B. Clayton, at 7: 59 P. M. , at the Town Hall , 26379 Fremont Road, Los Altos Hills , California. ROIL CALL: PRESENT : Councilmen Aiken, Bowler; Fowle , Mayor Clayton ABSENT: Councilman Henley MINUTES: November 4, 1963 . ACTION: Adopt Minutes of November 4, 1963 as submitted . COMMUNICATIONS : 1. Mr. W. F. Foster_24965_Oneonta Drive , Los Altos Hills - Inquiry as to the legality of his present building site and full privileges � of a one acre site , inasmuch as a portion of his lot has been taken by the State for the widening of the road at Foothill College. The matter was referred to the City Attorney. 2. County of Santa Clara, Department of Public Works , San_Jose , Mr. James T. Pott . Assistant Director - Letter dated-November 18, 1963 offering an interim solution with map, showing placement of proposed traffic signs) to control traffic at Foothill College driveway and El Monte Road intersection . Inasmuch as this proposal was not deemed to be in the best interest of the Town, the Council was in agreement that the Mayor meet with Dr. Calvin C. Flint , President of the Foothill College District , to explore other alternatives ; i . e . , the construction of an under- pass . Nessrs. C. Smith and G. G. Cowie commented upon the traffic problem. MSiOUNCEMENT:S : 1. League of California Cities , Peninsula Division - Meeting on Thursday, November 21, 1963 , Palo Alto , 6: 30 F. M. at the Cabana. 1 .2 Santa Clara County, La = -C,w,ree tw a. ' on Commission - Notice of Public Hearing on proposed annexatian,ddesignated as El Monte 63-1 , to the City of Los Altos. The City Clerk stated the proposed annexation had no bearing on the Town' s limits , and recommended it be filed . PLANNING COMMISSION REPORTS: 1. Pedestrian Rights-of-Way - Junirero Serra Freeway. Commissioner Garbett , after attending a meeting of the Division of Highways in regard to Junipero Serra Freeway plans , stated there were no equestrian, pedestrian or bicycle crossings at the interchanges planned by the State Highway Commission. The Mayor explained that the equestrian trails at Robleda, Elena and Magdalena were obtainedduring discussion with the State and are included in the Freeway agreement . The City Attorney explained that due to the fact that no streets would be cut off during the course of construction of the Freeway, that the Town had no bargaining power to request these additional walkways. OLD BUSINESS : 1. Page Mill Estates - Entry Gates. Mr. T. Gamboa, representing Page Mill Development Co. , reiterated that the intent of their sign was not advertising but solely for identification purposes only. In view of the recommendation of the Planning Commission and after a further review of the intent of the sign ordinance , the following action was taken: - ACTION: That the City Staff be instructed to inform the subdivider, Page Mill Development Co. , that the lettering on the brick structure in front of Page Mill Estates is in violation of Ordinance No. 42 and must be removed. MOTION: Fowle ; SECOND : Bowler; VOTE: Passed. unanimously. 2. Robert B. Ward - Appeal of Underground Utility Requirement in Tract No. 3505. As directed by the Council October '7, 1963 , the City Manager reported a transformer installation is best suitedto be above ground, pad mounted , generally 2x3 ' , and properly landscared by the developer. Mr. Robert B. Ward was present and explained the location of the proposed additional 3 poles, of his desire to retain the natural beauty of the land, that there were no objections from surrounding property owners , and of the hardship due to cost per lot for under- ground utilities. ,�-I� It was the opinion. of the Council that it was not in a position to vary from the present ordinance . -2- OLD BUSINESS : Robert B. Ward (Cont 'd. ) ACTION: That action on the request of Robert B. Ward for appeal of Underground Utility Requirements in Tract No. 3505 be tabled. MOTION: Aiken; SECOND : Fowle; VOTE: Passed unanimously. 3. Drainage Easement - Pink Horse Ranch, Tract No. 1684. A letter from the Santa Clara County, Flood Control and Water Conservation District , dated November 6, 1963, assured the Town there would be no material changes, only remedial maintenance work. Resolution No. 250, a Resolution of the City Council of the Town of Los Altos Hills , granting drainage easement to Santa Clara County, Flood Control and Water Conservation District in Tract No. 1684, was presented and read in its entirety by the City Attorney. The City Attorney was instructed to modify the Resolution as follows : "':Whereas there is assurance that the easement will not be concrete lined, and that a copy of Resolution No . 250 be transmitted to the District" . C ) ACTION: Adopt Resolution NO. 250 as read and modified . MOTION: Bowler; SECOND : Fowle ROIL CALL: AYES : Aiken, Bowler, Fowle , Mayor Clayton NOES : None ABSENT : Henley 4. Broadmoor, Inc. - Completion of Improvements . The Mayor reported that the completion of improvements , accord- ing to check list of Town Engineers dated November 18, 1963 , will be begun November 19, 1963 by the developer. VARIANCES : 1. Taaffe, Martin J. , Jr. (V-159-63) - Reduction in Setback Requirements. ACTION: That the request of Martin J. Taaffe , Jr. (V-159-63) for reduction of setback of proposed kitchen addition to 15 ' from side property line, as recommended by the Planning Commission, be approved. MOTION: Aiken; SECOND : Bowler; VOTE: Passed unanimously. -3- • • DIVISIONS OF LAND : Tentative Maps. �. ) 1. . Matadero Hills (263-63) 38 lots .- Engr. George S. Nolte. ACTION: That the Revised Tentative Map, dated October 1963, of Matadero Hills (263-63) be approved , subject to the conditions of the agencies and the Check List recommended by the Planning Commission dated October 28, 1963 ; and, approval of the path plan, with the condition that the path in the proposed easement along Page Mill Road be constructed throughout its length in the subdivision. MOTION: Bowler; SECOND : Aiken; VOTE: Fassed unanimously. 2. Bloch, Francis V. (246-63) - Request for Approval under Sec. 3 :40, Ordinance No. 69. The City Attorney explained that where there is subdivision of property under Section 3 :40, Ordinance No. 69, any parcel so severed must be declared in the deed as "not a building site". When improvements are made , i.e . , road , hydrant , access , under- ground utilities , etc . , only then can there be application for the land to become a building site . ACTION: That the request of Francis V. Bloch (246-63) , for division of property under Section 3 :40 of Ordinance No. 69, be approved. MOTION: Fowle ; SECOND: Aiken; VOTE : Passed unanimously. ORDINANCES: 1. Ordinance No. 95, an Ordinance of the Town of Los Altos Hills amending OTaTHafCe No. 42 of the said Town, by providing for Issuance of Permits for Certain Signs . Second Reading. The City Attorney read Ordinance No. 95 in its entirety. ACTION : Adopt Ordinance No. 95 as read . MOTION: Fowle ; SECOND : Bowler ROLL CALL: AYES: Bowler, Fowle , Mayor Clayton NOES : Aiken ABSENT : Henley 1 2. Ordinance No. 96, an Ordinance of the Town of Los Altos Hills emending Ordinance No. 88 of said Town, by adding thereto a new Section providing for Variances in Certain Cases. The City Attorney read Ordinance No. 96 in its entirety. • _4 ORDINANCES : Ordinance No. 96 (Cant 'd. ) It was explained that this Ordinance will provide the procedure for variance from Ordinance No. 88 on a "per lot" basis . The second reading will beheld on Monday, December 2, 1963. WARRANTS: 1. Bills in the amount ' of TWENTY-ONE THOUSAND, NIffE HUNDRED AND TWENTY- EIGHT DOLLARS and Seventy-four Cents ($21 ,928.74) were presented by Councilman Fowle . ACTION: That the bills be approved as presented ; that the City Clerk be authorized to draw the appropriate warrants. MOTION: Fowle ; SECOND : Aiken ROLL CALL: AYES: Aiken, Bowler, Fowle , Mayor Clayton NOES: None ABSENT: Henley OTHER BUSINESS : //- - 1. San Francisco Symphony - Mrs . M. Roselaar asked that the Mayor 1.,. � declare the week of November 30 - December 7th as "Symphony Week" . ACTION: That the Mayor be authorized to declare the week of November 30 to December 7, 1963 as "Symphony Week" . MOTION: Fowle ; SECOND: Bowler; VOTE: Passed unanimously. 2. Dept. of Public Works, Div_ of Highways , letter dated November 8, ' 1963 - Proposed Irrigation System. Mr. M. R. Johnson advised the Mayor that this matter is on the Agenda for the meeting of November 20, 1963 of the Purissima Hills County Water District . Councilman Fowle will attend.
