B. Clayton, at 7: 53 P. M. at the Town Hall, 26379 Fremont Road, Los Altos. Hills, California. ROLL CALL: PRESENT: - . Councilmen Bowler, Fowle , Henley, Mayor Clayton ABSENT: Councilman Aiken MINUTES: September 3, 1963. ACTION: Adopt Minutes of September 3, 1963 as submitted. COMMUNICATIONS: None . ANNOUNCEMENTS: 1. Proposed Annexations to City of Mountain View. The City Clerk announced receipt of legal descriptions of the ) following four proposed annexations to the City of Mountain View: El Camino No. 20, Centre; No. 2, Hospital Drive No. 1, and Orchard No. 2; and recommended they be filed. PUBLIC HEARINGS : 1. Mayfield Annexation No. 1 - Hearing of Protests . Mayor Clayton declared the Public Hearing open. The City Attorney stated no written protests had been filed prior to the meeting. As there were no protests from the audience, Mayor Clayton closed the Public Hearing at 7: 56 P. M. Resolution No. 247, approving the annexation of certain uninhabited land, designated as Mayfield No. 1 , to the Town of Los Altos Hills, was presented and read in its entirety by the City Attorney. Councilman Aiken arrived at 7 : 58 P. M. ACTION: Adopt Resolution No. 247 as read. MOTION: Henley; SECOND : Fowle ROLL CALL: AYES: Aiken, Bowler, Fowle , Henley, Mayor Clayton �.� NOES : None ABSENT : None "BLIC HEARINGS (Cont 'd. ) - Mayfield Annexation No. 1. The City Attorney read the title of Ordinance No. 94, concerning the annexation of certain uninhabited land, designated as Mayfield No. 1, to the Town of Los Altos Hills. ACTION: That further reading of Ordinance No. 94 be waived. MOTION: Henley; SECOND: Bowler BOLT CALL: AYES : Aiken, Bowler, Fowle , Henley, Mayor Clayton NOES: None ABSENT: None )LD BUSINESS: None. [LIT BUSINESS: Beaver, Dr. Harold J. - Appeal of Bond Penalty, Tract No. 2093. Dr. Beaver was not present or represented. The City Clerk read Dr. Beaver' s letter of September 4, 1963, stating the delay in completing the improvements was due to the slowness of the paving. company and weather conditions (improvements are presently com- pleted and accepted) . The City Attorney stated Dr. Beaver has no direct claim to the contractor but only to the Bonding Company. The liability is to us , but Dr. Beaver is at liberty to sue the paving company. This was related to Dr. Beaver, but the City Attorney' s office received no reply. ) ACTION: That Dr. Beaver's appeal of Bond Penalty, Tract No. 2093 , be referred to the Council 's Legal Committee for review. MOTION: Fowle; SECOND: Aiken; VOTE: Passed Unanimously. Page Mill Estates , Tract No. 3306 - Matter of Fence and Entry Gate he City Manager presented the plan submitted with the application for Building Permit showing fence and entry gates, The setbacks were satisfactory as required and the purpose was 'for identifying the property under Sign Ordinance No. 42, and not as an advertising display. Letters were submitted by the City Clerk from Messrs . Garbett , Dawson, Ewing and Jones of the Page Mill Road area, objecting to ahesize of the sign and lettering. Mr. Thomas Gamboa, developer of Page Mill Estates , asked the City Clerk to read aloud each lette7 objecting to the sign, and also for a determination between a billboard and an identifying sign. Councilman Fowle stated if it is larger than a street sign, it )ecomes a billboard. Councilman Aiken also had a similar opinion, U -2- NEW BUSINESS (Cont 'd. )- Page Mill Estates , Tract No. 3306. that if a street sign is sufficient for identifying purposes, ) there is no need for a 5-foot high fence , 72 feet long, with lettering. Messrs. Garbett and Jones were present and verbally expressed their objections. Councilman Fowle asked the City Manager if the plan submitted for the Building Permit contained the lettering on it . The City Manager affirmed it was approved as such. The City Attorney stated there was no bearing on this whether the Town was liable for this approval or not. The Ordinance is definite in explain- ing the use of billboards and that is why the Building Inspector issued the Building Permit in good faith. Section III , of Ordinance 42, exempts certain conditions for the placing of signs , advertising display or identifying the property. Councilman Henley suggested holding the matter over until the Council had seen the fence and entry gates in question. Councilman Fowle stated that in his opinion the sign was definitely advertising and made the following motion. ACTION: That the City Staff be authorized to remove the letters on the panel of the sign on Arastradero Road. MOTION: Fowle ; SECOND : Bowler Mr. Gamboa stated his case by saying he had conformed to the Town' s requests as to underground utilities , grading, etc. , had put in individual sprinkler systems to uphold the status of the neighborhood , and felt that the redwood fence and entry gates were as presentable as possible to conform to the countryside. Also, this sign could not be constructed as advertising, as eight houses had been sold before the sign was even erected. As both sides of the question had been heard and in view of the fact that Mayor Clayton expressed a desire to view the fence and sign, Councilmen Fowle and Bowler withdrew the foregoing Motion and Second, and it was requested of the City Clerk to place this matter on the Agenda for the next Regular Meeting, October 7, 1963. 3. Jones-Thenn Associates - Matter of Cochran Map. Jones-Thenn Associates asked to be withdrawn from the Agenda. VARIANCES: (J1 . Michaelian Construction Co. (V-155-63) - Request for Reduction of Setback Requirement for Garage. -3- VARIANCES (Cont'd.) - Michaelian Construction Co. ' ACTION: • C ) That the request of the Michaelian Construction Co. (V-155-63) for reduction ofsetback k requirement thfor the garage from 85' to 75 ' from cul-de-sac , as recommended by the Planning Commission, be approved. NOTION: Aiken; SECOND : Fowle ; VOTE: Passed unanimously. 2. Moeller, Hans (UP-156-63) - Request for Reduction of Setback Requirement and Use Permit for Secondary Dwelling. ACTION: That the request of Hans Moeller (UP-156-63) for variance and use permit as recommended by the Planning Commission be granted; subject , however, to the condition that the access to the proposed secondary dwelling be from the existing southwesterly driveway on Page Mill Road . MOTION: Bowler; SECOND: Aiken; VOTE: Passed unanimously. DIVISIONS OF LAND: Tentative Maps . 1. Ferris , Wm.' (239-62) 3 lots Engr. J. W. Riley. ( ) Mr. Paul I . Myers , representing Mr. Wm. Ferris , appeared before the Council to appeal from the action of the Planning Commission on August 12, 1963 (disapproval of Revised Tentative Map of Wm. Ferris (239-62) No; 0-137A, 3 lots) , and presented a petition signed by eight surrounding property owners. There were no objections to the proposed subdivision. As new evidence , there was a conditional approval of the County of Santa Clara Health Department , dated September 10, 1963. The Council discussed the matter of increasing the size of acreage for lot sizes of one acre to meet the requirements of the land and in the interest of welfare and safety. The City Attorney was of the opinion that the Council has the authority to go outside the minimum of the Ordinance . ACTION: That the Revised Tentative Map of Wm. Ferris (239-62) , No. C-137A, 3 lots, be approved; subject to the items on the Check List, and providing for the dedication of a path easement along the southerly and westerly lines of the subdivision from the southeasterly corner of Lot 1 to the northwesterly corner of Lot 3 . MOTION: Aiken; SECOND: Bowler VOTE: AYES: Aiken, Bowler, Mayor Clayton NOES: Fowle , Henley ABSENT: None -4- • ORDINANCES: (7)1. Public Hearing - Ordinance No . 93. A Public Hearing will be held October 7, 1963 , the next Regular Meeting of the City Council on Ordinance No . 93, amending Ordinance No. 78, relating to Building Setback Requirements . 2. Public Hearing. - Amendment of the General Plan. A Public Hearing will be held October 7, 1963 , the next Regular Meeting of the City Council , concerning the Amendment of the General Plan. WARRANTS: 1. Bills , in the amount of TWO THOUSAND, THREE HUNDRED 1ND EIGHTY DOLLARS and Ninety-one Cents ($2,380.91) , were presented by Councilman Fowle . ACTION : That the bills be approved as presented; that the City Clerk be authorized to draw the appropriate warrants . MOTION: Fowle ; SECOND: Henley ROLL CALL: AYES : Aiken, Bowler , Fowle, Henley, Mayor Clayton NOES : None ABSENT : None Mr. Russell Paulnock asked the City Council to recommend to the County that a tripper light be installed at O'Keefe Lane and El Monte Road to ease the congestion of Foothill traffic. O'Keefe Lane has -no ether exit from Los Altos Hills except onto El Monte Road. Mayor Clayton requested the City Manager to look into the matter. ADJOURNMENT: MOTION: Henley ; SECOND: Bowler.
