HomeMy WebLinkAbout92ORDINANCE NO. 92 AN ORDINANCE PROHIBITING THE MOVING OF BUILDINGS OVER, ALONG OR ACROSS HIGHWAYS, STREETS AND ALLEYS IN THE TOWN OF LOS ALTOS HILLS, PROVIDING FOR VARIANCES AND ENFORCE- MENT, AND PRESCRIBING PENALTIES FOR VIOLATION OF ITS PROVISIONS.. THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS DOES OR- DAIN AS FOLLOWS: SECTION I, Definitions. For turposes of this Ordinance, the following terms and words shall havethe meaning given herein, When not inconsistent with the text, words used in the present tense in- clude the future, words in the plural number include the singular number, and words in the singular number, ircluC.; t'' ---t% plural number, The word "shall" is always mandatory and not merely directory. (A) "Building" is a structure designed, built or occupied as a shelter or roofed enclosure for persons, animals or property, and used for any purpose whatever. Astructure containing an en- closed area of less than forty (40) square feet shall not fall with- in this definition, (B) "Person" is n_ -y pe -con, firm, partnership, association, corporation,company, organization or entity of any kind, SECTION II. Moving Prohibited. No person shall move any build- ing over, along, across or upon any highway, street or alley in the Town of Los Altos Hills. SECTION III. Variances. A permit for the moving of a building upon the streets, a eTiys or highways of the Town of Los Altos Hills may be granted in the event that both the Planning Commission and the City Council of the Town of Los Altos Hills find that there are special circumstances existing in connection with a particular such movement, and that the granting of such a permit would be in the best interests of the applicant and the residents of the Town of Los Altos Hills, andthatsuch issuance would involve no unreasonable risk to the public health, safety and welfare of the residents of the Town of Los Altos Hills. The procedure for application for such a permit and for consideration thereof should be that specified in Section XIII of Ordinance No. 78 of the Town of Los Altos Hills, adopted by the City Council on December 4, 1961, and no permit shall be issued unless, in addition to the findings mentioned hereinabove, the Planning Commission and the Cit7v'Council find that the conditions described in Section 13:60 (b) of said Ordinance No. 78 exist. The City Planning Commission and City Council shall consider such mat- ters as they deem relevant to each such application, and shell pose any any and all conditions deemed necessary as conditions precedent to the granting of any permit hereunder. SECTION N. Regeals. Ordinance No. 53 adopted by the City Council on May `6, 1959, - and Ordinance No. 89 adopted by the City Council on May 20, 1963 are hereby repealed. SECTION V. Penalties. Any person violating any provision of this Ordianance shall e, guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than FIVE HUNDRED DOLLARS 0500.00) or by imprisonment for not more than six (6) months in any jail or commitment facility used by the Town of Los Altos Hills, or by both such fine and imprisonment. SECTION VI, Nuisances." Eachandevery building placed or maintained or moved n violation of this Ordinance is hereby de- clared to be a nuisance and subject to abatement as such. SECTION VII, Effective Date. This Ordinance shall be posted in three (3) public places within t e Town of Los Altos Hills and shall be effective from and after thirty (30) days after its passage.
