The Regular Meeting of the Planning Commission of the Town of Los ,'_Itos
Hills was called to order b; Vice -Chairman Melvin L. Hawley Thursday, Feb.
ruary 7, 1963 at 7:45 F. M, at the Tonin Ball, 26379 Fremont Rd., Los Altos
Hills, California.

COMI"LTNIC'.TIONS:
1. Gordon E. Bowler - Copy of letter from the Chairman of the Planning
Commission to the Santa Clara County Planning Commission, opposing the
change in zoning requested by Stonebridge ,"ssociates.
Vice -Chairman Hawley reported that the Council had adopted a Resolution
opposing the charge requested, and urged Commissioner to attendthe
meeting of the S. C. Co. Planning Comnission on "'eb. 20T= at which the
request for rezoning will be heard.
2. Citttorne-- Memo stated that the draft for amending the Subdivision
rdinance relative to 'Cluster Development' will be submitted at his
earliest convenience.
3, County Planning Commission and Board of Zoning :Adjustment - Summary of
actions £or the meeting or January 16, 1963.

COMMITTEE REPORTS
1. Stud essian - Vice -Chairman Hawley reported on the Study Session hell
_7e ruary , 1963 at which 'cluster Development' and. 'Off Site Cost On
Far Lot Basis' was discussed.
The suggestion was made that data be collected and filed in the Fl e-
ning Co;�mission rile under the following subjects: 'Cluster 1;evelop-
-ent' and 'Off Site Cost on Per Lot Basis'

1. GGuasch, Claude E, (125-62) - Request for Reduction of Setback Require-
ment for Residence.
Vice -Chairman Hawley stated that the request is for 10' reduction on

easterly side and 12' reduction on the southwesterly side of tle prop-
erty. Review of the app?}cation was Wade by the -Vice Chairman, and it
was noted that, of the adjoining property owners, there was only ane
signature approving the variance. Signature was not received £ror
_ 1dilson and letter of objection was received from '.rs. Stanley
Bishop.
Mr. _d, Guslani, Counsel for Mrs. Bishop, and i'!rs. Bishop were present.
Mr. Guslani explained that the Bishops objected to the variance because
h,,.ving the house 10' from the property line will create noise end, would
be -o nuisance; that granting a variance of 20' would be contrary to
the planning of the Town, and they felt the house could be constructed
within the setback requirement. Further, that Mr. a Mrs. Bishop felt
this would create a hardship on them. Mrs. Bishop pointed out that
it is their intention to have their constructed 30' from the property
line,
Mrs. Guasch explained that the house will be a split level h:>use and
that due to the clevztions, only the top of the house could. be .seen,
by the Bishops. Relative to the suggestion that the house being -Laced
elsewhere on the lot, Mrs. Guasch axplained that this would neeessit�.te
fill due to the steepness of the lot.
Compissioner 1,1tor pointedout that the map did not show the concurs
^.s they exist.
Vice -Chairman Hawley explained that it is not the policy to approve a
variance over the objections of an adjoining neighbor, and suggested
that rerhans the applicants might discuss the possiblity of a compro-
mise rather than have the variance disapproved.
The _pplicants, 1?r. Guslani and Mrs. Bishop retired to the Office to--
discuss
o:discuss the matter, to be heard later during the meeting.
Peterson, Barbara (136-63) - Request for Reduction of Setback Require-
ment for Residence.
1polication was read by Vice -Chairman Hawley. He pointed out that the
request is for reduction of 10'6" from the southeasterly property line;
that only one adjoining property owner had signed; that two property
owners could not be reached (Psr. Stein and Mr. Malmquist); and that
z letter objecting to the approval of the variance has been received
from Mr. IT. R. Johnson, adjacent owner, with common boundary line £ray^
which the variance is reeuested.
Mr. Pialmquist was present and stated that he has no objection to the
variance.
Mr. Johnson was present and stated that the northeast prop-=rty line is
is only ninety feet (90') instead of one hundred feet (100') as shown
on the plan, and tnat the house has been constructed nineteen feet six
inchae (19'6") from the property line. He re -,d dotes of a number of
deed, transferring the propert;, in which the line in dispute was ninety
feet (90').
Mrs. Peterson stated that her deed, dated :,pril, 1961, gives
