Definitions of Words and Phrases. The followin5 words and phrases when used in this ordinance shall for the purpose of this ordinance have the meanings respectively ascribed to them in this Article. SECTION 1.1. Motor Vehicle Code Definitionsto be Used. .. Whenever any words or phrases used in this ordinance are not defined herein, but are defined .inthe Vehicle Code of the State of California and amendments thereto, such definitions are incorporated herein and shall be deemed to apply to.such words and phrases used herein as though set forth herein in full. SECTION 1.2; Bicycle. A light vehicle without a motor, having two (2) wheels, handle bars and a seat or seats and propelled by the operator. - SECTION 1.3• Council. The Council of the City. of the Town of Los Altos Hills. SECTION 1.4 Curb. The lateral boundary of the roadway whether such curb be marked by curbing construction, or not so marked; the word "curb" as herein used shall not include the line dividing the roadway of a street from parking strips in the center of a street, nor from tracks or rights-of-way of public utility companies. SECTION 1.5• Divisional Island. A raised island located in the road,,jay and separating opposing or conflicting streams of traffic. SECTION 1.6. Park. To stand or leave standing any vehicle, whether occupied or lot, otherwise than temporarily for the purpose of and while actually ngaged in loading or unloading of passengers or materials. SECTION 1.7: Parkway. That portion of a street other than a roadway ora sidewalk. SECTION 1,8, Pedestrian. ,Any person afoot. SECTION 1.9• police Officer. Every officer of such agency aF may be acting as the Police Department of this city or any officer authorized to direct or reg- ulate traffic or to make axrests for violations of traffic regulations. SECTION 1.10. Stop. When required, mean complete cessation of movement. SECTIO7 1.11. Stop or Stand. ',then prohibited means any stopping or standing of a vehicle, whether occupied or not, except when necessary to avoid conflict with Other traffi or in compliance with the directions of a police officer or official traffic control device. SFCTIOIT. l.12. Vehicle Code. The Vehicle Code of the State of California. ARTICIr TI 7`7FIC °.DT'IITTI''TRATION SECTION 2. Duties of Police Chief. The Police Chief of the Town of Too Altos Hills shall exer- cise the powers and duties as provided in this ordinance and in the traffic ordinances and resolutions of this city. If the Police Chief is required or authorized to place or maintain official traffic con- trol devices or signals, he Tay cause such devices or signals to be pllced. or'maintained. SECTION 2.1. Delegotion of Towers to Police Chief. It shall be the general duty of the Police Chief to determine the installation. and proper timing and maintenance of traffic con- trol devices and signalr, to conduct engineering analyses of traffic accidents ;?n-'. to devise remedial measures, to conduct engineering and traffic investigation of traffic conditions and to cooperate with other city officials in the development of ;-gays and means to improve traffic conditions, and to carry out the additional rowers and duties imposed by ordinances of this city, �henever, by theProvisionsof this ordinance a power is granted to the police Chief or a duty imposed upon I im, the power may be exercised or the duty performed b -y his deputy or b.�. a person authorized inwriting by him. -2_ ENFORC'J'R;NT AND O�T_?DIENCV TO TR,FFIC REGULATIONS. 3ECTION_3 kuthority of Folic and wise Department Officials Officers of the Police Department andisubh.officcrs-as are - assigned b,� the Chief of Police are h4eby a(thorized to direct all traffic by voice, hand, audible or other signal in conformance with traffic laws, except that in the event' a Eire or other emergency or to expedite traffic or to safeguard pd�lesfrians, officers of the I:olice Department or members of the Fire Department may direct traffic as conditions may require, notwithstanding tha provisions to the contrary contained in this ordinance or the Vehicle Code. SF'CTION 3.1.Fersors other Than Officials�3hall Not Direct Traffic. No person other than an officer of the Police Department or members of the ^ire Department or a person authorized buy the Chief of Police or a person authorized by law shall direct or Attempt to direct traffic by voice, hand or other signal, except that persons may operate, when and as herein provided, any mechanical pushbutton signal erectedby order of the Police Chief. - S7CTIONT 3.2. Obedience to Police or Authorized Officers. No person shall fail or refuse to comply with or to perform any act forbidden b-, any lawful order, _signal, .or- direction ofa traffic or police officer, or a member of the Fire Department, or. a person authorized by the Chief of Tolice or b., law. S^CTION 3.3. authority of Felice in Crowds and at Places `Jhere Large Numbers of People and Vehicles are to Be Oathered or,, Have Gathere,1.. Nothing in this ordinance shall be construedto prevent any police officer from prohibiting any person from parking any vehicle upon or using any street, sidewalk or path, or from prohibiting any pedestrian from using any street, sidewalk or path; and police off-' icers shall have authority to direct the parking of vehicles in any reasonable way, manner or direction, and it is hereby declared to be unlawful for any person to fail to Dromptly obey th-a said police officer's order, signal or command r.-gardless of any other n_rovision of the ordinance. -33 SECTION 3,4. Required Obedience to Traffic Ordinance, It is a misdemeanor for any person driving any vehicle or other conveyance upon any street, or any pedestrian, to do any act forbidden, or fail to perform any act required as applicable to any such person un- der this ordinance. SECTION 3.5. Traffic Regulations Apply to Persons Riding Biales or Animals. Every person riding a bicycle or riding or driving an animal upon a highway shall be granted all.of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by this ordinance, except those provisions which by their very nature can have no application. SECTION 3..6. Obstruction or Interference With Police or Authorized Officers. No person shall interfere with or obstruct in anywayany police officer or other officer or employee of this city in the enforcement of the provisions of this ordinance. The removal, obliteration or conceal- ment of any chalk mark or other distinguishing mark used by any police officer or other employee or officer of this city in connection with the enforcement of the parkingregulationsof this ordinance shall consti- tute such interference or obstruction. SECTION 3.7. Public Employees to Obey Traffic Regulations. The provisions of this ordinance shall apply to the operator of any vehicle owned by or used in the service of the United States Government, this State, any county or city, and it shall be unlawful for any said operator to violate any of the provisions of this ordinanceexceptas otherwise permitted in this ordinance or by the Vehicle Code. SECTION 3.8. Exemption of Certain Vehicles. (A) The provisions of this ordinance regulating the operation, parking and standing of vehicles shall not apply to vehicles operated by the Police or Fire Department, any public ambulance or any public utility vehicle or any private ambulance, which public utility vehicle or private ambulance has qualified as an authorized emergency vehicle, when any vehicle mentioned in this section is operated in the manner specified by the Vehicle Code in response to an emergency call.. (B) The foregoing exemptions shall not, however, protect the oper- ator of any such vehicle from the consequences of his wilful disregard of the safety of others. -4- �(C) The pvovisions`6Y' this ordinance rebuiwti(_o standing of vehicles shall not apply to any vehicle of a city'department or public utility while necessarily in use for construction of repair work or any vehicle ownedor operated by the United States lost Office Department while in use for the collection, transportion or delivery of United 7tates mail. SGCTI�N 3.9. Resort of Damage to Certain Fro ert, (A) The oper^tor of a vehicle or the person in charge of any animal involved in any accident resulting in damage to any property publicly owned or owned b- a public utility, including but not limited to any fire hydrant, Parking meter, limhting post, telephone pole, electric light or power pole, or resulting in dam-ge to any tree, traffic control device or other property of a like nature located in or along any street, shall �Fithin twenty-four (24) hours .after such accident make a written re- port of such accident to the Police Department of this city. (B) Every such report shall state the time ,hen and the place where the accident took place, the name and address of the person owning and of the person over ting or in charge of such Vehicle or animal, the license number of every such vehicle, and shall briefly describe the property damage in such accident. (C) The operator of any vehicle involved in an accident shall not be subject to the r�,quirements or penalties of this section if and during the time he is Physically incapable of making a report, but in such event he shall make a report as required in subdivision (A) wit'::in twenty-four (24) hours after regaining ability to make such report. S,CTION 3.10. When Vehicles Nay Be Removed From Streets. Any regularly employed and salaried officer of the Police Department of this city nay remove or cause to be removed: (2) .=ny vehicle that has been parked or left standing upon a street or highway for one hundred twenty (120) or mord consecutive hours. (B) .ny vehicla which is parked or left standing upon a street or highway between the hours of 7:00 A.M. and 7:00 F.H. when such parking or standing is prohibited by .ordinance or resolution of this city and signs are posted giving notice of such removal. (C) .any vehicle which is parked or left standing upon a street or highway where the use of such street or highway or a portionthereof is necessary for the cleaning, repair or construction of the street or highway or for the installation of underground utilities or where the -5- use of the street or highway or any portion thereof isauthorized for a purpose other than the normal flow of traffic or where the use of the street or highway or any portion thereof is necessary for the movement of equipment, articles or structures of unusual size, end the perking of such vehicle would prohibit or interfere .,ith such use or movement; provided that signs giving notice that such vehicle may be removed are erected or Placed at least twenty-four (24) hours prior to the removal. ARTICLE IV TF, FFIC CONTROL DEVICES SECTION 4. ,^.uthority to install Traffic Control Devices. (,) The Police Chief shall have the power and duty to place and maintain or cause to be placed and maintained official traffic control devices when and as required to make effective the rrovisions of this ordin:<nce. (B) Vhenever the Vehicle Code requires for the effectiveness of any provision thereof that traffic control divices 'De installed to give notice to the public of the application of such law the Police Chief is hereby authorized to install or cause to 1,c installed the necessary devices subject to any -limitations or restrictions set forth in the law applicable thereto. (C) TheL'olice Chief may also place and maintain or cause to be placed and maintained succi additional traffic control devices as he may deem necessary or proper to regulate traffic or to guide or warn traffic, but he shall make such determination only upon the basis of traffic en- gineering principals and traffic investigations r-.nd in accordance with such standards, limitations, andrules, and at such locations .:,.s may be set forth in this ordinance or as may be determined by ordinance or reso- lution of the Council. SECTION 4.1. Traffic Control :signs Required for Enforcement Purposes. No provision of the Vehicle Code or of this ordinance for which signs are required shall be enforced against an alleged violator unless appropriate signs are in place and are sufficiently legible to be seen by an ordinarily observant person, giving notice of such provisions of the traffic laws. -6- (.' SECTION 4.2 Obedience to Traffic Control Devices. The operator of any vehicle shall obey the instructions of any official traffic control device placed in accordance with this ordinance unless otherwise directed by a police officer or other authorized per- son subject to the exceptions granted the operator of an authorized - emergency vehicle when responding to emergency calls. SECTION 4.3 Installation of Traffic 2ianals. (A) The Police Chief is hereby directed to install and maintain official traffic signals at those intersections and other places where the Council. has determined that traffic conditions are such as to re- quire that the flow of traffic be alternately interrupted and released in order to Prevent or relieve traffic congestion onto protect life or property from exceptional hazard. (B) The Felice Chief shall ascertain and determine the locations where such signals are required by field investigation, traffic counts and other traffic information as may be pertinent and his determinations therefrom shall be made in accordance with those traffic engineering and safety standards and instructions set forth in the California Main- tenance Manual issued by the Division of Highways of the atate Depart- ment of Public 'dorks. (C) "1henever the Police Chief installs and maintaiis an official traffic signal at any intersection, he shall likewise erect and maintain at such intersection street name signs visible to the principal flow of traffic unless such street name signs have pre- viously been placed and are maintained at any said interaction. SSSCTION 4.4. Lane Marking. The Police Chief is hereby authorized to mark_ center lines and lane lines upon the surface ofth road•ray to indicate the cour8e. to be traveled by vehicles and nay place signs temporarily designating lanes to be used by traffic moving in a pa-ticular direction, regard- less of the center line of the highway. OEC.?I OI7 4.5.Distinctive Roadway Markings. The Police Chief is authorized to place and maintain di.s- tirctive roadway markings as described in the Vehicle Code on those .Streets or pa-ts of streets where the volume of traffic or the ver- tical or other curvature of the -road ::gay renders it hazardous to drive on the left side of such marking or sign and markings. -'uchimarking or signs and marking shall have the same effect as similar markings rlaced by the State Department of Public 'forks Pursuant to provisions of the Vehicle Code. -7- SUCTION 4.5. s.uthority to Remove_, Relocate and Discontinue Traffic Control Devices. The Police Chief is hereby authorized to remove, relocate or discontinue the operation of any traffic control device not specifically required b7 the Vehicle Code or this ordinance -,henever he ^nd the Citi? Council shall determine in any particular case that the conditions which ,,arranted or required the installation no longer exist or obtain. 97CTION 4.7. Traffic Control Devices: Hours of Operation. The Police Chief shall determine th hours €,ndda�rra dw�in,-- �,�ihi ch .any traffic control device shall be in operation or be in effect, except in those cases where such hours or day^ are specifiedby the City Council. 33CTION 4.8. Unauthorized Painting of ('urbs. Yo person, unless authorized by this city shall paint any street '. or curb surface; provided, however, th-t this section shall not apply to the painting of numbers on a curb surface b -r any person who has complied with the provisions of any resolution or ordinance of this city pertaining thereto. ARTTCIZ.. V TURNING NOV'F—NT3 .. 6-CTION 5.-,luthority to i'lace and Obedience to Turning Markers. Intersections. Multirle Lanes. (A) The Police Chief i^ authorized to place markers, buttons, or signs within or adjacent to intersections ani indicating the course to be traveled by vehicles turnin- at such intersections, and the Police Chief is authorized to locate and indicqte more than one lane of traffic from which drivers of vehicles ma;: mcke r;g;-_t or lcft hand turns, and the course to be traveled as so indicated may conform to ^,r be other than as prescribed b law or ordinance. (B) '.Then authorized markers, buttons, or other indications are plated within an intersection indicating the course to be tre.v=led by vehicles turningthereat, no driver of a v�hicic =.hall disobey the directions of such indications. `i CTICTT 5.1. 4uthority to Place Restricted Turn 'i_.Tns. The Police Chief is hereby authorized to determine those intersections at which drivers of vehicle; shall not make a right, left, or U turn, and shall place proper signs at such intersections. The making of such turns may be prohibited between certain hours of ;any day ( ( 1 and permitted at other hours, in which event the same shall be plainly indicated on the ^.igns or they may be removed when such turns are permitted. SECTION 5.2. Obedience to No -Turn Signs. 'dhenever authorized signs are erected indicating that no right or left or U turn is permitted, oo driver of a. vehicle shall disobey the directions of any such sign. OECTION 5.3• Signal"Controlled Intersections -- Right "_'urns. (A) No driver of a. vehicle shall make a right turn ^ga.inst a red or stop signal at any intersection which is sign -posted giving notice of such restriction as hereinafter provided in this section. (B) The Police Chief shall post appropriate signs giving effect to this section where he determines that the making of right turns against a traffic signal "stop" indication !-could seriously interfere with the safe and orderly flow of traffic. ARTICL3 VI 07--.74Y STR7� -,T AND 6LL3YS SECTIO?? 6. The Police Chief to Sign One-', and Raleys. Whenever any ordinance or resolution of this city designates any one-way street or alley, the Police Chief shall rlace .and maintain signs giving notice thereof, and no such re.gul^tionsshall be effective unless such signs are in place. -igns indicating the direction of ful traffic movement shall be placed at every intersection where move- ment of traffic in the opposite direction is prohibited. ^RTI CLE VII SPE'CIeL 17073 R-;^L'I3ED '7CTION 7. The Police 'hie£ to '=rect :?,top ^igns. /henever any ordinance or resolution of this city designates and describes xny street or portion thereof as a through street, or any intersection at which vehicles are required to star at one or mere entrances thereto, the Police Chief shall erect and maintain stop signs as follows: A stop sign shall be erected on each and every street intersect- ing such through street or portion thereof so designs ted and 3t these entrances of other intersections where a stop is required and at any . railroad grace crossing sc designated. D'very such sign shall conform with, and shall be placed r.s provided in, the Vehicle %'ode. M C) ,,°.ECTION 7.1. Stop--at Through Street or Stop Sign. (A) Those streets and parts of streets established b- resolution of the council are hereby declared to be through streets for the purposes of this section. (B) The provisions of this section shall also apply at one or more entrances to the intersections as such entrances and intersections are established by resolution of the council. SECTI_N 7.2 Emerging From :`l leyiriveway or Building. The driver of a vehicle emerging from an alley, driveway or building shall stop such vehicle immediately prior to driving onto a sidewalk or into the sidewalk area extending across any alley or drive- way. Clinging to P ioving_Vehicle_ No person shall attach himself with his hands, or to catch on, or hold on to with his hands or b other means, to any moving vehicle for the purpose of receiving native ^o,eer therefrom. ,-CTI J',.1 &'.1. No operator e£ any vahicle shall enter an intersection or c marked crosswalk unless there is sufficient spaco on the other side of the inter- section or crosswalk to accomodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians, nct�-itla.t*nd- ing any traffic-control signal indic_,tion to proceed. -11- - ARTTCLE IX. FEDESTRI"N REGUUTIONS SECTION 9. PJlice Chief to Establish Marked Cross balks. (5) The Folice Chief shall establish, designate and maintain cross walks at intersections and other places by appropriate devices, marks or lines upon the surface of the..roadway at such places where he determines that there is particular hazard to pedestrian crossing the roadway. (B) Other than cross walks at intersections, no cross walk shall be established in any block which is less than four hundred feet (400�') from another established cross walk. (C) The Police Chief may place signs at or adjacent to an inter- section in respect to any cross walk directing that pedestrians shall cross or not cross a particular crossing indicated upon said signs. , SECTION 9.1. When Pedestrian Must Use Cross Walks. No pedestrian shall cross a roadway other than by a cross walk where such is provided. ".RTICLE X STOPPING STBNDING !T?D PARKING FOR CERT FURF SES R P?1IN :'L ICES SECTION 10. 4pplication of Regulations. (.1) The provisions of this Ordinance prohibiting the stoppilg, ,standing or parking of a vehicle shall apply at all times or at those times herein specified, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device. (B) The provisions of this Ordinance imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restrictive provisions of the Vehicle Code or the ordinances of this city prohibiting or limiting the standing or parking of vehicles in specified places or at specified times. SECTIO" 10.1 `:topping or Standinp� in Parkways Prohibited. _ No person shall stop, stand or park a vehicle within any parkway. The Police Chief is hereby authorized to maintain, by appropriate signs or by paint upon the curb surface, all no stopping zones, no park- ing areas, and restricted parking areas, as defined and described in this ordinance. -dhen said curb markings or signs are in place no operator of any vehicle shall stop, stand, or nark such vehicle adjacent to any such. legible curb marking or sign in violation of any of the provisions of this ordinance. SECTION 10.3. No Parking !seas. No operator of any vehicle shall stop, stand, park, or leave stand- ing such vehicle in any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the direction o£ a police officer or other authorized officer, or tra=ffic sign or signal: - 12 - ( C) 71 -any divisional ie. l,..nd unless authorized an-' cleanly indicated with appropriate signs or nsrkings.
