Fowle '&esday, Septem- ber 8, 1959 at 7:47 P. M. at the Town Hall, Los Altos Hills. ROLL CALL: PRESENT: Councilmen Bledsoe, Clayton, Sherlock Mayor Fowle ABSENT: Councilman Henley `arrived 9:30 P. M. j MINUTES: August 17. 1959. ACTION: Adopt minutes of August 1?, 1959 as submitted. COMMUNICATIONS: 1. City of Los Altos - Letter signed by Mayor Atkinson expressing gratitude to the Town of Los Altos Hills for its participation in the Summer Youth Program. OLD BUSINESS: None. NEW BUSINESS: 1. Dr. Harold Beaver - ^equest for Extension of One Year for Filing Final Map for Subdivision (100-58) 22 lots. ACTION: That the one-year extension requested by Dr. Beaver be granted, MOTION: Sherlock; SECOND: Clayton; VOTE: Passed unanimously DIVISION OF LAND: 1. Whitcomb, Gladys A. (149-59) 3 lots . Engr. J. Riley. After discussion of whether paths should be required, the follow- ing action was taken: ACTION: That the tentative :nap of Gledys A. Whitcomb (149-59) 3 lots be approved subject to the approval of all agencies and that standard Town paths be constructed contiguous to the Arast- radero portion of the property. MOTION: Clayton; SECOND: Sherlock; "OTE: Passed unanimously In further discussion of the requirement of paths in the approval 4 of subdivisions, Commissioner Williams , Chairman of the Map Com- mittee of the Planning Commission, stated that the Planning Com- mission does consider paths in the Check List , but had decided against them in the Whitcomb subdivision. 9-10-59 ACTION: That the City Clerk be directed to work with the City En- gineer and review lots that have been approved to determine if paths should be required. MOTION: Clayton; SECOND: Sherlock; VOTE: Passed unanimously NEW BUSINESS: Cont 'd. 2. Los Altos Fire Protection District. The Mayor stated that the City Los Altos is considering withdraw- ing from the Los Altos Fire Protection District due to the recent attempt by the County Board of Supervisors to dissolve the Dis- trict in favor a central district. He further stated that the City of Los Altos has advised the Town of Los Altos Hills to withdraw from the District and has offered to furnish fire pro- tection to the Town. The Mayor stated that Ordinance No. 59 is being presented to set a Special Election in the Town to vote on the withdrawal from the fire district. Comments were heard from the Council, Commissioners 'Williams and Hibner, and the audience. ;uestions were raised relative to the cost of service if contract- ed from Los Altos, the result if the Town remains in the District , the possibility of increased insurance rates if the Town withdraws from the District, and what the Town can expect from the County under a central district. The Mayor explained that , at the present time, the Council does not have all the answers, but prior to the election , data will be made available to residents of the Town. Commissioner Hibner was asked to serve on a committee to study the situation. The Title of Ordinance No. 59 was read by the City Clerk. ACTION: That further reading of Ordinance No. 59 be waived. Freeway - Report by Councilman Clayton. Councilman Clayton stated that the Town has declined to enter in- to an agreement with the State until the landscape plan is what 4101 the Town desires. Relative to the Magdalena interchange, he stated that the County and the City of Los Altos are in favor of havi.ne the interchange, but the Town of Los Altos Hills is opposed to the interchange. ACTION: That the Town oppose the Magdalena interchange, based upon the information received from the Committee and residents in the Town. MOTION: Clayton; SECOND: Sherlock; ROLL CALL: AYES: Bledsoe , Clayton, Sherlock, Mayor Fowle NOES: None ABSENT: Henley 4. Truck Ordinance and Neary vs. Town of Los Altos Hills - Report by Councilman Bledsoe. Councilman Bledsoe commented on the recent decision of the State District Court of Appeal in the case of Neary vs. Town of Los Altos Hills, ruling the Ordinance of the Town prohibiting trucks use of its streets as illegal. He stated that the Town can appeal the case to the Suprene Court before September 18, 1959, and fur- ther stated that in his opinion, due to the judicial aspects, this would be a good case to take to the higher court. The City Attorney, Mr. Robin D. vaisant, commented on the decision rendered by the Court; and agreed with Councilman Bledsoe :that the Town hes good reason t. go further and nppoal the case to the Suprore Court: ACTION: On the advice of our Town Counsel and Councilman Bledsoe , that the Town's Counsel be instructed to file with the Supreme Court the case entitled Neary vs. the Town of Los Altos Hills. MOTION: Clayton; SECOND: Sherlock; ROLL CALL: AYES: Clayton, Sherlock, Mayor Fowle NOES: None ._BSTIINED: Bledsoe ABSENT : Henley 5. Swimming Pools - The Mayor asked that Council give some consider- ation to adoption of an Ordinance making it mandatory for owners of swimming pools to fence their property, and requested that the City Clerk to make investigations of how the situations is handled ` in other cities. br 6. Fremont Hills Schools - Request for Crosswalks and Safety Striping. Letter, dated September 8, 1959 from Mr. George T. Hayes, Pres. -4- of the F. T. A. , requested safety striping for school crossings and the installation of crosswalks leading to the school. The letter requested installation before Monday, September 14, 1959. ACTION: That the City Clerk be instructed to have crosswalks and striping completed as recommended in Mr. Hayes' letter by Monday, September 14, 1959. MOTION: Clayton; SECOND : Sherlock; VOTE: Passed unanimously Councilman Henley arrived (9:30 P.M. ). 7. Sewer Study - The Mayor read letters from Mr. Charles R. Garbett and Miss Margaret Stebbins, both stating objections to the con- clusions of the Sewer Committee . The Mayor stated that he would answer the letters. 8. M. L. Baker - Letter was read from Mr. Baker complimenting the town on the preparation of the Budget. RESOLUTIONS: 1. Resolution No. 100. 9dopting and approving Memorandum of tgree- ment for Expenditure of Funds Allocated Under Section 2107.5 of the Streets and Highways Code. ACTION: That Resolution No. 100 be adopted as read by the City Clerk? MOTION: Clayton; SECOND: Henley; ROLL CALL: AYES: Bledsoe, Clayton, Henley, Sherlock, Mayor Jowle NOES: None ABSENT: None WARRANTS: Bill, in the amount of :1'19,975.84, were presented by Councilman Clayton. ACTION: That the bills be approved for payment, andthat the City Clerk be authorized to draw the appropriate warrants. (V-46-59) - Request for Reduction of Setback Require- ments to Ten Peet for Garage. ACTION: That the variance of S. W. Wobber (V-46-59) for reduction of setback requirements to ten feet (10' ) for garage.
