HomeMy WebLinkAbout719 • • RESOLUTION NO. 719 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS DECLARING THE RESULT OF ITS CANVASS OF THE SPECIAL MUNICIPAL ELECTION HELD ON SEPTEMBER 18, 1973 FOR THE PURPOSE OF FILLING TWO VACANT COUNCIL SEATS. RESOLVED, by the City Council of the Town of Los Altos Hills, California, that WHEREAS, by resolution duly passed and adopted the City called and ordered a Special Municipal Election pursuant to §27518 of the California Elections Code for the purpose of filling of two council- manic vacancies, one for a term expiring at the regular Municipal Election in April 1974, and one for a term expiring at the regular Municipal Election in April 1976; and WHEREAS, notice of said special municipal election was duly published as required by law and by said resolution; and WHEREAS, it appears that said special municipal election was duly held in accordance with the law and said call on the 18th day of September, 1973, and that the polls for said election were kept open during the time required by law, and that said election was held and conducted and the votes thereat received and canvassed and the returns thereof ascertained, determined and declared all as provided in the laws of the State of California; and WHEREAS, the Council of the Town of Los Altos Hills has duly convened at its usual meeting place on the 25th day of September, 1973, being the first Tuesday after the election, and has completed a canvass of returns of such election and; • • WHEREAS, said canvass was duly completed and the results thereof are as hereinafter set forth; NOW,. THEREFORE, IT IS HEREBY RESOLVED by the City Council of the Town of Los Altos Hills that: 1. The City Council finds and hereby ratifies and declares the result of the special municipal election held on September 18, 1973 to be as follows: A. That said special municipal election was held and conducted in the Town of Los Altos Hills, County of Santa Clara, State of California, on Tuesday, September 18, 1973, in the time, form and manner required by law. B. That there were five (5) voting precincts : i. Consolidated Precinct No. 1 (Bullis School) consisting of County Precincts 2389 and 2395; ii. Consolidated Precinct No. 2 (Fremont Hills School) consisting of County Precincts 2382, 2383 and 2387; iii. Consolidated Precinct No. 3 (Town Hall) consisting of County. Precincts 2384 and 2391; iv. Consolidated Precinct No. 4 (Purissina School) consisting of County Precincts 2385 and 2390;. v. Consolidated Precinct No. 5 (American Orthodox Church) consisting of County Precincts 2386, 2388 and 2392. C. That a canvass of the votes cast in said city was held in accordance with the order of the City Council and in accordance with the law. -2- • • D. That the names of the persons voted for and the offices to fill which eachpersonwas voted for, were: i. Member of the City Council for the unexpired term ending April 1974: Robert C. Cheney James L. Mueller ii. Member of the City Council for the unexpired term ending April 1976 : David Bellucci, Sr. Ralph W. Franks Thomas P. McReynolds Wilton F. Minckley E. That there were five (5) consolidated precincts, and the following number of votes was cast for each candidate for each councilmanic vacancy in each precinct: CONSOLIDATED PRECINCT NUMBER 1 2 3 . 4 . 5 Member of City Council (unexpired term ending April 1974) Robert C. That 143 duly registered voters who expected to be absent from their election precinct on the day of the election secured from the City Clerk and 138 duly registered voters returned to the Clerk, in the time required by law, absentee ballots. G. That 138 absent voter ballots have been duly received and canvassed in the time, form and manner as required by law, and the result of the absentee vote, without regard to precincts., is as follows: Member of City Council (unexpired term ending April 1974) Robert C. Minckley 14 Absentee ballots counted 137 Absentee ballots rejected 1 Total absentee ballots 138 H. That there were 13 writein votes. 2. That the above canvass shows: A. That the total number of ballots cast in the city is 1, 878 . -4- • • B. That the total number of votes given in the city to each person, including absentee votes, is: Member of City Council (unexpired term ending April 1974) Robert C. Cheney 1109 James L. Minckley 330 BE IT FURTHER RESOLVED that the City Council does here and now declare that at said Special Municipal Election held on the 18th day of September, 1973, the following persons are elected: Robert C. Cheney - Member of the City Council for the unexpired term ending April 1974. Thomas P. McReynolds - Member of the City Council for the unexpired term ending April 1976. BE IT FURTHER RESOLVED that the City Clerk be and he is hereby instructed to enter this Resolution in full in the minutes of this Council as the statement of the result of said Special Municipal Election, and that. the City Clerk be and he is hereby authorized and directed to perform any and all incidental duties herewith as required by law. -5- 111 BE IT FURTHER RESOLVED that the. City Clerk immediately make out and deliver to each of such persons so elected a certificate of election upon each such person filing with him a campaign statement or declaration as required by Section 11561 of the Elections Code and that thereafter said City Clerk shall also administer to each such person the oath of office prescribed in the State Constitution and each of them shall then be entitled to enter upon the duties of such offices respectively. * * * * I HEREBY CERTIFY that the foregoing Resolution was passed and adopted at an adjourned regular meeting of the City Council of the Town of Los Altos Hills held on the 25th day of September, 1973. ?epu y ty C erk -6-
