The Council concurred that this matter should be scheduled to ri the end of the meeting for discussion before initiating legal procedure . . OLD BUSINESS : None . n NEW BUSINESS: 1. Oliver Noll, Tract No. 3380 - Engr. McKay & Somps - Requestfor submission of Final Map in Two Parts : Part One , for approval now and Extension of Time to File- Final Map for Part Two. ACTION: That the Council approve the request of Oliver Noll, as stated in his letter of August 9, 1963. MOTION : Bowler; SECOND : Aiken; VOTE: Passed. unanimously. 2. Ravenscrest, Tract No. 3246 - Request for Extension of Time (60 days) to Complete Tract Improvements . ACTION: That upon conditional approval of the Bonding Company, the Council will grant an extension of sixty (60) days ( ) to Ravenscrest Tract No. 3246; in the event the Tract improvements are not finished on time , the bonding penalty will run from the original. date of completion. Petition Request for Variance from Provisions of Ordinance - o. 88 Requirement for Underground Utilities Service in Existing Subdivisions). .. The City Clerk read a letter from John B. Moxon, dated August 5, 1963, and presented a petition dated August 8, 1963 signed by a number of interested general contractors , requesting the City Council to repeal Ordinance No. 88. Messrs. Moxon, Newman, Powell, Vogler and Carmichael presented . their objections. The Council concurred that only one side was represented and the subject needed further. study. Mr. Arthur S. Alter, representing the Planning Commission, was requested to bring this matter ✓� before the Planning Commission under "New Business" . The City Clerk was asked to place this matter on the Agenda for a Study Session at the next Regular Adjourned Meeting on September 3, 1963. -2- NEW BUSINESS (Cont 'd. ) 4. Annexation - Mayfield No. 1 - Resolution No. 241 . i, ) Resolution No. 241 giving notice of proposed annexation to the Town of Los Altos Hills of uninhabited territory described therein and designated "Mayfield No. 1" and giving notice of the time and place for hearing of protests thereto, was presented and read, in its entirety, by. Mr. R. D . Faisant, City Attorney. ACTION: Adopt Resolution No. 241 as read. MOTION: Aiken; SECOND: Bowler ROLL CALL: AYES: Aiken, Bowler, Acting Mayor Fowle NOES: None ABSENT: Henley, Mayor Clayton Mr. Charles Keenan, of Archway, Inc. , asked if there could be some indication from Los Altos Hills to the City of Palo Alto that sewers and water would be welcome in this district. Acting Mayor Fowle stated he would pursue this action. 5. Elena Road MOS Project No. 63-1. --� Mr. Richard I . Whaley, City Engineer, reported that the State of California disapproved the Elena Road MCS Project No. 63-1 because the lowest bid exceeded the 5% allowed over the esti- mated cost . As the Town has thirty (30) days in which to appeal, the Council agreed , without taking any vote , that the City Engineer should continue his negotiations with the State of California. 6,. Longson, C. L. Tract No. 2986 - Acceptance of Improvements . Resolution No. 242, accepting improvements in Tract No. 2986, was presented and read, in its entirety, by the City Clerk. ACTION: Adopt Resolution No. 242 as read. MOTIONS Bowler; SECOND : Aiken. ROLL CALL: AYES: Aiken, Bowler, Acting Mayor Fowle NOES : None ABSENT: Henley, Mayor Clayton 7. Summit Woods Unit No. 2, Tract No. 3340 - Engr. Brainerd Plehn - Request for Approval of Final Map. As this request was not on the Agenda and no official letter received from the City Engineer, it was the opinion of the City Council to postpone the matter to the next regular meeting. However, after an appeal from Hr. N. Guslani and Tproval of -3- NEW BUSINESS (Cont 'd. ) - Summit Woods Unit No. 2, Tract No. 3340. the Final 'Map of Tract No. 3340 by the City Engineer , the 11 Council concurred that this request should be grante . . ACTION: That the Council approve the Final Map of Summit Woods Unit No: 2, Tract No: 3340, subject to the requirements of all Agencies . MOTION: Aiken; SECOND: Bowler; VOTE: Passed unanimously. 8. Notice of Hearing - Masonic Lodge Hall (Royal Hodge Property) The City Clerk presented a Notice of Hearing of the Board of Supervisors , Santa Clara County, on September 10, 1963 , at 10:00 A. M. , to be held in the Board of Supervisors Chambers at the Civic Center, 70 West Rosa Street , San Jose , California, for public hearing on the appeal of the Town of Los Altos Hills from the decision of the County Planning Commission granting a Use Permit for the construction of a Masonic Lodge ,Hall on property located on the southerly side of Prospect Avenue between Stonebrook Drive and Edgecliff Place. It was the opinion of the Council that the Town of Los Altos Hills further its appeal to oppose this construction. Acting Mayor Fowle asked the City Clerk to contact Mr. Nestor Barrett , ( ) Planning Consultant , to attend the public hearing to protect \ the Town' s interest . VARIANCES : 1. PaKe , George E. (V-152-63) - Request for Reduction in Setback Requirement for Garage. ACTION: That the request of George E. Pake (V-152-63) be approved as recommended by the Planning Commission. MOTION: Aiken; SECOND : Bowler; VOTE: Passed unanir.-'>usly. 2. Borovoy, Roger S. (V-153-63) - Request for Reduction in Setback Requirement for Residence. ACTION: That the request of Roger S. Borovoy (V-153-63) be approved as recommended by the Planning L) Commission. MOTION: Liken; SECOND : Bowler; VOTE: Passed unanimously. t I -4- DIVISIONS OF LAND : Final Maps -� (- ) 1 . Mastin and Kingston AC:_=ON: That Final Map of Tract No. 3477, be approved . MOTION: Bowler; SECOND: Aiken; VOTE: Passed unanimously. RESOLUTIONS: 1: Resolution No. 240 - Adopting Budget for expenditure of Funds allocated from the State Highway Fund to Cities. Resolution No; 240 was presented and read, in its entirety, by the City Clerk. There were no objections . ACTION: Adopt Resolution No. 240 as read. MOTDON: Aiken; SECOND: Bowler. Resolution No. 243 - Accepting the imposition of additional highway users taxes and fees pursuant to Chapter 1852, Statutes of 1963. Resolution No. 243 was presented and read, in its entirety, by the City Clerk. There were no objections. ACTION: Adopt Resolution No. 243 as reed. MOTION: Bowler; SECOND: Aiken. Ordinance No. 92 - Prohibiting the moving of buildings over, t } along or across highways , streets and alleys in the Town of Los Altos Hills , providing for variances and enforcement, and prescribing penalties for violation of its provisions. (Amending Ordinance No. 53 - Second .Reading. ) ` J Ordinance No. 92 was presented by the City Clerk. There were no objections. ACTION: That further reading of Ordinance No. 92 be waived . MOTION: Aiken; SECOND : Bowler; VOTE : Passed unanimously ACTION: Adopt Ordinance No. 92 as read. MOTION: Bowler; SECOND: Aiken. ROLL CALL: AYES : Aiken, Bowler, Acting Mayor Fowle NOES : None ABSENT: Henley, Payor Clayton (-) 2. Amendment to Ordinance No. 78 (Discussion continued) . Commissioner Alter thoroughly explained the Amendment and added that this Amendment wouldeliminate a great deal of requests for variances. ACTION: That the proposed modification of Ordinance No. 78, as suggested in the report by Ccrinissioners Alter and Hibner, is favorable and that the Planning Commission be requested to initiate proceedings towardits adoption. MOTION: Aiken; SECOND : Bowler; VOTE: Passed unanimously. WARRANTS: 1. Bill, in the amount of TWO THOUSAND, TWO HUNDRED AND NINETY-TWO DOLLARS and Twenty Cents ($2,292.20) , were presented by Councilman Aiken.
