HomeMy WebLinkAbout65I i O R D I N A NT C E N o y 6 � AN ORDINANCE OF THE TC1JN OF LOS UTOS HILLS ADOPTING REG_ ULATIONS FOR OFFICL'L =f W LINES, PROHIBITING THE PLACING OF BUITDINGS OR SM S WITHIN SAI:' FLAN LINES, PROVID- ING FOR UNIFORM W-11 D RDS OF PROCEDURE FOR V.IRIANCES AND ADNSTMENT WITH RESPECT TO SUCH PLAN LINES, AND ADOPTING OFFICLSL PL.',N LINES FOR LUPINE ROAD, SECTION I. BUILDING PROHIBITED. Except as otherwise herein provid- ed, no building, structure or other improvements shall hereafter be erected or placed within any Official Plan Line established by ordinance of the Town of Los Altos Hills. This provision shall not apply to lawn, crops, planting, shrubbery and the like, nor to such ordinary front yard fences and non -permanent structures which will not in the opinion of the City Planning Commission defeat the purposes of this Ordinance. S' TION II. PROCEDURE FOR V.1RI_1Tc --- ";T _S. The City Council of the Town of Los .'.itos Hills, upon the recommendation of the Planning Com- mission of said Town, shall have power to grant adjustments or variances from the strict application of the provisions of Sect- ion I of this Ordinance in cases or a�ehere due to special conditions :reptional cha^^,ctor-1-acs of the propa--ry involved; or itslocation or surroundings, , literal enforcement of the Ordinance would result in practical difficulties or unnecessary hardships, provided that no such adjustment or variance shall be granted unless the Planning Commission and the City Council find that the granting of such variance will not be contrary to the intent of this Ordinance nor to the public interest, safety, health and welfare. ;application for any adjustment or variance pursuant to this Section shall be made to the Planning Commission and shall include a scale driwing of the building, structure or other improvement to be erected, together with such infornation as the Planning Commission nay require. filing fee of Fifty Dollars (550,00) shall accompan. each such application. Upon receipt Of such application, the Planning Comnission shall hold one pub- lic hearing thereon, notice of which hearing shall be given by publication once in a newspaper of general circulation within the Town of Los altos Hills, not less than ten days prior to the date of said hearing. The Planning Comnission shall make its deci- sion upon said application and report such decision to the City Council within fifteen (15) days after the public hearing, re- commending the granting of said adjustment or variance subject to such conditions as the Planning Commission nay deem necessary to the accomplishmont of the puiposos of this Ordinance and of the objectives of tile General Plan of the Town of Los :otos Hills, or shall recommond that the application for the variance or adjustment be denied. LUnINE ROAD PLL1.N LINES, There is hereby adopted a certain Official PF.Lan Lines Map of the Town of Los Altos Hills, a copy of which is attached hereto and by this reference specifi- cally incorporated herein .and made a part hereof, and which is more particularly described as Official Plan Lines Map Lupine Road between Page Mill Road and Marian ..venue, dated November 19`03. The above and foregoing Ordinance was regularly introduced at at regular meeting of the City Council of the Town of Los Altos Hills on the Eleventh day of July , 1960, and was thereafter on the First Day of Auuust , 1960, duly and regularly pass- ed by the following vote: AYES: Councilmen Clayton, Sherlock Henley, Aiken, Mayor Fowls NOES: None ABSENT: None ayor ATTEST: 1ty Jerk
