M. by Deputy Mayor Albert. T. Henley Monday, April 15, 1963 at the• Pown Hall, 26379 Fremont Rd. , Los Altos Hills, Calif. ROLL CALL: PRESENT: Councilmen Aiken, Bowler, Fowle, Deputy Mayor Henley ABSENT: Mayor Clayton MINUTES: April 1, 1963. ACTION:, Adopt Minutes of April 1 , 1963 as submitted. COMMUNICATIONS: 1. James P. Thurber Jr. , Mayor of Los Altos - Letter, dated April 12, 7963; requested the'town toga on record in favor of the expressway and new hearing on the decision by the Interstate-Commerce Commission concerning the abandonment of the Southern Pacific_'$.: R. right .of way. A sample resolution was enclosed. Deferred to be discussed under Resolutions. ANNOUNCEMENTS: 1. Santa Clara County Boundary Commission - Notice of two proposedAnnex- a3oiis to the 'Citnt Mountain-View, designated as Levin No. 3 and Bryant No.. 2. To be filed. COMMITTEE REPORTS: None. OLD BUSINESS: 1. Traffic Ordinance No. 87 - Continued Public Hearing. Deputy Mayor Henley declared the Public Hearing open at 7:58. P. M. He explained that the reason for a third public hearing was to give in- terested persons a. chance to make e-jections. The Clerk reported that letters have been received, signed by all resi- dents on the following roads, requesting exclusion from Sec. 12 of Ordinance No. 87 (regarding private roads) : Peck Lane, Rhus Ridge n and Wildcrest .Drive. The Council agreed to have a first reading of the Ordinance as amended, ��,,,. with regard to exclusion of certain private roads. Traffic Oxd. Cont 'd. 1. MOTION: Bowler; SECOND: • Fowle; VOTE: Passed unanimously Deputy Mayor Henley declared the public hearing closed at 8:40 P. M. The Clerk read the Title of Ordinance No. 8?. ACTION: That further reading of Ordinance No. 87 be waived. W. - Subdivision Abutting Foothill Expressway Route, Clerk read letter from Mr: McCulloch, dated April 9, -1963. Letter re- • quested',the Council' s approval of subdivision map which the Council previously considered on Oct. 2, 1961 at which time ? the Council sug- gested the map.be submitted-to the County for superimposition of the proposed :Foothill Expressway. In view of the recent ruling of the • •I. -C. C. against abandonment of the Southern Pacific Railroad right of way, Mr. McCulloch requests that the Council consider the Map for ap- preVal without payment of further fees. ACTION: That the Town accept the' resubmission of the -R. -W. McCulloch origi- !nalplan for subdivision and waive payment of second filing fees. MOTION: Fowls; SECOND: Aiken; ' Councilman 'Bowlersuggested that the Map be referred to the Planning ComMission. AMENDMENT: That the 'Map 'be'processed through the regular channels. '-Letter from the Law Offices of Ferguson, Pedder and Andrews, dated April 4, ':1963, was read by the C3erk. Mr. George A. Andrews, Jr. , Counsel for Mr. Couls, outlined the reasons fot the appeal. Deputy Mayor Henley suggested the parties should have time to discuss the matter. ACTION:. That the request of Mr. Philip R. Couls be put over to the next meeting. MOTION: Fowle; SECOND: Aiken; VOTE: Passed unanimously 3. Library Commission - Recommendation for Reappointment. . • ACTION: That the Council recommend the re-appointment of Mr. Hugh Monahan to the Library Commission. ' ' MOTION: Aiken; SECOND: Fowle; The Deputy Mayor asked if there were further nominations. VOTE: Passed unanimously 4. Water Commission - Pricing Policy. Councilman Fowle, the Town's representative on the Santa Clara Co. Water Commission, urged the Council to adapt a resolution relative to pricing. policy. ': Resolution No. 232 was presented and read in its entirety. ACTION: Adopt Resolution.No. 232 as read. Tract No. 3831 be approved. MOTION: Aiken; SECOND: Bowler; VOTE: Passed unanimously RESOLUTIONS: 1. Resolution - Supporting the County of Santa Clara in Appealing the .. .. 1. C. C. ' s Denial of Abandonment of the Southern Pacific Railroad Right of Way in Los Altos. ACTION: That the matter be continued to the next meeting. MOTION: Aiken; SECOND: Fowle; VOTE: Passed unanimously ORDINANCES: 1. Uniform Ordinance for Fallout Shelters. The City Attorney suggested the Council might consider adoption of a uniform ordinance providing for standards for shelters. The Council expressed a desire to study a draft. WARRANTS Bills, in the amount of Two Thousand Nine Hundred Fifty-Nine Dollars and Eighty-Seven Cents ($2,959.87) , were presented by Councilman Fowle. ACTION: Fowle; SECOND: Aiken; ROLL.
