Bledsoe Monday, June 300, 1958 at 7:58 P. M. at the Town Hall, 26379 West Fre- mont Avenue, Los Altos Hills. ROLE CALL: IREs")ENT: Councilman Clayton, Treat, Sherlock, Deputy Mayor Bledsoe, ABSENT: Mayor Fowle MINUTES: June 23rd..1958. Corrections: Page 1, Item #1, .ANNOUNCEMENTS: Magor Thomas Pt. Ryan's name wag--migpelled, Page 3, 2nd line of ACTION: Should read, "for purpose of giving 'opportunity' to the etc." Page 4, Item #5, 2nd line: Should read, "a situation caused 'by' excessive grading." ACTION: Adopt minutes of June 23rd, 1958 as corrected. Adoption of minutes of June 270, 1958 was postponed until the meeting July 70, 1958. ANNOUNCEMENTS: None. WARRANTS: Bills were presented for payment in the amount of 15,548.22. Councilman Treat read the itemized report of bills to be paid. ACTION: That bills in the amount of 15,548.22 be approved for payment, and that the City Clerk be authorized to draw the appropriate warrants. Fremont Hills Develo meat Com - Setting of Dates for Beginning and Completion o Off -tract an rainage Improvements. Mr. John Riley and Mr. Harry Fitzpatrick represented the Fremont -2 -- Hills Development Company. Mr. McCandless, City Engineer, was unable to be present due illness. In reference to a letter of June 241, 1958 from the Fremont Hills Development Company to the Council, Par. Riley reported that an agreement had been met with Mr. McCandless on the improvements re- quired in Unit ,#1, and that they are waiting for inspection of the other Units. He stated that the matter of a pipeline to be located near the Herb Frank lot will be taken care of. The City Clerk stated that Mr. McCandless will make no inspections until such time as work has been completed according to specifi- cations of the improvement plans. He pointed out that there is so much work that has not been done, and until it is completed, the City Engineer will not inspect Units 2, 3, and 4. -questioned regarding incompleted work, Mr. Riley stated that he would confer with the City Clerk. The City Clerk stated that the City Engineer will submit a written report of the status of improvements as noted dur% 'on site inspect- ion' made June 30b, 1958. Mr. Fitzpatrick reported that he had talked with Mr. Berger relative to the Fremont Hills Development Company being permitted to improve the drainage ditch on his property to take care of excess run off from its subdivisions, and stated that no agreement had been reached between them. Councilman Treat made reference to the action of the Meeting of June 23rd, stating that the purpose of postponing action was to give Fremont Hills an opportunity to make some arrangement with PTr. Berger or present some alternate proposal. Councilman Bledsoe stated the recommendations of the City Engineer, calling for the installation of a 30" pipe line running from Con- cepcion and West --Fremont Avenues , running Fremont Aivenue to the end of the Town Hall property to be connted to a 36" pipe line to continue down to St. Francis Drive, and that a 4'x6' reinforced concrete box culvert be installed across gest Fremont (Lvenue. In answer to the question of whether or not Fremont Hills will a- gree to the recommendations of the City Engineer of June 23rd, 19589 Mr. Riley stated that they will agree to the specifications under protest. Councilman Clayton commented on the existent danger at West Fremont and St. Francis Drive, and expressed his opinion that the Council should set a time for beginning and completion of work to be done, including the pipeline, culvert, and improvements of perimeter roads. He further stated that if the work is not completed within the specified time, the Town should take recourse under the bonds. Mr. Riley asked for clarification regarding requirements of the pro- posed pipeline and one complete culvert, stating that Fremont Hills had formerly agreed to install '/G culvert at Fremont and Concepcion -3 - and )i culvert at Fremont ,nO St. Francis Drive. rr. Fitzpatrick stated that he did not think that Fremont Hills is legally bound to put in a culvert on the other side of the road, because according to their engineers, they are only responsible for about 20510 of the water. The clarification was made that the City Engineer recommended the installation of 'r, culverts at Vest Fremont and Concepcion inter- section, and at West Fremont and St. Francis Drive or one complete culvert at i4est Fremont and St. Francis Drive. Following a lengthy discussion and the making of several motions which were subsequently withdrawn, the following action was taken: ACTION: That the matter of disposal of the excess run-off and the set- ting of dates for beginning and completion of off -tract and drainage improvements of the Fremont Hills Development Com- pany be tabled until the meeting of the Council of July 70, 1958, and that the City Clerk be instructed to request the City Engineer to submit a formal report in writing.
