MINUTES OF A REGULAR AEEETING
March 18, 1963
The Regular Meeting of the City Council of the Town of Los Altos Hills
was called to order Monday, March 18, 1963 by Mayor Vim. B. Clayton at
7:55 P. M. at the Town Hall, 26379 Fremont Road, Los Altos Hills , Calif.
ROLL CALL: PRESENT: Councilmen Bowler, Fowle, Henley, Mayor Clayton
ABSENT: Councilman Aiken
MINUTES: March 4, 1963.
ACTION:
Adopt Minutes of March 4, 1963 as submitted.
COMMUNICATIONS:
None.
ANNOUNCEMENTS:
1. League of California Cities Peninsula Division - Notice of Meeting to
be held Thurs. , Mar. 21, 1963 at 7: 30 P. M. at the Los Gatos Lodge.
The Clerk will attend.
COMMITTEE REPORTS:
None.
OLD BUSINESS:
None.
NEW BUSINESS:
1. Public Hearing - Traffic Ordinance.
The City Clerk advised the Council that ten (10) days prior written
notice had been mailed to each of the owners of privately owned and
maintained roads within the Town.
Mayor Clayton declared the Public Hearing open at 7: 58 P. M. and call-
ed for comments from the Floor.
The City Attorney explained the provisions of the Ordinance.
The following parties , residing on private roads, spoke in relation
to traffic control, maintenance , tresspassing, parking, pedestrian
and equestrian traffic, and the rights of the public to use these
private roads :

Questions were answered by the Council, Commissioner Hawley and the
City Attorney,
The following parties commented on traffic regulating to public
roads, indcluding the danger to pedestrians by .speedsters :

The Mayor declared the public hearing closed at 9: 50 P. M.
The Title of Ordinance No. 87 was read by the City Clerk. .
ACTION:
That further reading of Ordinance No. 87 be waived.

2. Smith, Emerson - Request for Extension of Time for Filing Final Map.
ACTION:
That the request for extension of time for filing Final Map for
Emerson Smith (215-62) 7 lots to March 5, 1964, be approved.
MOTION: Fowle ; SECOND: Henley; VOTE: Passed unanimously
3. Acceptance of Improvements in Valle Vista Hills , Tract No. 2093.
Harold Beaver. .
Letter,from the City Engineer, dated March 6, 1963, stated that all
improvements have been completed and inspected, and recommended that
the Council consider acceptance. . .
Councilman Fowlequestioned whether or not acceptance of the improve-
ments would waive the accrued penalty d2use relative to expiration of
the bond.
The City Attorney advised that the acceptance of improvements stops
( further running of the penalties, but that they are still payable to
the Town unless forgiven by the Council.

Resolution No. 231 , accepting improvements in Tract No. 2093, was
presented and read by the City Clerk.
ACTION:
Adopt Resolution No. 231 as read.

VARIANCES:
1. Guasch, Claude F: (125-62) - Request for Reduction of Setback Require-
ment for Residence.
The Clerk stated that approval was recommended by the Planning Com-
mission. He explained the Plan, as shown, was objectionable to one
of the adjoining property owners; that a compromise has been reached.
The Planning Commission recommended approval of reduction of setback
requirement on the southwesterly boundary to twenty feet (20 ' ) and on
the southeasterly boundary, reduction to fifteen feet (15' ) .
ACTION:
That the request for variance of Claude P. Guasch (V-125-62) be
approved as presently proposed and recommended by the Planning
Commission.
MOTION: Henley; SECOND: Fowle; VOTE: Passed unanimously
2; Petrick Richard- D.- (138-63) - Request for Reduction of Setback for
Residence Addition.
The City Clerk explained that the request is for reduction to fifty-
two feet (52 ' ) from the centerline of Burke Road in order that an
addition might be made to the existing house.
Commissioner Hawley commented that Mr. Petrick had presented sketches
of the addition planned and that the Planning Commission was in favor
of granting the variance.
ACTION:
That the request of Richard D. Petrick (138-63) be approved as
submitted.
MOTION: Fowle; SECOND: Henley; VOTE: Passed unanimously
3. Peterson Barbara B. (136-63) - Request for Reduction of Setback Re-
qu1rement for Residence.
The Clerk explained that a house has been constructed thirty feet (30' )
from the southerly lot line , but due to an error in the Record Map of
property conveyed to Mrs. Peterson, the house is actually nineteen

feet six inches (19'6" ) from the northerly boundary of the property
of the J & R Co. He explained that the J & R Co. has objected to
approval of the variance , but that the Planning Commission has re-
commended approval.
ACTION:
That the request of Barbara B. Peterson (136-63) be approved.
MOTION: Henley; SECOND: Bowler;
Mr. M. R. Johnson of the J & R Co. commented, stating his objections,
and subsequently, at the request Of the Clerk, withdrew his objections.
VOTE: Passed unanimously
D-VISIONS OF LAND:
1. Albertsworth, E. A. (245-63) 7 lots. Engr. Charles Coburn.
The Map was withdrawn at the request of the Subdivider.
2. 1:Lg1er, Fred (248-63) 12 lots. Engr. John W. Riley.
The Clerk read the provisions of the Check List and recommendation
for approval from the Planning Commission and all agencies.
The Mayor called attention to the existing bridle path along the
Vogler property and adjoining lands of Ferris and suggested that an
easement be granted in order that the path may not have to be abandon-
ed.
Mr. Vogler stated that he would be agreeable to granting the easement.
Following discussion, relating to drainage within the subdivision, the
decision was to have the Staff take care of the matter, working out
a solution with Mr. Vogler.
Councilman Fowle called attention to the two (2) driveways on Natoma
Roads (Lots 8 and 11) .
The Clerk explained that these driveways cannot be closer than one
hundred feet (100 ' ) to the intersection.
ACTION:
That the Tentative Map of Fred Vogler (248-63) lots be approved
subject to the conditions of the Check List, the City Engineer' s
letter, and acceptance of the in lieu payment for paths if re-
quested by the Subdivider, and grant of an eight foot (8' ) mini-
mum public easement between Black Mountain Road and the Ferris
property by any route acceptable by the City Manager and the
subdivider.

( -P Ereyman, E. A. - Agreement to Grant an Easement for Paths.
Mr. Breyman presented an Agreement to Grant an Easement for Paths in
Tract No, 2980, signed by the owners of Lots No. 2, 4, and 5. He
explained that the Planning Commission recommended acceptance of the
Agreement at its meeting of March 7, 1963
ACTION:
That the Agreement to Grant an Easement for Paths in Tract No.
2980 be accepted.

4. Tentative Map: E. A. Breyman (230-62) 9 lots. Engr, John W. Riley.
The City Clerk stated that the Planning commission recommended ap-
poval on March 7, 1963 and read the amended Check List,
Relative to the condition that Subdivider be allowed to pay in lieu
of construction of twelve thousand feet (1200' ) of paths, Mr. Breyman
requested that he be allowed to pay fifteen hundred dollars (01500.00)
rather than for the 1200' at one dollar and sixty-five cents (161,65)
per lineal foot, stating that he will be constructing over four hun-

That the Tentative Map of E. A. Breyman (230-62) 9 lots be ap-
proved, subject to the recommendation of the Planning Commission.
MOTION: Henley; SECOND: Bowler;
Commissioner Hawley commented on the Planning Commission' s recommend-
ation for the 1200 ' requirement , stating that the total footage of the
public road is 850 ' and 450' to the end of the property.
AMENDED MOTION:
That the Tentative Map of E. A. Breyman (230-62) 9 lots be ap-
proved in accordance with the provisions of the Check List,
with amendment that Mrs. Breyman be permitted to make an in
lieu payment for one thousand feet (1000' ) of paths.
MOTION: Powle;
Previous Motion was withdrawn in favor of the Amended Motion.
SECOND: Bowler; VOTE: Passed unanimously

- Letter from the City Engineer, dated Mar. 18, 1963,
realtive to drain-
age study requested by the Council, was read by the City Clerk.
Mr. Whaley, City Engineer, explained the Plan, showing drainae on the
"'c'eil property, the Laughlin, and the surrounding properties . He
explained that the two lot division will not add additional water of
flow onto the Laughlin property, but that the construction of the
driveway would alter the flow of the water.
The City \ttorney pointed out that if any structure is build that
would create additional waters on the adjoining properties , the prob-
lems would have to be resolved by the property owners. He further
stated that the Final Mapis before the Council and that at this time ,
the Council cannot require anything further of the subdivider •, that
the intract drainage is a private .natter.
ACTION:
That the Final Map of Bruce McNeil, Tract No. 3410 be approved .
MOTION: Fowle ; SECOND : Henley; VOTE: Passed unanimously
WARRANTS:
Bills , in the amount of One Thousand Four Hundred Forty-Two Dollars and
Twenty-Six Cents (01 ,442.26) , were presented by Councilman Fowle.
ACTION:
That the bills be approved as presented; that the Clerk be author-
ized to draw the appropriate warrants.

ABSENT: Aiken
OTHER BUSINESS :
1. Cluster Development - Ordinance.
- The City Attorney reported that he has been requested, by the Plan-
ning Commission, to draft an ordinance providing regulations for
cluster development in the Town. He stated that he has made a study,
and has formed the opinion that this is a matter of planning. He
suggested the Council request Mr . Nestor Barrett to present a plan.
It was the opinion of the Council that cluster development is now
being considered by Mr. Barrett along with his study of the Master
Plan.
Councilman Henley stated that he will be absent from the next meeting.
