HomeMy WebLinkAbout761 SIlk 41, RESOLUTION NO. 761 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS URGING DEFEAT OF ASSEMBLY CON- STITUTIONAL AMENDMENT NO. 40 PROPOSING THE REPEAL OF ARTICLE XXXIV RELATING TO PUBLIC HOUSING WHEREAS, Article XXXIV of the California Constitution entitled "Public Housing Project Law" and adopted November 7, 1950 by an initiative measure, provides that no low rent housing project shall be developed, constructed or acquired in any manner by any State public body until a majority of the qualified electors of the City, Town or County in which it isproposed to develop, construct or acquire the project, approve such project by voting in favor thereof by an election held for that purpose; WHEREAS, Assembly Constitutional Amendment No. 40 would propose to the people of the State of California an amendment to the Constitution by repealing in its entirety Article XXXIV, and WHEREAS, the approval of Assembly Constitutional Amendment No. 40 by the voters of the State would result in the elimination of the right of the qualified electors in a city or county to determine whether in fact they desire to have developed, constructed, or acquired a low rent housing project and would vest that decision in persons who are not responsible or accountable of the City or Town, and WHEREAS, the repeal of Article XXXIV would intrude upon the local home rule to be exercised by a city and its electors in an area of activity which could affect only and solely the electors 411 of that city NOW, THEREFORE, .THE CITY COUNCIL. OF THE TOWN OF LOS ALTOS HILLS does hereby go on record as being"in opposition of Assembly Con- stitutional Amendment No. 40 and does hereby urge each State Legislator to vote against Assembly Constitutional Amendment No. 40. BE IT FURTHER. RESOLVED that the City Clerk of the Town of Los Altos Hills is hereby directed_to .transmit .a certified copy of this Resolution forthwith to: the respective State Assemblyman and State Senator for the respective districts from which the Town of Los Altos Hills is situated. . * * * * I HEREBY CERTIFY that the foregoing Resolution was passed and adopted at a regular meeting of the City Council of the Town of Los Altos Hills: held on :the 3rd day of April, 1974. 7ity Cler i -2-
