Fowle, 11onday, November 3rd, 1958 at 7:52 P. M. at the Town Hall, 26379 Hest .Fremont Avenue, Los Altos Hills. ACTION; Adopt minutes of October 200, 1958 as corrected. COMMUNICATIONS: 1. Count of Santa Clara Office of Civil ?Defense - Letter, dated October 31, 1958, requested the Town's participation in the Veter- ans' Day Parade to be held November 9i in San Jose. Filed. 2. County of Santa Clara Planning De artment - Letter, dated October 21st, 1959 and signed by Karl J. Belser,—Director of Planning, was an inquiry as to whether or not Los Altos Hills desires to part- icipate in the block statistic program being prepared by the United States Bureau of the Census. It was the opinion of the Council that the Town does not wish to participate in the program. 3. County Boundary Commission - Notice of annexation of property de- signated as onteo. to the City of Los Altos. Filed. OLD BUSINESS: The Mayor announced that Items tl and Y2 on the Agenda, both pertaining to Pink Horse Ranch Unit #1, have been postponed until the next meeting of the Council at the request of the Committee Chairman. 3. Traffic Signs - Mannuella - Report by Road Commissioner. ,. The Road Commission recommended that warning "S" curve sign with "Slow to 20 Miles" sign be installed on Manuella Avenue at Estacada Way for north bound traffic, and on Manuella a "Slow to 20 Miles" sign be installed with the existing "S" curve sign for south bound traffic on Manuella north of 1'stacada Way. 11-6-58 F -2- Traffic Cont'd. The City Road Commissioner was instructed to have the signs installe( 4. Faul lus , Floyd_ (V-35-58) - approval of a Building Site. Letter, dated October 17t, 1958, was read from Mr. Dawson, owner of the property stating that at the time the property is subdivided, he expects to comply with ordinances governing subdivisions. Councilman Clayton, reporting for the Committee appointed by the Mayor to study this situation, recommended that the Town issue a building permit, subject to an agreement between the Town and Mr. Dawson, relative thein and off -tract improvements (entrance onto Page Mill Road and re -alignment of the right-of-way of Page Mill). Mr. Paullus stated that °'r. Dawson is having a new road constructed on the Schroll property, and asked what steps would. have to be taken to have the road accepted by the Town. The Mayor answered that the road must meet the Town's Road Standard specifications, be inspected by the Town, and application be made fo; acceptance. Three questions were asked the City Attorney by the Mayor. (1) If Mr. Dawson dedicated sixty (60) foot right-of-way, it is possible for him to take it back? The Attorney answered that the Town would retain control of the property. (2) Does the Town have to accept the dedication? The Attorney answered that the Town does not have to accept the dedication. (3) Can the Town prevent the actual tie-in with Page Mill Road? Under the existing ordinance, the Attorney said the tie-in can be prevented. ACTION: That the variance of Floyd Paullus (V-35-58) be approved, sub- ject to execution of a contract mutually agreeable between Mr. Dawson and the City, pertaining to the on-site improve- ments, specifically Page Mill Road. MOTION: Clayton; SECOND: Sherlock; The suggestion was made by the City Attorney that the Town should work out an agreement regarding the re-alig;t:Akt of Fage Pill Road, but leave any specific improvements until the time cne road is to be constructed. Councilman Clayton stated that there is no bond involved, and that it is better to have a signed agreement. VOTE: Passed unanimously ANEW BUSINESS: None. DIVISIONS OF LAND: 1. Baron, Mitchell (122-58) 3 lots. Sngr. Brian. Mr. John Riley, Engineer, represented Mr. Baron, who was not present -3 - Baron cont'd. low The City Clerk read the reco?M�-,endation of the Planning Conrission, dated October 1811 1958, approving the subdivision by a four to one vote. He stated that all agency approvals had been received ex- cept that of the City engineer who disapproved the subdivision be- cause of two (2) substandard lots. The City Clerk further pointed out that, in the ast, approval has been granted for subdivisions less than four (43 lots having one or more substandard lots, an exception provided for in the Subdivision Ordinance. He cited two exar-ples. The Mayor mentioned that approval of the adjacent subdivision (Teilhet) had been denied, causing the owner to lose one lot (w.ak- ing four instead five lots) due to dedication of the right-of-way creating substandard lots. The Teilhet subdivision was approved as four -lot division, having five (5) plus acres gross. Following a discussion relative to future road for the area, the Mayor suggested that the rap be referred back to the Planning Cormission for further study along the lines of future roads plans for access to adjacent properties. ACTION: That the Mitchell Baron tentative rap (122-58) 3 lots be re- ferred back to the Planning Commission for re -consideration, with particular emphasis on aster plan and access to other neighborhood lots. MOTION: Treat; SECOND: Sherlock; VOTE: Passed unanimously 2. Willis, Richard (124-58) 3 lots. Engr. Brian. The City Clerk read the Planning Corrission's recornendation of October 18b, 1958, approving the subdivion by a four to one vote. He reported that the Fire District, in letter dated October 14, 1958, had approved the tentative map. In letter dated October 22, 1958, the Santa Clara County Health Department stated conditions of approval for this subdivision. This letter was read by the City Clerk. The letter from the City engineer, dated October 28, 1958, was read etating conditions of approval relative to location of driveway and fencing along both sides of channel easements. The Mayor commented on the letter from Nestor Barrett, Planning Consultant, and read the following sections:"It is almost univer- sal in adr!inistering zoning natters to follow the rule that where land is being utilized for a public easement for a purpose which makes it completely unuseable by the person who will occupy the building site, that such land cannot be included in calculating the area of a lot." Another portion of the letter states," if the Town is to follow what is general practice in administering zoning it will not permit this channel easement to be included in the calculated area." The Mayor further stated that variances would have to be granted for the substandard lots. Mr. Willis stated that his -:ain reason for requesting this sub- division is in order to have the corner at ':Jest Fremont and St. Francis landoaped and maintained. He further stated that he has -4 - Willis cont'do secured the nares of residents in the area who approve of this subdivision and have signed a statement of approval. A letter, dated October 200, 1958 from Frenont Hills Development Company and signed by Mr. Williar_, D. Coldiron, was read which pointed out the fact that the Frer_:ont Hills Development Co. had desired this same division and that approval had, been denied be- cause of the policy of non-inclusion of public easement as a part of the net acreage. He stated in his letter that it was not a protest, but nerely pointed out an inconsistency. ACTION: That the tentative nap of Richard Willis (124-58) 3 lots be returned to the Planning Commission to explain and clarify what change in the situation has occured to warrant a revision of the lot design in this area of Fremont Hills Unit #1, when the revision is almost a replica of the original division that was rejected. MOTION: Sherlock; SECOND: Treat; VOTE: Passed unanimously DIVISIONS OF LAND: Final Maps. 1. Fremont Hills Development Co. (126-58) 2. lots. Engr. Brian. ACTION: That the Council approve the Final Map of Fremont Hills De- velopnent Company (126-58) 2 lots, re -subdivision of Lots �;1 and #2, Block J, Unit #2. MOTION: Sherlock; SECOr3D: Clayton; VOTE: Passed unanimously The City Clerk explained Ite^:*2 (.Andreas, Lee) was cancelled. RESOLUTIONS: None ORDINANCES: 1. Ordinance #42 -:.dating Signs and Billboards. Second Reading. The Title of the Ordinance was read in its entirety. ACTION: That further reading of Ordinance #+2 be waived. ACTION: That the City Council approve for payment bills in the anount of 15,826.47, and that the City Clerk be instructed to draw appropriate warrants. ZoninE Ordinance - The Council will hold a Study Session at the Town Hall on Iu sday, Noverber 11%, 1958 at 7:30 P. M. 2. Conference with Flood Control District- The report made by the May- or at the Council Councilmeeting of -October 20tb was consented on, and the question was raised relative to how the taxes which are paid to the Santa Clara County Flood Control District are boiag used, and whether or not the money is utilized for the Town. The City Clerk was instructed to contact the Flood Control District and secure this information. 3. L99 tY@'Hjj.1s- The Attorney announced that he had received Mr. Keary sem'brief, and that hc had applied for thirty days extension of tine for the Town's reply regarding Neary vs. Town of Los Altos Hills. 4. League of California Cities - The City attorney reported that he had attended e conference held in Los .Angeles, and suggested that the Town be represented at the conference in 1959 which will be held in San Francisco. 5. Flood Damage Allocation - The City Clerk reported that the State had approved the own s Flood Damage allocation; that the Town can use its contractor, Mr. Ta.affe, to do the road and drainage repairs.
