AS FOLLO'.13: SECTION I. CF7IC�3 CRE.TcD: That the office of the City Manager of the City of the Town of Los Altos Hills be, and the same is hereby created and established. The Cit-, Manager shall be appointed by the City Council on the basis of his administrative and executive ability, with emrhasis upon ex- perience in the field of Civil n,Iineering and City adminis- tration, and shall hold office for and Burin; the Pleasure of the City Council. SECTION II. "LIGIBIIITY: No person elected as a Councilman of the City shall, subsequent to such election, be eligible for appointment as City Manager until one year has elapsed after such Council member shall have ceased to be a member of the City Council. SECTION III. BOND: The City Nanager shall furnish a corporate surety bond. to be aprroved by the City Council in such sum as may be determined by the said City Council and shall be conditioned uron the faithful rerforrance of the dut- ies imposed upon the City Manager as herein nrescribed. Any premium for such bond shall be e, proper charge against the Town of Los altos Hills. SECTION IV. TSIiPOR..'iRY i udi:G?:3: The City Manager shall appoint, subject to the aprroval of the City Council, one of the other officers or derartment heads of tae City to serve as m: -eager Pro tempore during any temrorary absence or disability of the City Manager. In caee of the absence or disability of the City Manager and his failure to so appoint a manager pro tempore, the City Council may designate sore qualified city em- ployee to perform the duties of the City Manager Burin,_; the per- iod of absence or disability of sai,? Cit, Eanager, subject, how- ever, to said person furnishing a corporate surety bond condi- tioned upon faithful performance of tae duties re,uired to he rerformed as set forth in 'ection III hereof. i!ny such person serving as manager rro terarore whether appointed by the City Manager or designated by the City Council, shall not receive compensation for the performance of such office unless expressly so provided by resolution of the City Council SECTION V. COIiPENSA.TI0<i: The City Nanager shall re- ceive such compensation and expense allowances as the City Coun- cil shall from time to time determine and fix by resolution, and said compensation and expenses shall be a proper charge against such funds of the City as the City Council shall design- ate. Said City Manager shall be reimbursed for all sums necessarily incurred or paid by him in tae performance of his duties or incurred when travelling on business pertaining to the City under direction of the City Council; reimbursement shall only be made, however, when a verified itemized claim, setting forth the sums expended for such business for which reimbursement is requested, has been presented to the City Council and by it approved and allowed. SECTION VI. rOWERS A:?' DUTIES: The City Manager shall be the administrative head of the ;overnment of the City under the direction and control of the City Council except as otherwise provided in this Ordinance. He shall be responsible for the efficient administration of all the affairs of the City which are under his control. In addition to his general powers as administrative head, and not as a limitation thereon, it shall be his duty and he shall have the powers set forth in the following subsections: A. Law Enforcement: The City Iianager shall cause all laws and ordinances of the City to be enforced and shall see to the faithful observance of all franchises, contracts, permits and Privileges granted by the City Council. B. Authority Over Employees: It shall be the duty of the City Manamer and he shall have the authority to control, or- der and give directions to all 'heads of departments and to sub- ordinate officers and emnloyees of the City under pis jurisdiction through their derartment heads. Provided, however, that this authority shall not extend to or apply to the City Attorney, the City Engineer, or to elected officers of the City and their employ- ed staffs. C. Power of Appointment: It shall be the duty of the City Manager to, and he shall appoint, remove, promote and demote any and all officers and emplcye»s of the Town of Los Altos hills, except the City Clerk, City Attorney, City Treasurer, and City Engineer, subject to the Personnel Ordinance of the Town of Los s V -3- Altos 'ills and personnel rules and regulations adorted pur- suant thereto. D. eor7anization of Office: It shall be the fluty of the City P=anaer to recommendto the City Council such re- organization of offices, rositions, departments, or units un- der his direction as may be indicated in the interest of effi- cient, effective and economical conduct of the City's busi- ness. E. Ordinances: It shall be the duty of the City Manager and he shall recommendto the City Council for adopt- ion such measures and ordinances as he deems necessary or ex- pedient. F. Attendance at Council Vesting: It shall be the duty of the City Yianager to at`end all meeting of the City Council unless excused therefrom, except when his removal or compensation is under consideration. G. Financial Reports: It shall be the duty of the City Manager to keen the City Council at all times fully ad- vised as to the financial conditions and needs of the City. H. rudget: It shall be the duty of the City Mana- ger to prepare and submit tae proposed annual budget and the proposed annual salary elan to the City Council for its ap- proval. I. Purchasing Agent: It shall be the duty of tae City Manage- and he shall be responsible for the purchase of all materials, sup;lies .and equipment for all the derartments or divisions of the City. P?o expen6itures shall be submitted or recommended to the City Council except on report and approv- al of the City Manager. S. Public Buildings and Irorerty: It shall be tie duty of the City Manager and he shall. exercise Teneral super- vision over all public buildings, public narks and all other public property which are under the control and jurisdiction of the City Council. It shall be the further duty of the City Manager to maintain a perpetual inventory of city -owned property and to make, compile and file with the City Clerk a complete inrentory of property, both real and personal, owned by the Town of Los Altos Hills and file the inventories thereof at least semi-annually as to stock supplies and equipment and at least annually as to other properties. K. Hours of Employment: It shall be the duty of the City Manager to devote his entire time to the duties of his office in the interests of the City. Ar- -4- L. Departmental Cooperation: It shall be the duty of all subordinate officers and the Cite Clerk, City Treasurer, City Engineer and City Attorney to assist the City Managerin administering the affairs of the City efficiently, economically and harmoniously so far as may be consistent with their duties as prescribed by law and ordinances of the City. M. Attendance at Commission and Board Meetings: The City Manager may attend any andall meetings of the Planning Commission, and any other Commission, Boards or Committees hereafter created by the City Council, uror his own volition or upon direction of the City Council. At such meeting which the City Manager attends, to shall be heard by such Commission, Boards or Committees as to all matters uron which he wishes to address the members thereof, qnd he shall inform said members as to the status of any matter being considered by the City Council and he shall coor.erate to the fullest extent with the members of all Commissions, 3oards or Committees arpointed by the City Council. The City Manager shall from time to time re- tort to the City Council concerning: his attendance at any such meeting. N. :,dlitional Duties: It shall be tae duty of the City "lana--er to perform such other duties and exercise such other powers as may be dele,ated to him from tiy.e to time by ordinance or resolution or other action of the City Council. SDCTION VII, R71F07AL OF P'L'JTA9ER: In case of his in- tended removal by the Council, the Manager shall be furnished with a written notice stating the Council's intention to re- move him and reason therefor at least thirty (30) days before the effective date of lis removal. :Phe Council, in -emoving the S'.anager, shall use its uncontrolled discretion and its action shall be final, and shall not depend upon any particular showing or degree of rrcof, although the Manager shall be af- forded an onnortunity to publicly present to the Council his grounds of oprosition to removal i�rior to Council action re- moving him. .SECTION VIII. LI*_tITATIJ OF R7,M07AL: Notwithstand- ing the provisions of this ordinance hereinbefore enumerated, the City Manager shall not be removed from office durin or within a period of thirty (30) days next succeeding any general -s - municipal election held in the City at which election a mem- ber of the City Council is elected; the purpose of this pro- vision is to allow any newly elected merber of the City Coun- cil or a reorganized Ciby Council to observe the actions and ability of the City "tanager in the performance of the rowers and duties of his office. After the expiration of said thirty (30) day period aforementioned, the provi,ions of the preceding section as to the removal of said City Manager shall apply and be effective. 33CTION IX. VAIIT=Y: If any rrovision of this Ord- inance, or the application thereof to any person or circum- stances, is held invalid, no other provision of this Ordinance shall be affected thereby. S3CTION X. F03TIT-IG: This Ordinance shall be costed in three (3) rublic places within the Town of Los Altos Hills and shall become effective thirty (30) days after its adoption.
