Hills was called to order Monday, June 5, 1961 by Mayor John M. Fowle at 7: 50 F. M. at the Town Hall, 26379 W. Fremont, Los Altos Hills. ROLL C:SL: PRESENT: Councilmen Aiken, Clayton, Sherlock, Mayor Fow: ABSENT : Councilman Henley MINUTES : May 15, 1961. Corrections: Page 4, RESOLUTIONS: Item No. 3: Resolution No_156. The following was omitted and should be inserted. "Resolution No. 156, requesting a hearing by the Highway Commission of the State of Calif. relative to amendment of the route of the proposed Junipero Serra Freeway was read in its entirety by the City Attorney. ACTION: Adopt Resolution No. 156 as read. MOTION: Clayton; SECOND: Sherlock; ROLL CALL: AYES: Clayton, Henley, Sherlock; Mayor Fowle NOES: None ABSENT: Henley ACTION: Adopt Minutes of May 15, 1961 as corrected. COMMUNICATIONS: 1. Palo Alto Hills Golf and Country Club - Letter signed by Dr. James V. Betts, President, expressed appreciation for considerati and approval of request for permission to install sewers in Page Mill Road right of way. 2. Elsie A. Taaffe - Petition for :annexation of 10.2 acre parcel df in Page Mill Road area. Deferred to New Business. 3. Mrs. Nathan Koblick - Letter, dated June 5, 1961, requesting a one year extension of tine for filing Final Map of Tract No. 243, Deferred to New Business. COMMITTEE RETORTS: C1. Berm on Moody Road - *:,_ Le Subdivision . Councilman Sherlock reported for the Council's Road Committee, recommending that the berm be back filled, the curb be striped ; diagonally, and the Centcrline of the road be striped. He stated that the cost estimated by the Martin J. Taaffe Co. is $500.00. ACTION: That the work be done and be determined later how to pay for the work. MOTION: Sherlock; SECOND : Aiken; ROLL CALL: AYES: Aiken, Clayton, Sherlock, Mayor Fowle NOES: None ABSENT: Henley Further discussion was deferred until the arrival of the City Engineer. OLD BUSINESS: 1. Public Rearing - Ravensbury Annexation No. 1. The City Attorney reported that the protest of resident repre- senting over fifty-one per cent (51%) of the assessed valuation of the proposed annexation would have to stand; that Mrs. Millar( name cannot be withdrawn. He recommended that the Council take no further action regarding the Ravensbury Annexation. 2. Clark, Don - Tract No. 1583 - Default of Road Improvements. The City Attorney brought to the attention of the Council that Mr. Clark has defaulted in road improvements, required at the tine his subdivision was approved in 1957, and asked if the Council wished hin to nrocede with legal action to have work completed. The natter was referred to the Council's Committee on Legal '_ffairs--Councilmen Henley and Clayton. NEW BUSINESS: 1. Miss May Christal - rrotest to Inclusion in San Antonio Hills No. 2 :annexation to the Town of Los .Altos Hills. Miss Christal stated her protest to being annexed to Los Altos Hills , and was informed by the Mayor that the natter was out of the hands of the Council; that the election would be held on June 6, 1961 to determine whether the area will be annexed to the Town. -2,. .._Feesignatirton of City Treasurer - Mrs. Louise Fortriede. ACTION: That the Councilaccept , with regret, the resignation of Mrs , Louise Fortriede , as Treasurer of the Town of Los Altos Hills, and. that The Mayor be instructed to write a letter of appreciation. MOTION: Clayton; SECOND : Sherlock; VOTE: Passed unaninousl The Mayor asked that Councilmen submit nanes of persons to be considered for City Treasurer. 3. Resignation of Planning Commissioner - Andrew C. Stevens. ACTION: That the Council accept, with regret , the resignation of Mr. Andrew C. Stevens as Planning Commissioner of the Town of Los Altos Hills. MOTION: Clayton; SECOND: Sherlock; VOTE: Passed unanimously Councilmen were asked to submit nanes of persons to be considered for appointment to the Planning Commission. 4. Acceptance of Planting - Fremont Hills Units No. 2 and 4. Letter from the Fremont Hills Development Co. , dated May 26, 1961 referred to a letter dated Mar. 15, 1961, and requested acceptanc, of the planting in Units No. 2 and 4. The fact was mentioned that the planting will have to be main- tained for two (2) s+'nners, and the question arose as to whether the request is for approval of the inprovenents or acception of improvements. The Clerk was instructed to write to the Developers asking that their request be clarified. 5. Acceptance of rink Horse Ranch Sewers. The City Attorney recommended that action be deferred until an agreement has been drawn between between the City of Los Altos and the Town of Los Altos Hills. ACTION: That the matter be tabled and be reactivated by the Mayor,. 6. Podesta & '_ssociates - Request for Endorsement of Proposed F. M. Radio Solon in in the City of Santa Clara. ACTION: That no action be taken. He stated that there is a need for smog control in the Peninsula area. Following comments from the City Attorney, Mr. G. Bullis, Mr. Towle, and Mr. Wm. T. Powell , the following action was taken: :,CTI ON: That Resolution Noe 156 be adopted, supporting AB 1228, and that copies be forwarded to Assemblymen in Sacramento. MOTION: Aiken; SECOND: Clayton; ROLL CALL: AYES: Aiken, Clayton, Sherlock, Mayor Fowle NOES: None ABSENT : Henley 8. Roblick, Nathan - Request for Extension for Filing Final Sub- division Map, It was noted that a previous extension of one year was granted in June, 1959. ACTION: That a thirty (30) day extension be granted for filing Final Subdivision Map, and that a letter of explanation be sent to Mrs. Nathan Roblick. MOTION: Sherlock; SECOND: Clayton; VOTE: Passed unanimous] 9. Taaffe, Mrs. Elsie A. - Request for Annexation of Property to the Town. The City attorney advised that the Map of the proposed snnexatior and a copy of the description be forwarded to the Santa Clara County Boundary Commission. 10. acceptance of Imnrovei_nts in Lauraleen Acres, Tract No. 2393, Unit No. 1. Engr. L. G. Brian. The City Engineer stated that there is additional work to be dont on the shoulders of the road, but that the Subdivider's Enginee: requested that they be allowed to conplete this work when the road is constructed in Unit No. 2. Mr. Longmire stated that he had inspected the improvements, but did visualize any problem or hazard at the tine. The City Clerk was asked to look into the situation relative to the Bern on Josefa and Purissina Avenues. VARIANCES: 1. Bower, Wm. L. (V-75-61) - Request for Reduction of Setback Require vents. Approval was recommended by the Planning Commission. ACTION: That the request of Wm. L. Bower for reduction of setback requirement be approved. MOTION: Clayton; SECOND: Aiken; VOTE: Passed unanimously DIVISIONS OF LAND: Tentative Maps: 1. Claitor. Janes -. Resubcivisi.on of Tract No. 2261. Engr. L. G. Following discussion of procedure to be followed the City Attor- ney presented Resolution No. 157, declaring the council 's intent to vacate certain publ_ c utility easements and setting date for public hearing for consideration thereof. The resolution was read in its entirety. ACTION: Adopt Resolution No. 157 as read. MOTION: Aiken; SECOND: Clayton; ROLL CALL: AYES: liken, Clayton, Sherlock, Mayor Fowle NOES: None ABSENT: Henley -6- Ciaitor cont 'd. ACTION: That action on the Tentative Map of Janes C. Claiter, Tract No. 2261 be postponed until the .adjourned Meeting of the Council on Wed. , July 5, 1961. MOTION: Clayton; SECOND: Sherlock; VOTE: Tossed unanimous 2. Axford, Fred W. (196-61) 2 lots. Engr. J. Riley. Approval was recommended by the fist-mins Commission. Conditions of the Check List were road. The Clerk stated that , the Engineer has also required that the cul do sac be improved. The City Engineer commented that the creation of additional lots will necessitate improvement of the cul de sac due to probable drainage problems. ACTION: That the Tentative Map of Fred W. Axford (196-61) 2 lots be approved subject to the conditions of the Check List and approval of all agencies. Final Mafl: 1, Baron, Mitchell (194-6:H. 2 lots. Engr. J. Riley. .ACTION: That the Final Nap of Mitchell Baron (194-61) 2 lots, Tract No. 2981, be approved. MOTION: Clayton; SECOND: Aiken; VOTE: gassed unanimously in ORDINANCES: 1. Ordinance No. 71 - Canine Control. Title of Ordinance No. 71 was read by the City Attorney, -7- Ord. No. 71 cont 'd, ACTION: That further ror._.i.ng of Ordinance No. 71 be waived. Following discussion, action was deferred pending further study ANNOUNCEMENTS: 1. The Council 's Leeal Committee was asked to meet with the City Engineer to discuss procedure for formation of an assessment district for the improvement of Fernhill Road. New Bus, Cont 'd. Page Mill Road Sowors - Mr. W. D. McCann, Secretary of the Iurissima Hills County Water District , and Mr. Lawrence E. Feirano, of Kennedy Engineers, commented on right of way granted for installation of sewers in the Page Mill Road right of way relative to future water service or other utilities in the Town of Los Altos Hills, WARRANTS: Bills were presented by Councilman Clayton. ACTION: That bills , in the amount of 36,813.18, be approved for payment and that the City Clerk be authorized to draw the appropriate warrants.
