TOWN OF LOS ALTOS HILLS
MINUTES OF tOJOURNED MEETING
June 23rd, 1958
The meeting was called to order by Mayor John M. Fowle Monday, June
23rd, 1958 at 7:50 P. M. at the Town Hall, 26379 'West Fremont Avenue,
Los Altos Hills.
ROLL CALL: PRESENT: Councilman Bledsoe, Clayton, Treat, Mayor Fowle

Corrections: Page 1, Item #2: The memorandum from the City
Clerk outlined the status of off -tract road
and 'drainage' improvements to be made by the
Fremont Hills Development Company.
Page 2, 1st :ara.: Reinforced box culvert to
be installed 'under' West Fremont Avenue..
Page 4, Item #4: Arthur F. Case appointed to
fill vacancy of James H. Stedman,
ACTION:
Adopt minutes of June 16t, 1958 as corrected.
ANNOUNCEMENTS:
1. Thomas B. Inglis. Mayor of City of Monte Sereno - Copy of letter to
Mayor Thomas -M. Ry;W, Chairman of Inter -City ouncil Committee on
Metropolitan Integration, dated June 19%, 1958, expressed his
views on "Metropolitan Integration" relative to municipalities.
Deferred for further study.
2. Palo Alto Unified School District - Letter, read by the Mayor, sub-
mitted a list names for a new scEool to be built in Los Altos Hills,
and solicited other suggestions.
Filed.
OLD BUSINESS:
1. Abatement of Business - City Attorney.
City Attorney Bullis stated that Mr. Jack 0. Lind had been notified
to abate his business, being conducted at his residence located at
12120 Edgecliff Place, and further stated that Mr. Lind has a-
greed to comply. The City Attorney recommended that the Council
allow Mr. Lind a reasonable time to remove his business.
The Deputy Clerk was asked to notify the signers of the petition.

2. Variances:
Congregation Beth Am,(V-25-58) - Request for Use Permit for Church.
The Mayor opened the discussion by asking for comments.
Councilman Bledsoe stated that he had made a reseach of several
district court of appeals rulings which upheld the right of a city
to exclude churches, and which allowed a city to require a church
to waive its tax exemption, conditional to establishment. He
suggested that the Council might consider requesting Churches to
waive tax exemption. Councilman Clayton concurred with Councilman
Bledsoe.
Comments from the floor were offered by Thr. Gardner Bullis, Mr.
John stutherford, Mr. Omar Spain, Mr. George Pfeiffer III, and
Mr. Roy Burkhart.
In answer to the question of whether or not the Congregation Beth
Am would consider waiving its tax exemption, Mr. Gerald D. Marcus
stated that more time would be needed to consider such a proposal.
Relative to opposition to the establishment -of churches in Los Altos
Hills, Mr. William Geer stated that the opinion of the Los Lltos
Hills Association is about evenly split.
Members of the Council agreed that a policy relative to the estab-
lishment of churches in the Town should be set prior to action on
this variance,

3. Fremont Hills Development Company - Setting of Dates for Beginning
and Tompletion of Off -tract Road and Drainage Improvements. .
The Mayor turned the gavel over to Deputy Mayor Bledsoe, and did
not take part in the ;aeeting.
Letter, dated Jane 23rd from the Fremont Hills Development Company
and signed by Mr. Harry Fitzpatrick, was received and studied by
the Council. The letter stated the status of improvements in
Units Nos. 1, 2, 3, and 4, including perimeter roads, and made
specific proposals regarding improvements about.which there is some
question. -
Mr. Fitzpatrick and Mr. John Riley were presented.
Mr. McCandless, City Engineer, stated that he would not accept the
proposal made in the letter as a whole, but stated that he would
agree to some of the specific proposals mentioned in the letter.
The suggestion was made to Mr. Fitzpatrick that he confer with Mr.
D. L. Berger relative to getting permission to open the drainage
ditch on his property to carry additional storm waters draining
from the Fremont Hills Subdivisions onto the Berger property.

Fremont Hills Continued.
ACTION:
That action be tabled on the Matter of Fremont Hills Development
Company for the purpose of giving to the interested parties to
work out an agreement with reference to the Berger property.

1. Appointment of Councilman - Thomas Sherlock.
ACTION:
That the appointment of Thomas Sherlock to the City Council
be confirmed.

2. Appointment of City Attorney - Robin D. Faisant.
ACTION:
That the appointment of Robin D. Faisant as City Attorney
be confirmed.

3. Oath of Office - Thomas Sherlock, City Councilman and Robin D.
zasan , City -Attorney were sworn into office by the Deputy Clerk.
Councilman Sherlock took his seat at the Council -table, Mr..
Fiasant will commence serving the Town. July 71b, 1958.
4. Contract With City Attorney - Read by Councilman Treat.
ACTION:
That the contract between the Town of Los lltos Hills and
Robin D. Faisant, City f+ttorney, be approved as submitted.

5. Fremont Hills Development Company - Grading Plans for Lots #8 and
#oft #20 -
Councilman
_.Councilman Sherlock explained the plans presented were to correct
a situation caused excessive grading.
Mr. Longmeir, Engineer, stated that the Plans were adequate.
ACTION:
That the City Council approve the grading plans for lots #8
and #9 of Fremont Hills Unit r#2.
MOTION: Sherlock; SECOND: Clayton; VOTE: Passed unanimously
6. Reports:
a) Police Protection for Los Altos Hills - Submitted by Council-
man Clryt8n Ed Chief of o ice Mmith.
The report was read by Councilman Clayton.
questions were raised concerning salary, retirement, and the
increase in insurance and compensation rates.
The suggestion was made that the City of Los Altos be contact-
ed relative to its Police.Department serving the Town of Los
:altos Hills on a contract basis.
Co,jncilman Clayton was asked to confer with the Sheriff's
Office, explaining the Town's plan, to see whether or not the
Town can enter into an agreement with the County for -service
on a monthly pro rata basis until such time as it is determ-
ined what action will be taken regarding a Police Department
for the Town.
b) Metropolitan Library System Conference - Mayor Fowle.
The Mayor stated that he had attended an executive meeting .
regarding the proposed tax increase for the Library Distri.ct,
The proposed increase would be from 4.3¢ to 8¢ and will be
used to enlarge the district's library facilities. Approval of
the Council was given at this meeting, and the Mayor asked
Council to formally approve this action.
ACTION:
That the Mayor's action be approved.

That the appointment of the cor=ittee, by the Mayor, be con-
firmed.
