M M <br /> WJM&L:PDA;S :zw 7/18.72 12c <br /> RESOLUTION NO. 674 <br /> A RESOLUTION APPOINTING ATTORNEYS <br /> SEWER ASSESSMENT DISTRICT NO. 10 <br /> RESOLVED, by the Council of the Town of Los Altos Hills, <br /> California, that <br /> WHEREAS, this Council has determined to undertake proceedings <br /> pursuant to appropriate assessment and assessment bond acts for the <br /> acquisition and construction of public improvements in said Town; <br /> WHEREAS, the public interest and general welfare will be <br /> served by appointing and employing attorneys for the preparation <br /> and conduct of said proceedings in connection with said acquisition <br /> and construction of improvements; <br /> NOW, THEREFORE, IT IS ORDERED, as follows : <br /> 1. That Robin D. Faisant, Town Attorney, and the law firm of <br /> Wilson, Jones, Morton & Lynch, San Mateo, California, be, and they <br /> are hereby, appointed and employed to do and perform all legal <br /> services required in the conduct of said proceedings, including <br /> the preparation of all papers not required to be prepared by the <br /> Engineer, examining and approving the engineering documents and <br /> advising the Engineer in the preparation of his work, advising all <br /> Town officials on all matters relating thereto when called upon, <br /> and furnishing the legal opinion of Wilson, Jones, Morton & Lynch <br /> on the validity of said proceedings and bonds, and that their com- <br /> pensation be, and it is hereby, fixed at 3% of the project cost, <br /> or $1, 00, whichever is greater, 2% of said compensation to be paid <br /> to Wilson, Jones, Morton & Lynch, and 1% to be paid to Robin D. <br /> Faisant, together with reasonable fees for services in acquiring <br /> easements or in eminent domain or other suits, to be assessed as an <br /> incidental expense of said proceedings . <br /> 2. That the fees provided to be paid herein be paid from said <br /> assessments to be levied and bonds to be issued, and not otherwise. <br /> * * * * * * * * * <br />
