TOWN OF LOS ALTOS HILLS
MINUTES OF A REGULIR ADJOURNED MEETING
Noverber 23, 1959
The Regular '.djourned Meeting of the City Council of the Town of Los
Altos Hills was called to order by Mayor John M. Fowle at 7:53 P. M.
Monday, Novenber ?3, 1959 at the Town Hall, 26379 West Fremont Ave. ,
Los Altos Hills.
ROLL CALL: PRESENT: Councilmen Bledsoe, Clayton, Henley, Sherlock,
Mayor Fowle
ABSENT: None
APPROVAL OF MINUTES and COMMUNICATIONS were dispensed with.
COMMITTEE REPORTS:
1. Grant-St. Joseph No. 4 Annexation to the City of Los Altos.
Mayor Fowle announced that reports would be given as follows: By
Conrissioner Mellquist, Chairman of Committee appointed to study
the possibilities of annexing sone unincorporated lands southerly
of the Town, the City Attorney, on annexation procedure, and Com-
nissioner Williams, Chairmen of the Planning Commission, on action
taken at the Planning Conrission's meeting of Noverber 21st.
The Mayor stated that the Master Plan had been adopted by the
Planning Connission, and further stated that the City of Los Altos
has started annexation proceedings to annex lands southerly of the
Town which are included in the general planning outlined in the
General Plan. As a counter cove, the Conrittee has studied the
possibility of possible annexation of unincorporated lands in this
area.
Comrissionor Mellquist reported for the Cornittee. Other menbers
are Councilman Henley, Mr. Gardner Bullis, and Mr. Francis Duveneek.
Corrissioner Mellquist stated that in exploration of this problem,
the Cornittee kept in Hind the reasons for the Town's incorporation
and that no one on the edge of the Town was included who had red
quested exclusion.
The Connittee recorrended to the City Council that the Town initi-
ate, 1- a771.9tely, annexation proceedings in a southerly direction
to round out the boundaries, generally taking the boundaries to
the proposed Junipero Serra Freeway route, Permanente Creek, lands
of the rerranente Cenent Co. , the Palo :ato city limits, and the
lands of the proposed County Park on the Duvcneck land. =lith this
report , the Connittee submitted a nap showing precise knits of
the annexation proposal which Corrissioner Mellquist explained.
Corrissioner Mellquist stated that the Town could effect the an-
nexation in one of two ways : .(1) uninhabited lands procedure which
iso be effected by inclusion of less than twelve registered voters and
more than one-half of the assessed valuation of land and improve-
rents in favor of annexation, (2) Under inhabited territories pro-
cedure, sn election would be required, with a najority vote and 50%
of the land value, only, in favor.

The Committee recermended that the inhabited procedure of annexa-
tion be followed.
Mr. Robin D. Faisant , City attorney, submitted a report outlining
annexation procedures which may be followed in accordance with the
Government Code of the State of Californa. He explained that there
are sore methods of shortcutting the procedure which would cut
down the tine required, but that he would recommend the procedure
as he has outlined.
Corrissionor Williars reported that Commissioner Mellquist had
given the Committee 's report to the Flanning Commission at its
meeting on Noverber 21st. At the meeting a resolution was proposed
and adopted, urging the Council to proceed with immediate annexa-
tion proceedings. Commissioner Williams read Resolution No. 3-59
of the Flanning Co[rlssion.
Mayor 'Towle declared the meeting open for questions and comments
from the audience.
The following persons, presently in the unincorporated area, ex-
pressed a desire to be included in the proposed annexation to the
Town: Dr. Frank Derry, 23260 Eastbrook Ave , Mr. S. H. Williston,
Loyola Dr. , Mr. Joseph R. ',Jolie, 11090 Mora Dr. , Mr. John Hayes,
11750 rlateau ave. , Mrs. Elver Filippini, 23170 Eastbrook Dr. ,
Mrs. A. Gormely, 23211 Eastbrook Ave. , Mrs. J. E. Sherman,
23170 Eastbrook Ave. , Mr. Greer W. Sugden, 22548 Ravensbury -Ave. ,
and Mr. Eldon J. Gilbert, 10695 Eloise Circle. It was noted that
Mr. John Hays ' propertyis net included in the area proposed for
annexation.
Mr. 0. E. Huttlinger of Los 'ltos Hills expressed concurrence with
with the Committee 's recommendation.
Mr. Frank Duveneck explained that he has willed a portion of his
a portion of his land to Santa Clara County for a future park. He
stated that a ridge divides his lend, and that a portion would be
logically in the limits of Los Altos Hills, and that at some future
date ; he nay be sympathetic to being a part of the Town.
The question was, asked Mr. Faisant relative to what chance Los
Altos Hills ' proposed annexation has if the rap submitted by Los
Altos is a valid one. Mr. Faisant answered that the Town is act-
ing on the aawrption that the nap is invalid, but that if it is
found to be valid, the Town is wasting its tine.
Mr. Colin Peters, Attorney, stated that there are several interest-
ed parties in the proposed Los 1tos annexation who are going to
contest the annexation.
Councilman Sherlock mentioned that all of the 'conments heard in
favor of the annexation were from the Eastbrook area, and question-
ed whether or not people in other areas were favorable to the pro-
posed annexation.
Several of those persons who had spoken in favor of the proposed
annexation, stated that neighbors in their areas were also in
favor of annextion to Los Altos Hills rather than to Los 11tos.

Relative the next step t ; be taknn, the City 'Attorney stated that
the Flanning Commission should be advised to subrit the legal
4 description of the proposed annexation nap.
ACTION:
That the recommendation expressed in Resolution No. 3-59
of the Flaming Corrission be adopted with thanks; that
the question of inhabited annexation be referred to the
Planning Commission for a metes and bounds or other legal-
ly acceptable description and further consideration of
questions of planning aspects, and that the Corsission be
asked to forward a recorrendation to the Council for the
meeting of November 30, 1959.

That the Council adopt the Connittee 's report.

VOTE: Passed unanimously
Mr. Sugden suggested that there be sore way in which people who
wish to be annexed to the Town nay express such a dosiro.
The City .Attorney suggested that an informal petition be on file
at the Town Hall so interested persons nay sign.
There were no objections stated to the proposed annexation.
Mayor Fowl° c.nneunced that the Town will need assistance in getting
votes, and solicited assistance from interested parties.
A ten minute recess was declared.
NEW BUSINESS :
1. General Plan - Setting Date of Public Hearing.
The General Plan was submitted to the Council by the Planning
Commission along with Resolution No. 2-59, recommending adoption.
ACTION:
Tint a public hearing on the General Plan of the Town of Los
Altos Hills be held December 7, 1959 at 7:45 P. M. at the
L. Town Hall and that the City Clerk be directed to publish
appropriate notice thereof according to law.
