B. Clayton, at 7: 50 P. M. at the Town Hall, 26379 Fremont Road, Los Altos Hills, California. ROLL CALL: PRESENT: Councilmen Bowler, Henley, Mayor Clayton ABSENT: Councilmen Aiken, Fowle MINUTES: September 16, 1963. Corrections : Page 1, Public Hearings : Item 1 , third para. should read : "Resolution No. 247, finding that no majority protest has been made in connection with the annexation of certain uninhabited territory designated as ) 'Mayfield No. 1 ' , was presented and read in its entirety by the City Attorney. " Item 1 , Roll Call should read : " AYES : Bowler, Fowle , Henley, Mayor Clayton NOES : None ABSTAINED: Aiken ABSENT: None " Page 2, New Business, Dr. Harold J. Beaver, first para. , third sentence should read : • "The City Attorney stated the Town has no direct claim to the contractor, but only to the Bonding Company and Dr. Beaver. " Page 1, New Business , Page Mill Estates : Third para. , third sentence should read : "The City Attorney stated there was no bear- ing on this , whether the Town issued the permit or not. " Third para. , fifth sentence , change word "exempts " to "specifies" . �...-i ACTION: Adopt Minutes of September 16, 1963 as corrected . COMMUNICATIONS: flJ 1. County of Santa Clara, Office of the Board of Supervisors - The City Clerk presented a letter dated September. 19, 1963, with attached Resolution denying a Use Permit to the Masonic Lodge for construction of Lodge facilities at 28410 Prospect Road , Los Altos. 2. Santa Clara County Boundary Commission - Notice of proposed annexation to the City of Mountain View designated as Levin No. 4. The City Clerk stated the proposed annexation had no bearing on the Town's limits . ANNOUNCEMENTS: None . COMMITTEE REPORTS: 1. Legal Committee - Dr. Beaver Bond Penalty. This matter was deferred as the Legal Committee had not completed their report . Dr. Beaver was present. PUBLIC HEARINGS : 1. Amendment to General Plan. C.� Mayor Clayton declared the Public Hearing open. It was the opinion of the Council that the Planning Commission' s recommendation of September 10, 1963 should not be acted upon at this time and that Mr. Nestor Barrett , Planning Consultant , should be consulted for an opinion. As there were no comments from the audience, the Mayor declared the Public Hearing closed at 7:58 P. M. 2. Ordinance No. 93 - An Ordinance of the Town of Los Altos Hills amending Ordinance No. 78, the Zoning Ordinance of said Town, by amending the requirements relating to setback building line . Mayor Clayton declared the Public Hearing open. Comments were made by the following persons : Messrs. M. R. Johnson and, E. A. Bneyman, `and Mrs . R. W. Goldsmith. The City Attorney briefly reviewed the proposed Amendment and the City Clerk explained by means of a diagram on the blackboard how the proposed changes in setback requirements differed from present standards. There being no further comments from the Floor, the Mayor closed the Public Hearing at 8:07 P. M. -2- PUBLIC HEARINGS (Cont 'd. ) - Ordinance No. 93 . The City Attorney read the title of Ordinance No. 93 . ACTION: That further reading of Ordinance No. 93 be waived. MOTION: Henley; SECOND: Bowler ROLL CALL: AYES: Bowler, Henley, Mayor Clayton NOES : None ABSENT: Aiken, Fowle Second reading will be held on Monday, October 21 , 1963. OLD BUSINESS: 1. Page Mill Estates - Entry Gates. Mayor Clayton asked the permission of the Councilmen present to defer this matter and place it on the next Agenda in order to have the vote of the full Council. Councilman Henley requested the City Attorney to draft an additional Ordinance in order to prevent a reoccurence of issues of this type relating to lettered entry ways . 0 NEW BUSINESS : 1. Paths - Gardner Bullis School. The City Clerk presented letters from Mrs. Walter C. Barber, Mrs . C . F. Quate and Mr. & Mrs . F. Malcolm Smith (The Smith's letter being signed by four neighbors on DeBell Drive) request- ing completion of unfinished pathways in the vicinity of Miranda and Manuella Avenues. Mrs. Barber and the Smiths were present and expressed their appreciation for the prompt action of the Town in completing the pathways in question; however, Mrs. Barber said there was one remaining problem - a need for a pathway from Robleda Road through to the back of the Gardner Bullis School. The City Manager sketched a pathway showing the Breyman easement and the path easement on the proposed Koblick Subdivision, which would have provided two entries to the back of the Gardner Bullis School. However, the subdivision was never developed and ease- ments never granted. The Council agreed there was a need for this pathway and suggested that Mrs. Barber, who is Chairman of Safety and Pathways , Gardner Bullis School PTA, contact a number of interested parents to t--� approach Mr. Koblick on the matter of obtaining a path easement . The City Manager will assist in any way possible . -3- • NEW BUSINESS (Cont 'd. ) ij 2. Ward, Robert B. - Underground Utilities , Tract No. 3505. The City Manager presented a letter dated September 27, 1963 , from Robert B. Ward, requesting the Council to reconsider the requirement for underground utilities for Tract No. 3505. Comparative cost estimates , pictures and sketches were attached. ACTION: That Robert B. Ward ' s letter of September 27, 1963 and enclosures be referred to the City Manager and City Engineer for study; to suggest a standard on a transformer installation, and present such findings to the Council . MOTION: Bowler; SECOND : Henley; VOTE: Passed unanimously. 3. Resolution No. 248 - Acceptance of Improvements . Resolution No. 248, a Resolution of the City Council of the Town of Los Altos Hills accepting improvements in the following Tracts : No. 3445 - F. Vogler No. 3280 - E. A. Breyman 0 No. 3248 - Beekhuis-MacDonald- The Resolution was presented and read , in its entirety, by the City Attorney. ACTION: Adopt Resolution No. 248 as read. MOTION: Henley; SECOND: Bowler ROLL CALL: AYES: Bowler, Henley, Mayor Clayton NOES : None ABSENT: Aiken, Fowle 4. Tract No. 2376 (Fred W. Trumbull) - Request for Abandonment of Easements . Resolution No. 249, a Resolution of the City Council of the Town of Los Altos Hills , vacating easements and rights-of-way in Tract No. 2376, was presented and read in its entirety by the City Attorney. ACTION: Adopt Resolution No. 249 as read. MOTION: Henley; SECOND: Bowler ROLL CALL: AYES : Bowler, Henley, Mayor Clayton NOES : None ABSENT: Aiken, Fowle. -4- VARIANCES : I-1 1. Corenson, Seymour (V-157-63) - Request for Setback Requirement. ACTION: That the request of Seymour Corenson (V-157-63) for reduction of setback requirement from 75 feet to 70 feet for location of house , as recommended by the Planning Commission, be approved. MOTION : Bowler; SECOND : Henley; VOTE: Passed Unanimously. 2. Garbett , Charles R. (V-158-63) - Reduction in Setback Requirement . ACTION : That the request of Charles R. Garbett (V-158-63) for reduction of setback requirement to erect a plastic canopy between house and garage , as recommended by the Planning Commission, be approved. MOTION: Henley; SECOND : Bowler; VOTE: Passed unanimously. DIVISIONS OF LAND : Tentative Maps ! _ 1. James Hill Subdivision (265-63) 19 lots - Engr. Lutes & associates . \') Mr. Leon Twigg was present , representing Lutes & Associates . The City Manager reviewed the Check List as recommended by the Planning Commission on August 26, 1963 and conditions of approval by the Health Department in a letter dated September 16, 1963. The Council agreed that in view of the Health Department ' s stand, Lot No. 19 could not be considered a building site ; however, if sewers became available , then Lot No. 19 could be approved. ACTION: That the James Hill Subdivision Tentative Map, Tract No. 3609, be approved, subject to the condition that Lot No. 19 be designated "not a building site " in the Clerk's Certificate and in accordance with the Planning Commission's Check List dated August 26 , 1963. MOTION: Bowler; SECOND : Henley; VOTE: Passed unanimously. DIVISIONS OF LAND: Final Maps 1. Albertsworth, Dr. E. F. , Tract No. 3425 - Engr. Charles Coburn. ACTION: That the Final Map of Tract No. 3425 be approved. MOTION: Bowler; SECOND: Henley; VOTE: Passed unanimously. -5- ORDINANCES : (- ) 1. Ordinance No. 94 - Mayfield No. 1 Annexation, Second Reading. The City Attorney read the title of Ordinance No. 94, approving the annexation of certain uninhabited territory designated "Mayfield No. 1" to the Town of Los altos Hills. ACTION: That further reading of Ordinance No. 94 be waived. MOTION: Henley; SECOND: Bowler ROLL CELL: AYES : Bowler, Henley, Mayor Clayton NOES: None ABSENT: Aiken, Fowle ACTION: Adopt Ordinance No. 94 as read. The City Manager read a letter from Mrs. Mary A. DeCristoforo , of 27861 Natoma Road, Los Altos Hills, appealing to the Town for more strict penalties on speeding violations and for the erection of additional stop signs in pertinent hazardous areas , as well as lettering on the pavement . Mrs . Goldsmith and a group of inter- ested parents commented on the need for more strict control of speed violators . The Mayor said he would discuss this traffic matter with the Sheriff personally, as well as with the City Manager and designated Deputy Sheriffs . 2. Underground Utilities - Petition requesting repeal of Ordinance No. 88. The City Clerk read the recommendation of the Planning Commission dated September 23, 1963. Messrs . Moxon and Newman were present to request the modification of Ordinance No. 88. I ' The City Attorney was requested to prepare an appropriate Amendment to Ordinance No. 88. .1 full discussion will be held at the first reading. OTHER BUSINESS (Cont ' d. ) . 11 3. Use of Town Hall. The City Clerk read a portion of the May 20, 1957 Council Minutes referring to a Report on the Use of the Town Hall , and asked the Council to review the action of the 1957 Council in view of recent inquiries as to the availability and fee of the Town Hall Council Room as a public meeting place. The Council concurred that all previous recommendations of the Council as to general use and social groups shall stand , except for the matter of fees. ACTION: That a deposit of $10.00, returnable in whole or part, depending upon the condition of the Hall according to the judgment of the City Manager; and that no rest room service will be available . MOTION: Henley; SECOND: Bowler; VOTE: Passed unanimously. WARRANTS: 1. Bills , in the amount of TEN THOUSAND , EIGHT HUNDRED MID FIFTY-FOUR 0 DOLLARS and Eighteen Cents ($10,854.18) , were presented by Councilman Bowler. ACTION: That the bills be approved as presented; that the City Clerk be authorized to draw the appropriate warrants .
