B. Clayton at 7 :53 P. M. at the Town Hall, 26379 Fremont Road, Los Altos Hills, California. ROLL CALL: PRESENT: Councilmen Aiken, Bowler, Fowle, Mayor Clayton ABSENT: Councilman Henley MINUTES: March 18, 1963. Corrections : Page 5, Item 3: Breyman E. A. - Agreement to Grant an Easement-for Paths. - Add the following: "Mr. Breyman presented an agreement to Grant Ease- ment signed by the owners of Lots 3, 4, and 5 of Tract No. 2980 and of a five foot strip of land contiguous to the Easterly boundary of said Lot 5, granting easements for pedestrian pathways over the private road situated on Lots 3 and 4; a five foot easement along the southerly boundary of Lot 5; _ - and within the five foot strip of land hereinbefore described. " Page 5, Item 4: Breyman, E. A. - Para 2, line 2: Should read "'of construcion of twelve hundred feet (1200' ) of paths, . " Page 5, Item 4: AMENDED MOTION: line 3: Typograph- ical error: Mrs. Breymanshould read 'Mr. Breyman' . ACTION: That Minutes of March 18, 1963 be adopted as corrected and amended. Section 12 of the Ordinance and the inclusion or exclusion or certain private road in the Ordinance was discussed. The City Attorney explained that if persons residing on certain pn- -vate roadswished to be excluded, such a request may be directed to. the Council. -- Following discussion by the Council. and. comments by Commissioner ' Garbett, representing the Planning Commission, Mayor Clayton announced- that a third Public Hearing will be held: on April 15, 1963 at 8:00 PM. The public hearing was closed at 8:28 P. M, Councilman Powle suggested that the City Manager contact the press: for coverage so that persons onprivate roads will know of the scheduled ltblic Hearing so that they will have sufficient time to ---:file protests. yARIANCES:._. _. <. 1.. Albertswortb. Eete-tea (245-63) 7 lots. Engr. Charles Coburn. Judge J. Atkinson appealed to the Council, on behalf of Dr. Albertsworth, to allow relief from the requirement-Iorunderground utilities in the subdivision on the basis that strict compliance would be a hardship on ( the subdivider and Would not be in thebest interests of the Town. The cost of using small steel poles, as opposed to wooden poles, was discussed. Councilman Aiken commented that he did not feel that the additional poles -3 Albertsworth cont 'd. wouldebe visible from the roadswhich are private •, that prior to the land being annexed to the Town ; Dr: Albertsworth's map was reviewed by the Planning Commission and Council, and he was led to believe that the proposed subdivision would be satisfactory to the Town•, that on this basis, he felt that the Subdivision should bee -approved with a waiver of the provision for underground utilities: ACTION: That the Tentative Map of Albertsworth Estates (245-63) 7 lots be approved, subject to the conditions of the Check List; but waiving the requirement for installation of underground utilities; on site and off site of the subdivision: MOTION: Aiken; SECOND: Bowler;: Councilman Fowle commented that he would like to see the use of steel poles. Councilman Aiken commented that telephone wires have to go underground also. The responsibility, with regards to lead-in wires was discussed, and the Clerk explained that the Building Code reghiresall service entries underground where primary facilities are underground: The Motion was amended as follows: AMENDED MOTION: That the Tentative Map of Albertsworth Estates- (245-63) 7 lots be approved,. subject to the Conditions of the Check List,: but waiving the requirement for installation of underground utilities.. ACTION: That the Tentative Map of Ernest Brittain (251-63) 2 lots be ap- proved, subject t'othe conditions of the Check List, the require- ments as set forth in the City Engineer's letter of March 18, 1963; upon failure to acquire title to Beek triangle of land, that theEngineer be allowed to alter the lot line in order to obtain twenty-four feet (24' ) of access to the public road. MOTION: Fowle; SECOND: Aiken; VOTE: 'Passed unanimously WARRANTS: Bills, in the amount of EIGHT THOUSAND FIVE HUNDRED NINETY-FIVE DOLLARS and Twenty=Five Cents '($8,595.25)', were presented by Councilman Fowle. ACTION: That the bills be approved as submitted; that the Clerk be authorized to draw the appropriate warrants'. Councilman Fewle 'questioned the status of the General Plan. The City Attorney stated that the Planning Consultant, Nestor Barrett, is scheduled to meet with the Planning Commission. • 2. Utilities_Ordinance. Review by the Plannimg Commission.
