Hawley Monday, Altos H , 1 July ls8, 163 nt at 7:55 P. M. at the Town Hall, 26379 , ROLL CALL: PRESENT: Commissioners Alter, Garbett, Hibner, Prentice, Chairman Hawley ABSENT: Commissioner Mellquist MINUTES: June 24, 1963. ACTION: Adopt Minutes of June 24, 1963 as submitted. MOTION: Prentice; SECOND: Garbett; VOTE: Passed unanimously COMMUNICATIONS: None. ANNOUNCEMENTS: None. COMMITTEE REPORTS: 1. Master Path Plan. Commissioner Garbett reported thO Committee plans to work with a Citi- zens' Committee to determine the best places to construct paths in each Path Zone. He stated that a program of this kind will take some time, and that a report willPKiven later. The suggestion was made that the Path Committee work with the Palo Alto Regional Planning Group in an effort to have coordinated path plan for equestrian and bicycle.traffic as well as for equestrian traffic. 2. Ordinance No. 78 - Setbacks. Commissioner Hibner destributed copies of the report, dated July 8, 1963. He explained and discussed the following recommendation; "The setback building line for any structure shall be 30 feet from the property line. Where the property line abuts or is in the vicinity of a road, public or private, the setback line shall be 40 feet back from the existin street ri ht of wa or the future or planned dedication line or road right or way. Following comments by Commissioners, Chairman Hawley suggested that the recommended revision be studied and that it be considered at the next meeting of the Planning Commission. 3. Underground Utilities. 4 Commissioner Prentice stated that the report will be submitted at the meeting of August 12n. Commissioner Garbett reported that an on site inspection was made; that on the basis that there is no adequate provision for off-street parking, cnd no access to the garage, he would not be in favor of granting the variance. Commissioner Hibner commented that the pad for the house is not ade- quate, that in order to be used, excessive grading would be required. He felt that the houseis not designed for the lot. Mr. Schwab was not present. Mr. R. Clark Smith, representing the neighbors, reported that he had circulated the petition for signatures, approving the variance. He stated that he and his neighbors would prefer that the house be placed on the existing pad which will require a 15' variance. He stated that if the house is moved further down the slope, he and his neighbors would k have a view of the underside of the house because it would have to be cantilevered. He said it is doubtful that the subsequent purchaser of the house would maintain landscaping on the slope which would shelter the view of the house. Mr. Smith commented that Mr. Schwab was not concerned with the variance one way or the other, but that the neighbors would like the variance approved. He requested approval of the variance. Chairman Hawley commented that the neighbors had indicated approval by signatures on the application; that their wishes should be consider- ed. That the request of Laurence Schwab (V-160-63) for reduction of setback requirement for location of house be approved. MOTION: Garbett; SECOND: Prentice; VOTE: LYES: Garbett;,. Prentice, Chairman Hawley NOES: Alter, Hibner ABSENT: Mellquist DIVISIONS OF LY:ND: 1. Ferris, Wm. J._(239-62) 3 lots. Engr. John W. Riley. Chairman Hawley explained that the Tentative Map of Wm, J. Ferris was returned for recommendation with regard to a conditional exception re- lativo to lot sizes.- fAr He declared the public hearing open for comments from the Floor. There being none, the hearing was closed. Commissioner Prentice commented that the property is within the Town Perros cont'd. i8 ;: A14;4hscussion, relative to development of the property, and control Iof slope cutting, the following recommendation was made: RECOMMENDATION: That the Tentative Map of Wm. proved as submitted. MOTION: Alter; SECOND: Garbett; J. Ferris (239-62) 3 lots be ap- VOTE: Passed unanimously 2. Olive Tree Hills Unit No. 2 (259-63) 15 lots. Engr. John G. R. Clegg. Developers presented Map showing proposed division of a 32 -acre parcel, and another map showing proposed access along Lot 16 of the Olive Tree Hills Tract No. 2958 which is within the limits of Los Altos Hills and contiguous to the proposed Olive Tree Hills Unit 2 subdivision. Mr. Dunn explained the proposed access to the subdivision, a right-of-way of 40' with a paved section of 24'. During discussion, Commissioners were of the opinion that if the Fire Chief approves of the road pattern, they would consider a Cluster type development, showing placement of houses and a minimum of roadways. 3. Tracey, Walter (260-63) 2 lots. Engr. John W. Riley. Mr. Riley explained that the map was previously approved under the name of Milton; that the Final Map was never filed. Conditions of approval of the Milton Map were reviewed, and the Check List was completed, outlining conditions of approval of the Tracey Map. RECOMMENDATION: That the Tentative Map of Walter Tracey (260-63) 2 lots be ap- proved, subject to the conditions of the Check List. MOTION: Alter; SECOND: Prentice; VOTE: Passed unanimously 4. Cunneen, Wallace (Resubd. of Lots 1, 5 & 6, Tract No. 2986. Condition- al Exception (Final Map Procedure). Engr. John W. Eiley. Chairman Hawley declared the public hearing open for discussion of a conditional exception with regard to filing a record of survey in lieu of a Final Subdivision Map. RECOMMENDATION: That the conditional exception of Wallace Cunneen be approved. MOTION: Garbett; SECOND: Prentice; VOTE: Passed unanimously The Clerk was asked to send a Memo to the City Attorney relative to a- mending the Subdivision Ordinance to allow filing a Record of Survey for a change in lot lines.
