RESOLUTION NO. 790
A RESOLUTION OF THE TOWN OF LOS ALTOS HILLS
IMPOSING A MORATORIUM UPON THE ACCEPTANCE OF
APPLICATIONS FOR THE DIVISION OF LAND.
RESOLVED, by the Council of the Town of Los Altos Hills, Santa
Clara County, California, that
WHEREAS, the Town of Los Altos Hills has become increasingly concerned
about the adverse results of subdivisions approved and developed in recent
years and about the probable adverse results of subdivision plans that have
been recently reviewed;
WHEREAS, the Town is of the opinion that significant aspects of
such subdivisions are not consistent with the policies set forth in the
recently adopted amendments to the Town General Plan;
WHEREAS, in particular, the Town is concerned with the following
problems, being created by subdivisions:
1. Excessive grading which results in accelerated erosion, sediment-
ation and runoff causing downstream flooding, ugly scars on which it is
difficult to reestablish vegetation, alteration of the natural environment
in such a manner as to be inconsistent with the basic aesthetic qualities
of the Town, the creation of cut and fill banks over which driveway accesses
to lots are difficult to achieve;
2. Excessive removal of trees which results in loss of aesthetic
value and modification of micro climates; and
3. The creation of lots which do not afford sites which provide
space suitable -for-the variety of uses normally associated with residential
uses in the Town;
WHEREAS, the Town believes these problems are of such importance to
the residents that it is in the public interest to temporarily halt the
further subdivision of land for a time period sufficient to allow a full
review of the V-Town regulations affecting subdivisions and the preparation
of such modifications of regulations as are deemed appropriate;

WHEREAS, the Town believes that during a moratorium the problems
can be studied andremedies established; for example, remedies might
include the establishment of limits on height of cuts and fills, flexibility
of road grades in hill areas, more- detailed requirements for locating and
preserving trees, further standards for lot design, requirements for bank
protection for erosion control and visual enhancement, etc. ;
WHEREAS, the Town is now undertaking such a study to determine what,
if any, modifications of regulations affecting subdivisions are
warranted;
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, THAT:
Applications for the division of land pursuant to Chapter 4, Title 9
of the Municipal Code will not be accepted by the Town during the period
of the moratorium unless exempted by the following provisions:
1. Transfers of land between adjacent property owners as provided
for in Section 9-402 of the Municipal Code shall be exempted; and
2. Where the Planning Commission finds that a proposed subdivision
does not raise significant questions regarding the subdivision problems
enumerated in this moratorium, the Council , upon recommendation from the
Planning Commission, may exempt said subdivision from the provisions of
this moratorium.
The within Resolution shall be and remain in full force and effect
for four (4) months following the date of its adoption.

I HEREBY CERTIFY that the foregoing resolution was passed and
adopted at a regular meeting of the City Council of the Town of Los Altos
Hills, held on the 3rd day of July, 1974, by the following roll call vote:
AYE: Councilmen Cheney, McReynolds, Miller, Grabowski
NO: Councilman Helgesson
