town of Los Altos Hills. Definitions SECTION 13-2: The following terms, phrases and words shall be deemed to have the meaning given herein. N"City" is the Town of Los Altos Hills. "Council" is the City Council of the Town of Los Altos Hills. (c) "City License Officer". There has been here- tofore established in the Town of Los Altos Hills theposition of City Inspector of Buildings and Public Works. The Building Inspector of the Town of Los Altos Hills shall be responsible for the enforcement of this ordinance and shall issue all permits as provided. (d) "Insignia" is any emblem, sticker or other kind of identifying device required by this Ordinance. (e) "License" means the fee to use or carry on a business as defined herein for a period of time as specified. ,(f) "Business" is meant to include indicated vocations, occupations, professions, enterprises, establish- ments and all other kinds of activities and matters, together with all devices, materials, vehicles and appurtenances used therein, any of which are conducted for commercial or monetary gain or benefit, directly or indirectly, upon any premises or elsewhere within the Town of Los Altos Hills. (g) "Person" include any individual or partnership „r association together of individuals or any corporate entity or any officer, agent, or employee thereof. (h) "Contractor" shall include any "Sub -contractor". SECTION 13-3: Compliance Required. Every person engaged in conducting, transacting, or carrying on any business within the Town of Los Altos Hills, shall pay a fee for revenue only as provided in this ordinance, to said City and receive a receipt and license for such ousiness. Any such license must be kept in effect in conformity with this Ordinance and such license shall not be connected with regulation but the fee thereof imposed for revenue only and subject to collection processed by court proceedings in event of non-payment. ` - 2 - SECTION 13-4: Agents Responsibility. Agents or representatives of non-resident persons who are doing business within City shall be personally responsible for the compliance by their principals with this Ordinance as well as the direct responsibility of the principals. SECTION 13-5: City License Officer City License Officer shall: (a) Collect all license fees and shall issue all licenses to qualified persons. (b) Promulgate and enforce necessary rules and regulations. (c) Adopt all forms and prescribe information deemed desirable to be stated therein. (d) Require applicant to state such facts in writing and upon penalty of perjury as deemed necessary. SECTION 13-6: Procedure Application shall be filed in person or by mail and shall be accompanied by the payment of the fee as provided herein. A w-^itten receipt shall be given for any payment made and a license, i€ as a license, or insignia thereof delivered. SECTION 13-7: Term - The period for which a license is issued shall be for the fiscal year of City dating from July let la any year to June 30th of the succeeding year, or any fraction of such year. SECTION 13-5: Renewal - Renewal of License may be had by payment of the fee therefor. SECTION 13-9: Fees: The Annual License fee shall be set forth in the following schedule: Classification of Contractor Brick S 25.00 Cement 25.00 Electrical 25.00 Flooring 25.00 Jobbing 5.00 General 50.00 Glazing 25.00 Grading 25.00 Heating 25.00 House Moving or 'Wrecking 25.00 Masonry 25.00 Painting 25.00 Paving 25.00 Plastering 25.00 r ORDINANCE NO. 4 - 3 - Plumbing $ 1,5.00 Roofing 25.00 Sewer 25.00 Sheet Metal 25.00 Sheet Rock Contractor 25.00 Spraying or Tree Surgeon 25.00 Electrical Fixtures 10.00 Tile 25.00 Chimney Sweep 5.00 Landscape Contractor 25.00 Supervising Architect 25.00 All other Contractors not specifically classified 25.00 Except that for any license issued after January let of any year the fee shall be one-half that stipulated in the above table. SECTION 13-10: Contents of License Each License shall contain: (a Name of Licensee or business under which conducted. (b Kind and address of business. c License fee d Date of issuance and expiration. (e Such other information as License officer deems pertinent. SECTION 13-11: Display - Any License issued hereunder, or any insignia in connection therewith, shall be kept for public display in connection with the conduct of this business and as to any motor vehicles by affixing to a proper location to be seen on such vehicle. SECTION 13-12: Exclusion of Utilities - No License fee shall Se required of any person operating under any franchise or con- tract of the City from which a fee payment is made to the City. SECTION 13-13: Non -validating effect. The acceptance of a fee or issuance of a License under this Ordinance shall not be regarded as approval of any business or the conduct thereof contrary to the laws of the State or Ordinance of the City nor in violation of any health or safety measures or provisions or an operation which is deemed a nuisance or contrary to the interests of the health, welfare and safety of any indiv- idual or entity. SECTION 13-14: Enforcement. The License Officer shall be responsible for the enforcement of this Ordinance and shall make all investigations deemed necessary therefor. i ORDINANCE NO. 31 - 4 - SECTION 13-15 Liability 4 41 The amount of an unpaid license fee shall constitute a debt due the City and legal action may be instituted for the collec- tion thereof if not paid as specified herein. SECTION 13-16: Severability. The City Council of the Town of Los Altos Hills hereby declares that it would have adopted any word, sentence, phrase or section of this Ordinance irrespective of any other word, sentence, phrase or section. If any Court of competent jurisdiction shall declare any portion of this Ordinance void or unconstitutional, it shall not effect any other portion and except as so declared void or unconstitutional, this Ordinance shall remain in full force and effect. SECTION 13-17: Effective Date. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and general wel- fare of the people of the Town of Los Altos Hills, and shall take effect immediately upon its adoption. The following is a statement of the facts found and determined by the City Council of the Town of Los Altos Hills showing the urgency of this Ordinance. Revenues of the Town of Los Altos Hills are insufficient to cLequately provide for the services which should be available to residents of the Town of Los Altos Hills as well as for the protection and security of those doing business for such residents of a contractural nature or as are employed in any enterprise within the City. The City Council of the Town of Los Altos Hills finds that a Licensing Ordinance as contained herein is a fair end usual and essential enactment; that immediate revenues there- from are essential and unnecessary loss thereof will result from any delay in the enactment of an Ordinance of Licensing as con- tained herein. SECTION 13-18: This Ordinance shall be posted by the City Clerk in three public places heretofore designated by the City Council by Resolution and take effect immediately upon its adoption.
