HomeMy WebLinkAbout97ORDINANCE NO. 97 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS PROHIBITING SOLICITATION UPON PRIVATE PROPERTY, DECLARING VIOLATION TO BE A NUISANCE, PROVIDING FOR PENALTIES FOR VIOLATION, AND DECLARING THE EXISTENCE OF AN EMERGENCY THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS DOES ORDAIN AS FOLLOWS: Section 1: It shall be unlawful for any person to engage in business as a canvasser or solicitor, calling at residences within the Town of Los Altos Hills, without the previous consent of the occupant, for the purpose of soliciting orders, sales, subscriptions or business of any kind, or seeking for information or donations. Section 2: The practice of going in and upon private residence properties in the Town of Los Altos Hills by solicitors, peddlers, hawkers, itinerant merchants or transient vendors of merchandise, not having been requested or invited so to do by the owner or owners, occupant or occupants of said private residences, for the purpose of soliciting orders for the sale of goods, wares and merchandise and /or for the purpose of disposing of and/or peddling or hawking of same, is declared to be a nuisance and is prohibited. Section 3: The provisions of this ordinance shall not apply to officers or employees of the city, county, state or federal government or any subdivision thereof when on official business. Section 9: Every violation of this ordinance or any provision thereof shall constitute a misdemeanor, and every person committing the same shall be punished by a fine of not more than $500.00 or by imprisonment in the County Jail for not to exceed six (6) months, or by both such fine and imprisonment. Section 5: It is the intention of the City Council that each separate provision of this ordinance shall be deemed independent of all other provisions herein, and it is further the intention of the City Council that if any provision or application of this ordinance is declared invalid, all other provisions, and applications thereof shall remain valid and enforceable. -1- L GOFIO h FAIBANT Section 6: The City Council of the Town of Los Altos Hills has received evidence that solicitations are being made within the Town of Los Altos Hills by persons who are conducting themselves in a threatening manner and that said persons have made threats to the health, safety and property of the residents of the Town of Los Altos Hills. Said City Council hereby finds and declares that under these circumstances, the immediate preservation of the public peace, health and safety require adoption of this ordinance as an urgency measure. This ordinance is therefore hereby declared to be an urgency measure, to take effect immediately, and it shall be posted in three (3) public places within the Town of Los Altos Hills. THE FOREGOING ORDINANCE was introduced and adopted at a regular meeting of the City Council of the Town of Los Altos Hills held on February 3, 1969, by the following vote: AYES: Councilmen Aiken, Bowler„ Fowls,:, Hayor Clayton, NOES: None.
